Preventative Maintenance Plan for Autoclaves at FDA W.E.A.C. Laboratory
(Open Market)
1. Purpose & Scope:
Autoclaves are an essential piece of equipment in the microbiology laboratory. They are needed to sterilize media used in regulatory work and research and to decontaminate bio-hazardous waste so it is safe for disposal. Because of their central role autoclaves are heavily used and can be prone to break-downs if not properly maintained. When an autoclave is not functioning properly the work-flow of the laboratory can be severely affected. A well-executed comprehensive preventative maintenance plan for WEAC’s laboratory autoclaves will help reduce the incidence of autoclave break-down and ensure lab efficiency. There are 3 autoclaves in total.
2. Requirements:
The following is a description of the minimum performance requirements under this contract:
1. Shall include the cost of all scheduled and unscheduled labor, travel, and parts.
2. Shall replace or repair parts using original equipment manufacturer’s parts.
3. Shall provide regularly scheduled maintenance and safety inspections.
4. Shall provide a service audit to show acceptable service is being provided.
5. Shall provide online and/or phone service to allow service requests and for ordering parts.
6. Shall provide detailed service documentation.
7. Shall provide technical support by phone and/or online.
8. Shall be available onsite within 48 hours of service request.

3. Place of Performance & Government Point of Contact:
Autoclaves will be serviced at FDA Laboratory located at:
Winchester Engineering & Analytical Center (WEAC) 109 Holton Street Winchester, MA 01890
The government will provide the technician access to the laboratory area where the instrument resides.

4. Period of Performance:
The period of performance is for the period of a base year and (4) our option periods.
Base: April 2019 – April 2020 Opt1: April 2020 – April 2021 Opt2: April 2021 – April 2022 Opt3: April 2022 – April 2023 Opt4: April 2023 – April 2024
*Option Year pricing shall be fixed-priced in order to be considered. The FDA will not consider fluctuating pricing pertaining to Options*
The services must be performed during regular business hours (Monday-Friday) during the times of 8:00 AM – 4:00 PM Eastern Time.
The services shall not be scheduled during Federal Holidays or Federal Closures as determined by Executive Orders or WWW.OPM.GOV. Federal holidays are as follows:
New Year’s Day Martin Luther King, Jr.
Washington’s Birthday Memorial Day Independence Day Labor Day Columbus Day Veteran’s Day Thanksgiving Day Christmas Day
5. Inspection and Acceptance:
The COR or duly authorized representative shall perform inspection and acceptance of products/services. The performance criteria for these products shall be timely delivery and closure of all activities and deliverables listed within the SOW and within the established Period of Performance.
6. Security
It is not anticipated that the contractor will be exposed to sensitive Agency information or data.
But, the contractor agrees that the contract personnel will not divulge or release information or data developed or obtained in connection with performance of this contract, unless made public mailto:Kyle.smith@fda.hhs.gov by FDA or upon written approval by the COR. FDA will retain all data rights and access upon completion of the tasks.
7. Invoicing Instructions

*** Acceptable methods of delivery include: E-mail (preferred) and Standard Mail.
B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:
(i) Name and address of the contractor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite- Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;
(b) itemized travel costs, including origin and destination;
(c) any other supporting information necessary to clarify questionable expenditures;
(d) the contractor shall include the Contract Line Item/Funding line item for each description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed;
(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;
(vi) Terms of any discount for prompt payment offered (Prompt Payment terms other than NET 30);
(vii) Name and address of official to whom payment is to be sent (must be the same as that in the purchase order/award, or in a proper notice of assignment)
(viii) Name, title, and phone number of person to notify in event of defective invoice;
(ix) Taxpayer Identification Number (TIN);
(x) Electronic funds transfer (EFT) banking information, including routing transit number of the financial institution receiving payment;
(xi) Name and telephone number of the FDA Contracting Officer Representative (COR) or other Program Center/Office point of contact, as referenced on the award;
(xii) For all Time-and-Materials and Labor-Hour Awards, Contractor is required to attach an invoice log addendum to each invoice which shall include, at a minimum, the following information for contract administration and reconciliation purposes:
(a) list of all invoices submitted to date under the subject award, including the following:
(1) invoice number, amount, & date submitted
(2) corresponding payment amount & date received
(b) total amount of all payments received to date under the subject contract or order
(c) and, for definitized contracts or orders only, total estimated amounts yet to be invoiced for the current, active period of performance;
(xiii) Any other information or documentation required by the award.
C. An electronic invoice is acceptable if submitted in adobe acrobat (PDF) format. All items listed in (i) through (xiii) of this clause must be included in the electronic invoice. Electronic invoices must be on company letterhead and must contain no ink changes and be legible for printing.
D. Questions regarding invoice payments should be directed to the FDA Payment Office at the e-mail address provided above in Section A.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Section 508 Evaluation Factors Responses to this solicitation will only be considered for award after it has been determined that the proposal adequately addresses the requirements for Section 508. Only proposals which contain adequate information to document their responsiveness to the Section 508 requirements (e.g. accessibility capabilities and past performance) will be eligible for any additional merit consideration.
Section 508 Acceptance Criteria Date and Information Services outputs/deliverables resulting from this solicitation will be accepted based in part on satisfaction of identified Section 508 requirements for accessibility.
Data Services or Information Retrieval Systems outputs/deliverables must include a completed GPAT, a sample of which is included as a part of this solicitation.

10. Instructions to Quoters
All Quoter’s who can provide these items are strongly encouraged to submit a quote.
Quotes are due no later than 12:00 PM (Eastern Time) on March 26. 2019.
Quoter’s shall submit quotes via email to kyle.smith@fda.hhs.gov that comply with all technical requirements of the solicitation and contain the best terms from a price standpoint.
Within the quote, each period of the contract (base and each option period) should be separately priced. Option period pricing must be fixed price in order to be considered. Quotes must clearly state the overall price to the Government (base and options). Quoter’s shall submit all assumptions in their quotation. All Quotes shall remain valid for a minimum of sixty (60) days.
Quoter’s shall submit all applicable terms and conditions in full text as attachments, appendix, or exhibits. Quoters shall submit Product Accessibility Templates (PAT) in full text with their quotations.
Quoters are advised that additional terms and conditions submitted with their quotation that are in conflict of the terms and conditions of this solicitation may be deemed to be technically unacceptable and may not be considered for award.
Open Market items/services will be accepted
11. Evaluation
FDA will evaluate all quotes received in response to this RFQ by using the lowest-price-technically-acceptable (LPTA) methodology. Quotes must meet all the salient functional characteristics and requirements of this solicitation in order to be considered technically acceptable. FDA will issue the award to the Quoter whose proposed solution meets all technical requirements, including the Terms and Conditions identified within the solicitation, and whose overall price is lowest. Quoter’s are advised that additional terms and conditions submitted with their quotation that are in conflict of the terms and conditions of this solicitation may be deemed technically unacceptable and may not be considered for award.
