Elsevier ScienceDirect Subscription (or Equal)
(Open Market)
1. Purpose & Scope:
FDA researchers require access to Elsevier ScienceDirect platform that includes Subscribed titles, the Freedom Collection and selected ebooks to conduct research and reviews, stay informed on current scientific information and to meet the research mission of the FDA. Library requires online electronic access to all the above information resources in order to satisfy FDA researcher’s information needs and ensure they have access to the information they require to do their work. These resources are highly valued and used by FDA researchers in support of the Agency mission as evidenced by usage statistics. Usage stats reporting for FY17 indicate 440,000 hits to the Science Direct, Cell Press, and Freedom collection ejournals and 10,000 hits to the ebook collection.
Elsevier is a leading publisher of health science journals, books, and databases. The interface is used to access more than a quarter of the world’s scientific, medical, and technical information online.
The Library has also procured sole source various backfiles over the years as listed below:

This requirement is for a 3- year (base and two option years) contract for electronic access to Elsevier journals, Freedom Collection and selected ebooks. Provides for unlimited users and search access based on IP authentication. They are available to users of the FDA network 24/7.
The requirement will include current year access to the attached list of titles which comes with archival content for most titles starting from the year 1995.
2. Requirements:
The FDA requires online access to subscribed titles (including Cell Press) of high interest, Freedom Collection, and selected ebooks. For many of the subscribed titles, our access begins with 1995. See attached spreadsheet for journal titles.
3. Deliverables
a) An enterprise wide site license for 24/7 desktop web access via IP authentication. Unlimited users and downloads to subscribed titles. The journals/books are hosted on the contractor’s server.
b) Furnish support for IP modifications and other technical issues pertaining to website/database.
c) Supply usage statistics for material via a portal or vendor supplied on a monthly basis
d) Material must be full text, including photographs, images, tables, graphs, etc. in a range of delivery options, including but not limited to intranet and devices.
e) Newest issue must be available with no time embargoes or schedule delays.
f) The Government retains archive access to subscribed material, as stipulated in the Elsevier subscription agreement.
g) Provide access to purchased archive collection (if applicable), as stipulated in the Elsevier subscription agreement.
h) One (1) website database supplying right of entry with advanced search and basis retrieval options.
i) Support government Interlibrary Loan and Document Delivery standards and service in compliance with copyright laws, including the CONTU guidelines.
j) Timely compliance with linking tools to allow for interoperability within the Library and Agency resources.
k) Customer service shall be available to troubleshoot website/connectivity issues via phone with a toll free number and email via web form.

5. Period of Performance:
Base: 1/1/2019-12/31/2019 Option Year 1: 1/1/2020-12/31/2020 Option Year 2: 1/1/2021-12/31/2021
6. Inspection and Acceptance:
The COR or duly authorized representative shall perform inspection and acceptance of products.
The performance criteria for these products shall be timely delivery and closure of all activities and deliverables listed within the SOW and within the established Period of Performance.
7. Security
It is not anticipated that the contractor will be exposed to sensitive Agency information or data.
But, the contractor agrees that the contract personnel will not divulge or release information or data developed or obtained in connection with performance of this contract, unless made public by FDA or upon written approval by the COR. FDA will retain all data rights and access upon completion of the tasks.
8. Invoicing Instructions

*** Acceptable methods of delivery include: E-mail (preferred) and Standard Mail.
B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:
(i) Name and address of the contractor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite- Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;
(b) itemized travel costs, including origin and destination;
(c) any other supporting information necessary to clarify questionable expenditures;
(d) the contractor shall include the Contract Line Item/Funding line item for each description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed;
(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;
(vi) Terms of any discount for prompt payment offered (Prompt Payment terms other than NET 30);
(vii) Name and address of official to whom payment is to be sent (must be the same as that in the purchase order/award, or in a proper notice of assignment)
(viii) Name, title, and phone number of person to notify in event of defective invoice;
(ix) Taxpayer Identification Number (TIN);
(x) Electronic funds transfer (EFT) banking information, including routing transit number of the financial institution receiving payment;
(xi) Name and telephone number of the FDA Contracting Officer Representative (COR) or other Program Center/Office point of contact, as referenced on the award;
(xii) For all Time-and-Materials and Labor-Hour Awards, Contractor is required to attach an invoice log addendum to each invoice which shall include, at a minimum, the following information for contract administration and reconciliation purposes:
(a) list of all invoices submitted to date under the subject award, including the following:
(1) invoice number, amount, & date submitted
(2) corresponding payment amount & date received
(b) total amount of all payments received to date under the subject contract or order
(c) and, for definitized contracts or orders only, total estimated amounts yet to be invoiced for the current, active period of performance;
(xiii) Any other information or documentation required by the award.
C. An electronic invoice is acceptable if submitted in adobe acrobat (PDF) format. All items listed in (i) through (xiii) of this clause must be included in the electronic invoice. Electronic invoices must be on company letterhead and must contain no ink changes and be legible for printing.
D. Questions regarding invoice payments should be directed to the FDA Payment Office at the e-mail address provided above in Section A.
9. Clauses:
52.217-8 Option to Extend Services (November 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months.

52.217-9 Option to Extend the Term of the Contract (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 1 day before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 years.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Requirements for accessibility based on Section 508 of the Rehabilitation Act of 1973 (29 U.S.C.
794d) are determined to be relevant for the following program need: "Data Services or Information Retrieval Systems."
Section 508 Deliverable Requirements The activity to be performed relates to or requires the use of EIT. Section 508 must be considered as a requirement for Systems Administration outputs/deliverables to ensure that it considers specific Section 508 accessibility requirements. Further, Systems Administration outputs/deliverables should not adversely affect accessibility features of existing EIT technologies. Technical standards from 36 CFR part 1194 Subpart B have been determined to apply to this acquisition. Solicitation respondents must describe how their background and experience will enable them to at least meet those technical provisions identified as applicable in the attached Government Product/Service Accessibility Template (GPAT).
Data Services or Information Retrieval Systems outputs/deliverables should meet applicable accessibility requirements and should not adversely affect accessibility features of existing EIT technologies.
Functional performance criteria from 36 CFR part 1194 Subpart C have been determined to apply to this acquisition. Section 508 Evaluation Factors Responses to this solicitation will only be considered for award after it has been determined that the proposal adequately addresses the requirements for Section 508. Only proposals which contain adequate information to document their responsiveness to the Section 508 requirements (e.g. accessibility capabilities and past performance) will be eligible for any additional merit consideration.
Section 508 Acceptance Criteria Date and Information Services outputs/deliverables resulting from this solicitation will be accepted based in part on satisfaction of identified Section 508 requirements for accessibility.
Data Services or Information Retrieval Systems outputs/deliverables must include a completed GPAT, a sample of which is included as a part of this solicitation.

11. Instructions to Quoters
All Quoter’s who can provide these items are strongly encouraged to submit a quote.
Quotes are due no later than 12:00 PM (Eastern Time) on Wednesday December 19. 2018.
Quoter’s shall submit quotes via email to kyle.smith@fda.hhs.gov that comply with all technical requirements of the solicitation and contain the best terms from a price standpoint.
Within the quote, each period of the contract (base and each option period) should be separately priced. Option period pricing must be fixed price in order to be considered. Quotes must clearly state the overall price to the Government (base and options). Quoter’s shall submit all assumptions in their quotation. All Quotes shall remain valid for a minimum of sixty (60) days.
Quoter’s shall submit all applicable terms and conditions in full text as attachments, appendix, or exhibits. Quoters shall submit Product Accessibility Templates (PAT) in full text with their quotations.
Quoters are advised that additional terms and conditions submitted with their quotation that are in conflict of the terms and conditions of this solicitation may be deemed to be technically unacceptable and may not be considered for award.
Open Market items will be accepted.

FDA will evaluate all quotes received in response to this RFQ by using the lowest-price-technically-acceptable (LPTA) methodology. Quotes must meet all the salient functional characteristics and requirements of this solicitation in order to be considered technically acceptable. FDA will issue the award to the Quoter whose proposed solution meets all technical requirements, including the Terms and Conditions identified within the solicitation, and whose overall price is lowest. Quoter’s are advised that additional terms and conditions submitted with their quotation that are in conflict of the terms and conditions of this solicitation may be deemed technically unacceptable and may not be considered for award.
