Notice of Contract Action for The Boeing Company, Strategic Missile & Defense Systems, Directed Energy Systems

This announcement constitutes a Notice of Contract Action (NOCA) by the Air Force Research Laboratory (AFRL), Phillips Research Site (PRS), Directed Energy Directorate (RD), Kirtland AFB NM. AFRL intends to solicit and award a non-competitive, cost plus fixed fee – Level of Effort contract to The Boeing Company, Strategic Missile & Defense Systems, Directed Energy Systems, 4411 The 25 Way, Suite 350, Albuquerque, NM 87109-5858.

The statutory authority of this action is Contracting by Other Than Full and Open Competition, under the authority of 10 U.S.C. 2304(c)(1) as implemented with FAR subpart 6.302- 1(a)(2)(iii)(B). The sole source action will be implemented via a contract that will provide continued contracted effort to accomplish the RDS mission between the technical end of the Innovative Research and Optical Site Support (IROSS) (FA9451-05-C-0257) contract and the technical start of the successor R&D for Advanced Space Superiority Technology and Engineering Requirements (RASTER) contract. The possible contract term, if all options are exercised, is twenty five months.

This contract will provide the personnel, hardware, software, equipment, and supplies required for technical performance, AEORSS Phase-out/RASTER Phase-in, and AEORSS administrative close-out activities. AEORSS will transition the highly specialized technical effort between the IROSS contract and the RASTER contract. AEORSS will enable the continued advancement of research and development objectives, execution of experiments, maintenance of experimental equipment, technology transition to customers, and the multi-level security necessary for site research and operations. Place of performance is the Starfire Optical Range (SOR), Kirtland Air Force Base and Air Force Maui Optical and Supercomputing Site (AMOS), Maui, Hawaii.

The North American Industry Classification System (NAICS) code is 541712 with a size standard of 500 employees.

This notice neither constitutes a Request for Proposal (RFP) or an Invitation for Bid (IFB), nor does the issuance restrict the Government in any way to an ultimate acquisition approach. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the Government. THIS IS NOT A REQUEST FOR PROPOSAL AND IS NOT TO BE CONSIDERED AS A COMMITMENT BY THE GOVERNMENT. Any costs incurred as a result of this announcement shall be borne by the offeror and shall not be charged to the Government for reimbursement. The determination of the Government not to compete this proposed contract action based upon the responses to this notice is solely within the discretion of the Government.

The clause at 5352.201-9101, Ombudsman, is applicable to this procurement. An Ombudsman has been appointed to address concerns of offeror(s) or potential offerors. The Ombudsman does not diminish the authority of the program manager or contracting office, but communicates the contractor concerns, issues, disagreements, and recommendations to the appropriate Government personnel. When requested, the Ombudsman shall maintain strict confidentiality as to the source of the concern. The Ombudsman does not participate in the evaluation of the proposals or in the source selection process. Matters of routine or administrative nature concerning this acquisition should not be addressed to the Ombudsman, but rather to the contracting point of contact identified below.
