Part 1 – Description

The U.S. Food and Drug Administration (FDA) has a requirement for a Supply/Service contract - REAL TIME PROCESS MONITORING (PAT) FOR DOWNSTREAM OPERATIONS (BRAND NAME OR EQUAL). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a separate written solicitation will not be issued.

This solicitation is a Request for Quote (RFQ) using FAR Parts 12 and 13 procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-05. The North American Industry Classification System (NAICS) code for the proposed acquisition is 334516, Analytical Laboratory Instrument Manufacturing, small business size standard 1000 employees. This requirement is full and open.

Part 3 – Description/Specifications

3.1 Background

OBP currently owns and operates several preparative FPLC systems for purification of biomanufactured drug product as well as multiple analytical U/HPLC systems for product quality assessment in biopharmaceutical manufacturing research, however these systems all function as separate unit operations. We require an integrated real-time process monitoring solution for downstream manufacturing to support research for advanced/continuous manufacturing control strategies that would link the purification stream with automated sample UPLC analysis. Large molecule drug formulations are complex and the manufacturing process has an inherent variability. The regulatory challenges posed in this field require research to provide new regulatory understanding to assist review staff in their evaluation. These complex drug formulations require enhanced product assessment and control strategies during the manufacturing process. Advanced analytics provided by the requirement can facilitate review and enhance safety of drug products during manufacture. This allows for better support of emerging control processes for advances in Continuous Manufacturing of such drug products.

An ideal integrated solution will allow for automated sampling of multiple sites from FPLC(s) pre- and/or post-column with transfer for direct injection to 1 or more UPLC autosamplers for liquid chromatography analysis- minimal excess plumbing, easy to operate pumps and valves with intuitive timing control (software wizard), luer-lock or similar connections if appropriate, no intermediate liquid handler so as to more closely model a continuous and closed system.

The sampling should occur over several time points for the duration of purification and/or be triggered automatically from instrument detector feedback (e.g change in UV absorbance/conductivity/pH/pressure) or manually by operator.

Modification of native equipment operation software (such as Unicorn, OpenLab CDS/ChemStation, etc) to a SCADA (supervisory control and data acquisition) for all systems is acceptable if possible/available otherwise a third-party SCADA for this integration is acceptable. Other options may include a stand-alone automated fluidics control module with liquid handler for transferring samples from holding vessels between FPLC and UPLC injection. Software should be user-friendly for scientists/lab technicians with zero background in computer science/programming. Ability to meet technical outcomes and integrate solution with existing lab instruments will be considered more than cost alone. Off-the-shelf commercially available solution with established OPC (cross-instrument communication) capability preferred to a system that will require extensive development and testing before implementation.

3.2 Statement of Work/Salient Characteristics

The contractor shall provide the Government with a System that meets or exceeds the salient characteristics described below:

Performance / Specifications: The instrument shall meet the following performance / specifications:

Supply/Services will include all of the following:

EQUAL). Proposals should include itemized list and diagrams of any and all equipment to be supplied (plus new

3 | P a g e system control workstation) with size/weight specifications and description of integration plan/ connections with FPLC(s) and UPLC(s)

Integration with several existing lab-owned scientific instruments: at least 1 FPLC type and at least 1 UPLC type (specs for FPLC and UPLC listed below) currently in the lab must have control module/software connection and an integrated process stream for sampling during downstream protein purification steps as a result of this contract. An external variable pathlength spectrometer is also available for integration and may be used to detect protein concentration in samples of dynamic process fluid post FPLC column but before UPLC injection.

An ideal integrated solution will allow for multiple sampling sites from FPLC(s) pre and/or post-column with direct injection to 1 or more UPLC autosamplers for liquid chromatography analysis- minimal excess plumbing, easy to operate pumps and valves with intuitive timing control, luer-lock or similar connections if appropriate. The sampling should occur over several timepoints for the duration of a run and/or be triggered automatically from instrument detector feedback (e.g change in UV absorbance/conductivity/pH/pressure) or manually by operator. Modification of native equipment operation software (such as Unicorn, OpenLab CDS/ChemStation, Empower, etc) to a SCADA (supervisory control and data acquisition) for all systems is acceptable if possible/available otherwise a third-party SCADA for this integration is acceptable. Other options may include a stand-alone automated fluidics control module with liquid handler transferring samples from holding vessels between FPLC and UPLC injection. Software should be user-friendly for scientists/lab technicians with zero background in computer science/programming. Ability to meet technical outcomes and integrate solution with existing lab instruments will be considered more than cost alone.

Existing instruments must still be operational with original settings for research not utilizing integrated configuration.as the following; thus, the new system must include the following:

• Automated system should be able to prepare samples before UPLC injection (concentration adjustment, buffer addition, etc.) when required for analysis method, or be able to indicate sample information to UPLC for manipulation by native autosampler.

• FPLC compatibility:

o -GE Healthcare (now Cytiva) Akta Avant 25 with Unicorn v.7.xx software o -Pall (now Sartorius) Cadence BioSMB PD (native software) o -Chromacon ContiChrom CUBE with ChromIQ software

• UPLC compatibility:

o -Agilent Infinity II LC 1290 series with high speed binary pump, multisampler, multicolumn thermostat compartment and dioda array detector (OpenLab CDS software with ECM networked server)

• Variable pathlength UV-Vis-NIR Cary Spectrophotometer compatibility:

o -C technologies FlowVPE (Flow VPE, Cary WinUV, and NiDAW software)

• Sample data (timestamp, sample point, inline measurement info, etc) should be captured for data processing and management with analysis results. System must be able to communicate with main data storage/data management structure (Agilent Open Lab CDS or Unchained Labs LEA software)

• All systems and parts should be compatible with solvents, buffers, and process/sanitization fluids typical of biomanufacturing and purification of large molecule drug substance and drug product (clarified harvest media, isopropanol/ethanol, wide pH and salt/conductivity range, etc.).

• Capable of very small sample volumes with minimal dead volume from any tubing connections

• Able to sample from several sample points directly post-FPLC columns or from surge vessel intermediates and delivery sample to at least 1 UPLC

• Capability to sample multiple times from all sample points during a purification run

• Sampling by manual operator intervention AND automated with pre-programmed schedule and/or triggered by inline detectors (such as UV, conductivity, pH, etc.)

• Small footprint expected within lab/bench scale size. Max depth 35in; width approx. 20in.

• Power supply compatible with US standards 120V/60Hz.

Delivery, Installation, Training, and Support:

The entire system must ship as one lot, no back orders allowed. If shipments must be sent separately, payment will not be made until all deliveries have been made. The vendor shall cover all costs associated with the following:

• Within 2 weeks post award- contact TPOC with any additional system control software version specifications in order to complete IT request approvals with FDA Scientific Computing department and to coordinate any ongoing IT needs

• Integrated solution that includes automated sampling system and/or fluidics routing module, and/or liquid handler with any tubing/connectors/external pumps/valves or peripherals required to sample from FPLC and inject to UPLC with control workstation, instrument control and data processing software, and any drivers/OPC required for operation.

• System/instrument delivery; installation, IQ/OQ performed by qualified OEM technician/engineer(s).

• Training of FDA scientists performed by qualified OEM technicians/engineers/application specialists; digital copy of reference/training materials should be provided.

• Vendor must provide required consumables for initial installation and system IQ/OQ and at least 1 extra set of tubing, connectors, and/or other consumable parts (specific to system design and operation)

• Provide list- or check with TPOC- of any other consumable supplies (if applicable) commonly found in bioprocessing laboratories at least 1-month pre-delivery to ensure availability

• Reporting Requirements and Deliverables: After a PM or repair visit is concluded on the system and associated interfaces, a summary report is required to be provided to the primary user (employee of Bioprocessing Lab).

Regular reports (monthly, quarterly) are not required.

General Service Requirements:

• Only certified field technicians will perform all installation and training of the equipment

• Software support and maintenance will be included. Updates for software will be provided at the time of scheduled Preventive Maintenance.

• Unlimited technical support Mondays - Fridays (excluding Federal Holidays) between the hours of 8a- 5p Central Time, within 8 business hours of contact for assistance (e.g. telephone, email, website, etc.)

• Must be able to provide any needed parts, labor, and travel for repair in a timely fashion (3-7 days)

• Scheduling must be Monday-Friday between the hours of 8am-4:30pm.

• Scheduling to be coordinated through the TPOC on the contract: TBD

• All technicians must have a valid U.S. Driver’s license, a Legal Permanent Resident Card or Green Card for entry through security.

Capabilities Statement:

Must be able to integrate with several existing scientific instruments: at least 1 FPLC type (Pall BioSMB PD, Chromacon Contichrom CUBE, GE Akta AVANT 25) and UPLC (Agilent) that are currently owned; must have an integrated process stream for sampling and control module/software connection as a result of this contract.

FOB-Destination - System crating, shipping, and delivery to FDA location below shall be covered by the vendor.

Part 4 –Performance and Deliverables

4.1 Place of Performance and Work Hours

All applicable equipment is located at the location listed below. Normal workdays are Monday through Friday except US Federal Holidays. Work hours are typically from 8 am to 5 pm (ET). Service visits shall be coordinated with (TBD), see below.

The vendor will be responsible for shipping and handling costs, inside installation, and on-site instrument training.

Delivery on-site at CDER’s facilities in:

Silver Spring, MD (Building 72, Second floor labs, 10903 New Hampshire Ave, Silver Spring, MD 20903), unless otherwise indicated. The FDA’s Technical Point of Contact (TPOC) will approve all tasks and deliverables.

For all on-site maintenance, the Contractor’s personnel are required to report to the security guards at the White Oak Building 75, 10903 New Hampshire Ave, Silver Spring, MD 20903, who will contact the TPOC or his or her designated FDA employee. The Contractor’s personnel must always be escorted by the TPOC or his or her designated

FDA employee while working on-site under this order. The Contractor shall perform all on-site maintenance service during the hours of 8:00 am to 4:00 pm ET, Monday through Friday, unless otherwise indicated by the TPOC.

4.2 Period of Performance

REAL TIME PROCESS MONITORING (PAT) FOR DOWNSTREAM OPERATIONS (BRAND NAME OR

EQUAL) shall be Delivered within 120 days of the award.

Period of Performance shall be for one (1) (base) year and four (4) option years. Start of period TBD.

4.3 Deliverables

4.4 Optional Service/Maintenance Agreement

The FDA shall have a unilateral right to exercise optional periods of service/maintenance coverage on the instrument described in section 3.2. This service agreement shall cover all parts, labor and travel necessary to maintain the instrument.

The option period of performance(s), if exercised, shall commence as follows:

The vendor shall offer a Warranty to cover installed system, control module, and all parts for 12 months

• Should include all required corrective service, inclusive of parts/labor/travel costs

• Replacement parts should be genuine OEM parts

• Maintenance and repair activities shall be performed by formally trained and certified technicians/engineers, following OEM specifications, manuals, and service bulletins, using new OEM replacement parts, components, subassemblies, etc.

• Option Year service maintenance plan pricing requested

Part 5 –Contract Administration

5.1 Contracting Officer’s Representative

The Contracting Officer’s Representative (COR) will perform inspection and acceptance of equipment and services to be provided.

For the purpose of this PART, (COR TBD) is the authorized representative of the Contracting Officer.

The COR is responsible for the following as required by this order: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluations; (4) performing technical inspections and acceptances; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as an agent of the Government under this order.

Only the Contracting Officer has authority to: direct or negotiate any changes in the order, including modifying or extending the period of performance, changing the delivery schedule, authorizing reimbursement to the Contractor for any costs incurred during the performance of this order, or otherwise change any terms and conditions of this order.

5.2 FDA Three-Way Match Invoicing Procedures

A. The contractor shall submit all invoices to:

B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer - System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(i) Name and address of the contractor;

(ii) Invoice date and invoice number;

(iii) Contract/Order number (including a reference to any base award for Indefinite-Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);

(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:

(a) period of performance for which costs are claimed;

(b) itemized travel costs, including origin and destination;

(c) any other supporting information necessary to clarify questionable expenditures;

(d) the contractor shall include the award item number for each description, quantity, unit of measure, unit price, and extended price supplies delivered, or services performed;

(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;

(vi) Terms of any discount for prompt payment offered (Prompt Payment terms other than NET 30);

(xii) For all Inspections, Time-and-Materials and Labor-Hour Awards, Contractor is required to attach an invoice log addendum to each invoice which shall include, at a minimum, the following information for contract administration and reconciliation purposes:

(a) list of all invoices submitted to date under the subject award, including the following:

(1) invoice number, amount, & date submitted

(2) corresponding payment amount & date received

(b) total amount of all payments received to date under the subject contract or order

(c) and, for definitized contracts or orders only, total estimated amounts yet to be invoiced for the current, active period of performance;

(xiii) Any other information or documentation required by the award.

C. An electronic invoice is acceptable if submitted in Adobe Acrobat (PDF) format. All items listed in (i) through

(xiii) of this clause must be included in the electronic invoice. Electronic invoices must be on company letterhead and must contain no ink changes and be legible for printing.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
