This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This synopsis is to notify contractors that the government intends to issue a Purchase Order in accordance with FAR Part 13 for the following, under simplified acquisition procedures. The Request for Quotation (RFQ) number is FDA-SOL-15-1148652. Provisions and clauses in effect through Federal Acquisition Circular 2005-82 are incorporated into this request. It is the contractor's responsibility to be familiar with the applicable clauses and provisions. The provisions and clauses may be accessed in full text at www.acquisition.gov/far. The NAICS code is 511120, Periodical Publishers. All qualified vendors are encouraged to respond.

Statement of Work

Background and Purpose

FDA researchers require unlimited access to electronic journals to conduct research and reviews, stay informed on current scientific information and meet the research mission of the FDA. The online platform must allow quick searches across all resources simultaneously in one search statement. The FDA’s Biosciences Library requires 24/7 online electronic access to all of the listed informational resources reduces the need for multiple individual copies of expensive resources and decreases document delivery costs.

These resources are highly valued and used by FDA researchers in support of the Agency mission as evidenced by usage statistics.

FDA has purchased perpetual access to ScienceDirect backfiles, access to the Freedom Collection and selected Cell Press & Clinic titles. Backfile collections procured include:

Agriculture & Biological Sciences, Anesthesiology, Chemical Engineering and Physical and Analytical Chemistry, Emergency Medicine, Environmental Science, Immunology and Microbiology, Materials Science, Medicine and Dentistry collection (7 of 17 sections), Organic Chemistry, Pain Medicine, Pharmacology, The Lancet, Toxicology and Pharmaceutics, Radiology and Imaging and Veterinary Science.

With the backfiles, FDA has perpetual access to the full-text of content from a selection of journal articles from these subject areas with years of coverage prior to January 1995.

The purpose of this acquisition is to purchase the following backfiles:

Cell Press (brand name or equal)

Custom Single File Backfile (brand name or equal) http://www.acquisition.gov/far

Scope of Work

With the Subject Backfile Collections providing complete archival access, FDA researchers shall experience seamless access to current and historical literature between current journal content on ScienceDirect and archival content starting at the inception of the respective journal. The contractor shall provide efficient, time-saving and convenient desktop access through a single platform. It shall also eliminate the need for the Library to maintain the print saving space and time required for technical processing of document requests. The contractor shall provide researchers with the ability to seamlessly link to the full-text of citations for journals the library subscribes to when conducting searches in various databases.

Requirements

The contractor shall provide Cell Press (brand name or equal) and Custom Single File Backfile (brand name or equal) with following salient characteristics:

• An Agency wide site license for 24/7 desktop web access, via IP

• Customer service shall be available to troubleshoot website/connectivity issues via phone, email, etc. during normal business hours

• Researchers and librarians shall have access to all of the resources and must be able to search selected resources with one query and one interface.

• Researchers shall have the ability to set up alerts to keep current by registering for a username and password.

• Researchers shall have the ability to display related articles, i.e. to pull up other articles related to their area of research when they retrieve their original search results

• The interface shall be hosted on the contractor’s server (ScienceDirect Elsevier platform or equal to) with IP access.

• Researchers shall the ability to register for a username and password access to establish alerts to be ran on a regular basis to keep current with their subject area of expertise.

• Usage statistics shall be provided on a monthly basis by the vendor.

Vendor quotes shall address how the proposed solution will comply with Section 508.

Specifically the following 508 Standards are applicable:

Section 508 Compliance

Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d) requires Federal agencies to purchase electronic and information technologies (EIT) that meet specific accessibility standards. This law helps to ensure that federal employees with disabilities have access to, and use of, the information and data they need to do their jobs. Furthermore, this law ensures that members of the public with disabilities have the ability to access government information and services.

There are three regulations addressing the requirements detailed in Section 508. The Section 508 technical and functional standards are codified at 36 CFR Part 1194 and may be accessed through the Access Board’s Web site at http://www.access-board.gov. The second regulation issued to implement Section 508 is the Federal Acquisition Regulation (FAR). FAR Part 39.2 requires that agency acquisitions of Electronic and Information http://www.access-board.gov/

Technology (EIT) comply with the Access Board’s standards. The entire FAR is found at Chapter 1 of the Code of Federal Register (CFR) Title 48, located at http://www.acquisition.gov. The FAR rule implementing Section 508 can be found at http://www.section508.gov. The third applicable regulation is the HHS Acquisition Regulation (HHSAR).

Regardless of format, all Web content or communications materials produced for publication on or delivery via HHS Web sites - including text, audio or video - must conform to applicable Section 508 standards to allow federal employees and members of the public with disabilities to access information that is comparable to information provided to persons without disabilities. All contractors (including subcontractors) or consultants responsible for preparing or posting content intended for use on an HHS-funded or HHS-managed Web site must comply with applicable Section 508 accessibility standards, and where applicable, those set forth in the referenced policy or standards documents below.

Remediation of any materials that do not comply with the applicable provisions of 36 CFR Part 1194 as set forth in the SOW, shall be the responsibility of the contractor or consultant retained to produce the Web-suitable content or communications material.

Unless an agency exception to this requirement exists, the Contractor must conform to applicable Section 508 standards and must apply best practices associated with Section 508 compliance during the application design, development, and testing phases. The Contractor shall utilize FDA approved tools to verify the compliance with the Section 508 standards and ensure the delivery of the fully compliant products.

Authorized Resellers / Authorized Companies

The Contractor shall be an OEM authorized reseller and/or servicing agent for the maintenance of the software licenses while performing on this contract. The Contractor shall provide documentation (i.e. service agreement, etc.) to confirm that they are authorized resellers and/or servicing agent of the product to be serviced.

Confidential Treatment of Sensitive Information The Contractor shall guarantee strict confidentiality of the information/data that it is provided by the Government during the performance of the task order. The Government has determined that the information/data that the Contractor will be provided during the performance of the task order is of a sensitive nature.

Disclosure of the information/data, in whole or in part, by the Contractor can only be made after the Contractor receives prior written approval from the Contracting Officer. Whenever the Contractor is uncertain with regard to the proper handling of information/data under the contract, the Contractor shall obtain a written determination from the Contracting Officer.

Instructions to Quoters

• The vendor must complete the Price Breakdown in Deliverable Section.

• The vendor must identify all items.

• The vendor is requested to hold price quotations for a minimum of 60 days.

• Quotes must be firm-fixed-priced and be inclusive of all cost.

• Quotes must be for all the items requested or none.

• All quoters shall submit the terms and conditions in full text with their quote.

• Quoters must submit two (2) volumes of their quotation, One (1) volume with technical information and one (1) copy with pricing. Technical volume shall not contain any pricing information. Quotations must meet all the requirements of this solicitation in order to be considered technically acceptable.

• “Equal to” quotations must submit Technical volume with detailed point-by-point description of how the equal to product meets all the requirements of this solicitation. “Equal to” quotations shall be required to operate seamlessly with connecting operating software, hardware and FDA infrastructure.

• Authorized reseller and/or servicing agent must identify and/or provide documentation to confirm their claim as an authorized reseller and/or servicing agent.

• The Quoter shall notify the Contract Specialist / Contracting Officer immediately if this requirement is registered by a reseller with the Original Equipment Manufacturer (OEM).

• Quoters are advised that additional terms and conditions submitted with their quotation that is in conflict of the terms and conditions of this solicitation may be deems as technically unacceptable and may not be considered for award.

• Quoters responding to this RFQ must be registered with an Active status in the System for Award Management (SAM)

In accordance with FAR 52.212-4, Offerors shall be registered in the SAM database to be considered for award. Registration is free and can be completed on-line. Please visit the System for Award Management (SAM) at: www.sam.gov to register.

Evaluation Factor for Award

• Quotes will be evaluated on a lowest price technically acceptable basis. Technical acceptability will be determined by a quoter’s ability to meet each of the salient characteristics, meet the required delivery date, and provide the service described in this solicitation. Among those quotes determined to be technically acceptable, the Government will award to the lowest priced quote.

Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment By Electronic Funds Transfer – Central Contractor Registration) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(I) Name and Address of the Contractor;

(IX) Taxpayer identification number (TIN);

(X) Electronic funds transfer (EFT) banking information, including routing transit number of the financial institution receiving payment and the number of the account into which funds are to be deposited;

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215- 2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor.

a) Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor.

(b) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.

(c) Include the substance of this clause, including this paragraph (c), in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial items.
