This is a combined synopsis/solicitation for commercial items prepared in accordance with the Federal Acquisition Regulation (FAR) format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. It is the Government's intent to issue a Firm Fixed Priced Purchase Order in accordance with FAR Part 13.5.
The solicitation number is FDA-1210010. This solicitation is issued as a Request for Quote (RFQ).
The solicitation document and incorporated provisions and clauses in effect through the Federal Acquisition Circular 2019-02 dated May 26, 2019.
The appropriate NAICS code for the acquisition is 332999 -- All Other Miscellaneous Fabricated Metal Product Manufacturing; Small Business Size standards – 750 employees. This requirement is a Total Small Business Set-Aside.
Background/Statement of Need:
The Center for Biologics Evaluation and Research (CBER), Division of Veterinary Services (DVS) is responsible for support of all aspects of Food and Drug Administration’s (FDA) laboratory animal care and use program on the FDA’s White Oak campus. DVS administers a comprehensive set of animal-related services, providing for the humane care and health of research animals. Routine services include animal procurement, quarantine, transportation and housing, provision of diet, water, and enrichment, daily observation of animals with reporting of abnormal health conditions, as well as sanitization of rooms, cages, racks, and other equipment. DVS currently requires various caging and rack types for mice and rabbits.
Minimum Technical Requirements:
1. IVC racks and cages shall be compatible with currently owned Allentown NexGen Lo-Profile system:
a. Ten (10) -140 cages per rack complete with cages, and all required cage components:
Positive/Negative Control (PNC) housing
Same Side Plenums with 4" Exhaust (Right side) & 4" Supply
Cage runners (Plastic)
Equipped with Edstrom Stainless Steel Automated Watering with removable valve (SHR design)
5" x 1.25" Gray Retort Casters, Integrated Cage Locks, Double Face, 7 Columns with 10 Tiers and the IVC Mouse rack
Animal holding Cage air shall exhaust via cage filter top self-sealing exhaust port, must include metal snap ring to prevent port from detaching from cage
Cages shall be equipped with air supply bullet inside the cage bottom level
b. Six (6) – 70 cages per rack complete with cages, and all required cage components:

2. The following additional technical requirements shall be met:
a. IVC racks (both 140 and 70-cage racks) shall be supplied with all caging components capable of providing HEPA-filtered supply and exhaust air, gasketed micro barrier filter tops with automated drinking watering system to ensure fresh potable water for housing research mice under biohazard levels 1 and 2 conditions.
b. Equipment shall operate with minimal vibration and noise at the cage level to prevent negative animal behavior.
c. Vendor shall provide noise level documentation for HEPA supply motors and exhaust motors.
d. IVC racks and cages shall be capable of preventing the escape of mouse allergens into the room environment and provide a quiet housing environment.
e. Cages shall have adequate pre-filter space and filter cage tops capable of maintaining cage micro-environment in a passive/static mode in the event of a macro-environmental power failure.
f. Ventilated rack caging units shall provide a high-level bio-secure environment for both the animal care workers and research staff.
g. Inter cage air exchanges shall be sufficient to remove water vapor, carbon dioxide and ammonia with air flow low enough to prevent discomfort to the animal(s).
h. Racks shall have the capability to connect to 4-inch diameter existing building facility exhaust duct system.
i. Cages shall be equipped with air supply bullet inside the cage bottom level.
j. Cages and filter tops shall consist of high temperature clear polysulfone and capable of withstanding 300 degrees Fahrenheit temperature.
k. Cages shall have a minimum of 77.5 sq. in of floor space.
l. Cages shall have Edstrom A-160 automated water with removable valve (SHR design) Valve or
With Valve Integral to Cage/CD3 Design as indicated.
m. Animal holding Cage air shall exhaust via cage filter top self-sealing exhaust port.
n. Supply air HEPA blower motors shall have touch screen Bluetooth and USB cord with hose assembly.
o. Exhaust blower with electronically communicated motor interconnection cord with hose assembly.
p. IVC racks shall not exceed 64’ wide x 35’’ deep and 82’ high.
q. All IVC racks shall have high temp 270 degree autoclavable wheels.
r. Caging and IVC racks shall have as few as possible removable parts for cleaning and sanitation purposes.
s. Cages on the IVCs shall be in conformance with the Guide for the Care and Use of Animals for animal holding of rodents.
t. Shall include J design feeders SS with bottom clip.
u. Shall include field service for installation of all equipment offered for the IVC racks.
v. Rodent IVC and rabbit cages as described above shall fit and be compatible with existing racks being used currently.
w. Racks shall have not less than a 1-year warranty after installation and subsequent acceptance.
x. The contractor shall provide in-side delivery and installation for the system.
Offered systems shall be a turn-key solution i.e. the contractor shall be responsible for providing all hardware, components, instruments, computers, software, and that otherwise required to meet these specifications and the FDA’s stated need. The systems shall be delivered with all necessary supplies and accessories required for installation and start-up.
All personnel that enter FDA/CBR will be required to submit sufficient information for security screening on this US Government facility. Within 30 calendar days prior to on-site installation or on-site performance the contractor shall provide Full Names, Date of Birth, and Social Security Numbers for security screening of all personnel who will need US Government facility access. All personnel participating in the installation may be required to be fit tested to wear a N95 respirator in the animal facility.

Contractor Performance Assessment Rating System (CPARS):
(a) Pursuant to FAR 42.1502, this contract is subject to Contractor Performance Assessment System (CPARS). CPARS is an automated centralized information system accessible via the Internet that maintains reports of contractor performance for each contract. CPARS is located at https://www.cpars.gov/.
(b) Under CPARS, the Government will conduct annual evaluations of the contractor’s performance. The contractor has thirty (30) days after the Government’s evaluation is completed to comment on the evaluation. The contractor may request a meeting to discuss the CPAR at any time during the reporting period.
(c) The CPARS system requires the government to assign the contractor a User ID and password in order to view and comment on evaluation. Provide the name of one individual who will be assigned as the Contractor Representation for CPARS below:

Inspection/Acceptance:
The supplies and/or services delivered hereunder shall be inspected and accepted at destination by the Governments Technical Point of Contact (TPOC) specified at award. If the supplies or services are acceptable, the TPOC shall promptly forward a report of inspection and acceptance to the paying office. If the supplies or services are not acceptable, the TPOC shall document the nonconforming items/services and immediately notify the Contracting Officer.
The TPOC is responsible for: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements;
(3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance.
The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the contract; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or (5) otherwise change any terms and conditions of this contract.

B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer – System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:
(i) Name and address of the contractor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite-Delivery/Indefinite- Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;
(b) itemized travel costs, including origin and destination;
(c) any other supporting information necessary to clarify questionable expenditures;
(d) the contractor shall include the Contract Line Item/Funding line item for each description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed;
(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;
(vi) Terms of any discount for prompt payment offered (Prompt Payment terms other than NET 30);

C. An electronic invoice is acceptable if submitted in adobe acrobat (PDF) format. All items listed in (i) through (xiii) of this clause must be included in the electronic invoice. Electronic invoices must be on company letterhead and must contain no ink changes and be legible for printing.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

Offerors are afforded the opportunity to inspect the equipment installation building to the date set for receipt of quotes by contacting the Contract Specialist identified herein to schedule an appointment.
Failure to inspect the systems will not relieve the successful offeror from fully meeting the requirements of the resulting contract at the price offered.
It is the offeror's responsibility to monitor FedBizOpps for information relevant to this solicitation, e.g., questions and answers, amendments, etc.
Addendum Paragraph (b)(4): Technical capability will be determined by review of information submitted by the offeror which must provide sufficient technical information for the Government to conclusively determine that the offered items, components and services meet or exceed the technical requirements identified above. Offerors shall address each technical requirement stated above to demonstrate that the proposal meets the technical requirements. In addition to identifying manufacturer, make, and model of offered products it is incumbent of offerors that they unequivocally demonstrate that offered products meet the requirements herein through the submission of technical specifications, descriptive material, scientific literature, brochures, scientific publications where proposed solution has been used for same or similar purposes, and other information which demonstrates the acceptability of the offered supplies/services. The Quoter shall submit a written Accessibility Conformance Report (ACR) for each item not in compliance with 508 standards identified in clause 352.239-73, describing how the item(s) will fully address the accessibility requirements outlined in the solicitation; and a description of the evaluation methods the offeror will use to validate for conformance to the Revised 508 Standards. The ACR should be based on the Voluntary Product Accessibility Template Version 2.0 (MS Word) provided by the Industry Technology Industry Council (ITIC).
NOTE: Submission of the ACR is required for documentation purposes. In accordance with agency purchasing procedures, solutions which do not conform fully to the applicable 508 standards may still be purchased by FDA if the FDA Requiring Office obtains the appropriate approval. In order to obtain approval, the FDA must have an ACR from the vendor documenting the level of conformance of the items being purchased.
Offerors shall identify ENERGY STAR qualified and/or EPEAT-registered product(s) to be supplied under this contract by manufacturer, model name, and model number. Offerors should be prepared to provide evidence of product certification by an EPA-recognized certification body upon request. In addition, offerors shall specify the EPEAT level rating (bronze, silver, or gold) for each product.
Addendum Paragraph (b)(10): Offeror’s past performance will be evaluated based on the recency (within the last 3 years) and relevancy (brand, type, model of equipment serviced) of the information provided to determine the likelihood of success in performing the solicitation’s requirements as indicated by that offeror’s record of past performance. For each reference include period of performance, description (how is this relevant to current requirement), dollar value, company name, point of contact name, and telephone number for each contact. The Government reserves the right to obtain information for use in the evaluation from any and all sources including sources outside of the Government.
Price: Provide a detailed quote for each item/component proposed to the schedule of items. Include the firm’s DUNS number with quote.
Prices shall be valid through September 30, 2019.

An official authorized to bind the Offeror must sign the terms and conditions of the offer. Offerors that fail to complete the required representations and certifications, or reject the terms and conditions of the solicitation, may be excluded from consideration.
The government is not responsible for locating or securing any information, which is not identified in the proposal; however, the Government reserves the right to obtain information for use in the evaluation from any and all sources including sources outside of the Government.
The offeror or applicant shall submit all electronic documents for Microsoft Office suite products without the use of “macros”. If the offeror or applicant submits documents that contain macros the Government will not be able to view or open such documents and the submission will be considered non-responsive to the solicitation. No additional time will be given to an offeror or applicant to correct the document submission and the Government will not inform the offeror or applicant that their submission is non-responsive prior to award. It is the offeror’s or applicant’s responsibility to ensure all electronic documents are submitted without the use of macros.

The Government will award an order to the responsible offeror whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical Capability Past Performance Price
Technical Capability and past performance, when combined, are more important than price. However, if the Government determines non-price factors to be essentially equal among competing offerors price becomes more important as a discriminating factor.
As part of the technical evaluation, in addition to verifying that proposals meet those minimum specifications set forth herein, the Government will (1) confirm that EPEAT offered products are registered product(s), evaluating more favorably offers that propose delivery of products that meet higher levels of qualification under the EPEAT product registration system (i.e., silver or gold) and (2) evaluate more favorably those proposals in which proposed housing will maximize the number of cages per square foot of floor space, be easy for the users to correctly operate, that are energy, water, and labor efficient, do not require opening the cage when power or HVAC is lost for extended time to prevent loss of life, and that best contain allergens within the cages to protect the staff.
(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
The Provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (Oct 2018) The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
(a) Definitions. As used in this provision-- “Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
