Part 1 – Description The U.S. Food and Drug Administration’s (FDA) Center for Drug Evaluation and Research (CDER) is requesting a Morphologically Directed Raman Spectroscopy System. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Part 12.603. This announcement constitutes the only solicitation; quotes are being requested, and a separate written solicitation will not be issued.

This solicitation is a Request for Quote (RFQ) using FAR Parts 12 and 13 procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-04 January 15, 2020. The North American Industry Classification System (NAICS) code for the proposed acquisition is 334516 Analytical Laboratory Instrument Manufacturing, Small Size Standard 1,000 Employees. This requirement is set-aside for small business only.

Part 3 – Description/Specifications

3.1 Background

The Division of Product Quality Research (DPQR) is requesting a morphologically-directed Raman spectroscopy (MDRS) system for pharmaceutical analysis. Currently the division does not have a system that can perform chemical compound mapping for API or excipients with particle size analysis simultaneously. The division requires this system for ingredient mapping as well as particle analysis such as particle sizing and categorization in various drug formulations, aiming to benefit regulatory research in the field of bioequivalence (BE), particulate matter and formulation study. In order to maintain scientific integrity, the continued use of validated methods must be maintained, and a brand name or equivalent to Morphologi 4-ID is needed.

3.2 Statement of Work

Requirements

The brand name or equal to Morphologi 4-ID Automated Raman Spectroscopy System manufactured by Malvern Panalytical shall meet the following salient characteristics:

i. Shall produce high quality images for morphological analysis (~1µm resolution).

ii. Shall have a wide selection of optical lens (at least 5X, 10X, 20X, 50X) for the application for particles with varied sizes (1 µm to 1 mm).

iii. Shall have high performance Raman spectroscopy incorporated to identify chemical composition, from 200cm-1 to 2000 cm-1.

iv. Shall have comparable resolution for both optical microscope and Raman spectroscopy, so the integrated resolution would not be compromised.

v. Shall have a laser probe as excitation source in Raman spectroscopy, the laser probe power should be adjustable for different materials purposes to prevent irradiation damage.

vi. Shall be used for different forms of pharmaceutical products, including particle, spray, liquid or solid tablets; as well as different materials including biological, polymeric and solid materials.

vii. Shall have integrated software that simultaneously monitors performance, collects data, analyzes results for both microscopy and Raman spectroscopy; and generates publishable results for regulatory and research purposes.

viii. Shall include adaptable sample mount for different purposes. For example, wet cells for liquid materials.

ix. Shall meet the current need of chemical compound mapping for API or excipients with particle size analysis simultaneously for the division in the area of generic formulations, bioequivalence study, tablet reformulation, particulate matter in injectables etc.

x. Shall include filtering system to prevent environmental contamination.

xi. Shall provide system crating, shipping, and delivery.

xii. Shall provide full system software and peripheral installation.

xiii. Shall provide on-site hardware and software training (at least 5 scientists).

xiv. Shall include one (1) year warranty to include parts and labor.

Part 4 –Performance and Deliverables

4.1 Delivery, Installation, Training, and Support: 52.247-34 F.O.B. Destination The vendor is responsible for delivery of the instrument and all components specified above. The vendor will demonstrate upon installation that the item will meet all performance specifications by the manufacturer. The instrument will not be accepted until those performance specifications have been met. The project officer will perform inspection and acceptance of the Morphologi 4- ID manufactured by Malvern Panalytical or Equal. The entire system will be warranted for parts and labor for twelve (12) months from date of installation. Service and installation must be provided by service engineers who are trained and certified by the original manufacturer of the instrument. Engineers should have access to the manufacturer’s latest technical developments, repair procedures, application updates, diagnostic software, and planned maintenance procedures.

The vendor shall cover all costs associated with the following:

• Crating and shipping shall be included in this proposal to the delivery address.

• On-site installation, hardware, software, and applications training shall be provided at the FDA site.

• All appropriate training manuals and literature must be supplied either electronically or in hard copy.

• Technical support shall be provided through common avenues: phone, web, fax, during standard business hour.

Place of Performance and Work Hours Delivery and installation should be coordinated through the Contracting Officer Representative.

Work shall be conducted Monday through Friday, excluding federal holidays during the times of

9.00 AM to 4.00 PM EST. Contractor shall provide at least 72 hours notice for installation, set-up, and vendor is responsible for delivery and installation of the instrument to the laboratory facility.

Morphologi 4-ID equipment shall be delivered to:

Inspection and Acceptance Criteria After the delivery of the instrument, the Government shall have 30 working days to inspect and verify that the equipment is operational and functional. Acceptance to be made after completion of IQ/OQ.

Period of Performance The period of performance for this contract is 12 months from the completion of installation and validation of the equipment.

This is a standard procurement for a commercial product item. Period of performance will be the standard delivery after placement of the order, plus warranty and service contract coverage for one (1) year.

Warranty/Preventative Maintenance Service Agreement Warranty: Vendor shall offer a minimum one (1) year warranty for parts and labor for repairs or defects.

Part 5 –Contract Administration

5.1 Administrative Points of Contact

Contracting Officer’s Representative For this PART, (COR TBD) is the authorized representative of the Contracting Officer.

The Contracting Officer’s Representative (COR) will perform inspection and acceptance of equipment, installation and services to be provided.

The COR is responsible for the following as required by this order: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluations;

(4) performing technical inspections and acceptances; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as an agent of the Government under this order. Only the Contracting Officer has authority to: direct or negotiate any changes in the order, including modifying or extending the period of performance, changing the delivery schedule, authorizing reimbursement to the Contractor for any costs incurred during the performance of this order, or otherwise change any terms and conditions of this order.

B. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
