Part 1 – Description The U.S. Food and Drug Administration’s (FDA) Center for Drug Evaluation and Research (CDER) Division of Pharmaceutical Analysis (DPA) is requesting a UV-Vis dissolution imaging system. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Part 12.603. This announcement constitutes the only solicitation; quotes are being requested, and a separate written solicitation will not be issued.
This solicitation is a Request for Quote (RFQ) using FAR Part 12 and 13 procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-04 January 15, 2020. The North American Industry Classification System (NAICS) code for the proposed acquisition is 334516 Analytical Laboratory Instrument Manufacturing, Small Size Standard 1,000 Employees. This acquisition is being competed as a total small business set-aside.
This requirement is for a UV-Vis dissolution imaging system with brand name or equal characteristics to the Pion, Inc. Pion SDi-2.

Payment of any firm-fixed-price deliverables will be authorized only upon successful completion of the respective CLINs, including delivery and acceptance of all deliverables, as determined by the FDA Contracting Officer’s Representative (COR) according to the Statement of Work, and upon submission of a properly rendered invoice. Instructions for proper invoice submission are specified in Part 5.
Part 3 – Description/Specifications
3.1 Background
Dissolution testing has been an important tool for decades for assessment of drug release from solid oral dosage forms such as tablets and capsules in pharmaceutical development. Efforts have been made over the years to examine physical changes to the dosage form during the dissolution process and to elucidate drug release mechanisms from a solid dosage form. The classical approach is direct visual observation of the dissolution process, to see disintegration of the dosage form, dispersion of particulates, mounding at the bottom of vessel, etc. Pictures can be taken at time points of interest to see the dissolution behaviors of solid dosage forms, as well as cross-linking effect on the dissolution of gelatin capsules. Specially designed video cameras can also be installed next to the dissolution vessel to record the whole dissolution process.
Recent advancements in spectroscopic imaging and its implementation in dissolution testing have made it possible to observe the dynamic dissolution process in-situ with high spatial and temporal resolution. Spectroscopic imaging measures the changes on or close to the surface of the solid sample or tablet. It provides information on the changes of chemical and physical properties of drug and excipients that are relevant to dissolution mechanisms of pharmaceutical products and can potentially be used in support of process analytical technologies (PAT) as related to domestic manufacturing. Spectroscopic imaging techniques that have been investigated include NMR imaging, Raman imaging and UV-Vis imaging. NMR and Raman as applied to dissolution imaging do not exist in a commercial state as of yet and thus aren’t viable approaches for implementation of dissolution imaging in support of PAT applications for advanced domestic manufacturing. Additionally, the base instrumentation cost alone without the interfacing to dissolution apparatus for NMR and Raman imaging is expected to far exceed the cost of a commercially available UV-Vis dissolution imaging.
As part of its mission, the Division of Pharmaceutical Analysis (DPA) is frequently called upon to assess the dissolution properties of pharmaceutical products. In addition, the DPA has an active research program targeting dissolution phenomenon and factors influencing dissolution test results. These goals are further consistent with those outlined by the CDER Research Governance Council (RGC). The RGC is a core component involved in the development and review of CDER policies related to the proposal, conduct, tracking, reporting and oversight of research. The currently stated goals of the RGC are as follows:
1. Develop and improve scientific approaches that aid in developing new drugs or evaluating their safety and efficacy.
2. Develop and improve scientific approaches to enhance the safety of marketed drugs.
3. Improve product manufacturing, testing, and surveillance to help ensure the availability of high-quality drugs.
4. Develop and improve methods for comparing products to facilitate the development and review of generic drugs and biosimilars.
5. Maintain scientific readiness to address emerging public health threats, enable regulatory integration of emerging technologies, and facilitate stakeholder adoption of novel approaches to drug development.
In line with these goals, and consistent with recent pharmaceutical trends, DPA has expanded on the above to invest additional time and resources to both develop and implement approaches that support drug development while also developing methods to evaluate their safety and efficacy, especially when in vitro methods of bioequivalence assessment can be applied. This addition to instrumentation at DPA will assist in meeting these goals.
3.2 Statement of Work
3.2.1 Objective
The objective is to install instrumentation at CDER/DPA that will allow for UV-Vis dissolution imaging as a characterization tool for rapid and label-free physicochemical analysis of the dissolution of pharmaceutical products in support of process analytical technologies (PAT) as related to domestic manufacturing. Dissolution apparatuses and UV-Vis cameras must meet the salient characteristics and technical specifications identified in this solicitation.
3.2.2 Scope
The contractor for the instrumentation shall be responsible for delivery, installation, and training of a UV-Vis dissolution imaging system that meets the specifications as outlined in “Requirements”.
3.2.3 Requirements
The instrumentation shall meet the following salient characteristics:
• Shall be a newly manufactured unit, not used and refurbished or previously used for demonstration.
• Shall have software capabilities that allows for the spatial visualization of the dissolution process via UV-Vis imaging in real time.
• Shall have UV wavelengths covering a minimum of 255, 280, 300 and 320 nm ± 5 nm
• Shall have visible wavelengths of 520 nm ± 5 nm
• Shall allow for a minimum of two detection wavelengths to be used in each experiment.
• The UV-Vis imager shall allow for up to a maximal area of 28 x 28 mm to be imaged, with a minimum frame rate of 1 frame per second per wavelength and a minimum effective pixel size of 14 µm.
• The UV-Vis imager will allow for export of the captured videos for the dissolution imaging process to be exported in commonly used media types that can be read and played by windows media player and shall allow for physicochemical changes at the selected experimental wavelengths to be visualized in real time.
• The UV-Vis imager detector Shall have a detector that is thermoelectrically cooled and requires no external cooling source to operate (i.e. addition of liquid nitrogen to obtain operating temperatures)
• Shall have a compact flow cell that allows for 3-10 mg sample amounts to be analyzed with flow rates between 1 and 2 mL/min
• Shall have a whole dosage flow cell that allows for tablets up to 20 mm in length to be analyzed with flow rates between 7 and 24 mL/min
• Shall allow for commonly used pharmaceutical dosage forms (i.e. tablets and capsules) to be analyzed.
• Shall allow for a temperature range between ambient and 37 °C to be set and maintained during dissolution measurements.
• Shall have the ability to interface with a Kaiser PhAT probe via mounting of the probe to allow for Raman measurements to be taken during the dissolution experiments.
• Following successful completion of instrument qualification, the warranty period shall cover a minimum of one (1) year

Part 4 –Performance and Deliverables
4.1 Delivery, Installation, Training, and Support: 52.247-34 F.O.B. Destination
The vendor is responsible for delivery of the instrument and all components specified above. The vendor will demonstrate upon installation that the item will meet all performance specifications by the manufacturer. The instrument will not be accepted until those performance specifications have been met. The project officer will perform inspection and acceptance of the of UV-Vis Dissolution Imaging System and flow cells manufactured by Pion, Inc. or Equal. The entire system will be warranted for parts and labor for twelve (12) months from date of installation.
Service and installation must be provided by service engineers who are trained and certified by the original manufacturer of the instrument. Engineers should have access to the manufacturer’s latest technical developments, repair procedures, application updates, diagnostic software, and planned maintenance procedures.
The vendor shall cover all costs associated with the following:
• CLIN 0001 pricing shall be inclusive of all packaging, crating, delivery and shipping to the FDA delivery location.
• On-site installation, hardware, software, and applications training shall be provided at the FDA site.
• All appropriate training manuals and literature must be supplied either electronically or in hard copy.
• Technical support shall be provided through common avenues: phone, web, fax, during standard business hours.
4.2 Delivery Location/Place of Performance and Work Hours*
Delivery and installation shall be coordinated through the Contracting Officer Representative.
Work shall be conducted Monday through Friday, excluding federal holidays during the times of
9.00 AM to 4.00 PM EST. Contractor shall provide at least 72 hours notice for installation, set-up, and vendor is responsible for delivery and installation of the instrument to the laboratory facility.

4.3 Inspection and Acceptance Criteria
Government acceptance will be made within 30 days upon completion of all deliverables (including services), and demonstration of the instrument’s performance capability.
4.4 Period of Performance
The period of performance for this contract is 12 months from the completion of installation and validation of the equipment.
This is a standard procurement for a commercial product item. Period of performance will be the standard delivery after placement of the order, plus warranty and service contract coverage for one (1) year.
4.5 Warranty/Preventative Maintenance Service Agreement
Warranty: Vendor shall offer a minimum one (1) year warranty for parts and labor for repairs or defects.
Part 5 –Contract Administration
5.1 Administrative Points of Contact
Contracting Officer’s Representative
For this PART, (COR TBD) is the authorized representative of the Contracting Officer.
The Contracting Officer’s Representative (COR) will perform inspection and acceptance of equipment, installation and services to be provided.
The COR is responsible for the following as required by this order: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluations;
(4) performing technical inspections and acceptances; and (5) assisting in the resolution of technical problems encountered during performance.
The Contracting Officer is the only person with authority to act as an agent of the Government under this order. Only the Contracting Officer has authority to: direct or negotiate any changes in the order, including modifying or extending the period of performance, changing the delivery schedule, authorizing reimbursement to the Contractor for any costs incurred during the performance of this order, or otherwise change any terms and conditions of this order.

B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer – System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:
(i) Name and address of the contractor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite- Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;
(b) itemized travel costs, including origin and destination;
(c) any other supporting information necessary to clarify questionable expenditures;

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
