BRAND NAME JUSTIFICATION AND APPROVAL

1. Contracting Activity: AFRL/RIKO, 26 Electronic Pkwy, Rome NY 13441 Contracting Officer: Bryant Soule, 315-330-4723 Purchase Request: F4HBL16091A001

2. Nature and/or Description of the Action Being Processed

This action is a new firm fixed price order for a set of optical components for assisting an ion trapping optical setup that will be laid out and built in support of the Quantum Information Science (QIS) (Quantum Networking Project).

3. Description of Supplies/Services Required to Meet the Agency’s Needs

The requirement is for free space electro-optical modulators that provide the required 7.374 GHz at 369

nm. The order also includes other optical components that are reliable and compatible with other components previously purchased and currently in use.

4. Authority Permitting a Brand Name

The specific exception that authorizes restricting consideration based on limited sources for this acquisition is 10 USC 2304(c)(1)-- Only one brand is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

5. Applicability of Authority

The brand name products to be acquired are essential to the Government’s requirements and other companies’ products do not meet, or cannot be modified to meet, the Government’s needs.

These are the highest quality optical components compatible with each other, and with the other components that are already in use. The quality and compatibility of the Newport components are necessary in order to create a cohesive optical setup. To the best of the Government’s knowledge Newport (New Focus) is the only provider of these free space electro-optical modulators that provide the required

7.374 GHz at 369 nm. Other optical components in the order are reliable and compatible with other components previously purchased and currently in use. To purchase the required components from another manufacturer would result in higher costs (estimated to add to the order) since adaptors would be needed to make all the components compatible. In addition, these adaptors would result in a less stable optical setup which would not meet our experimental requirements as stability is a critical factor for these experiments.

Newport is the only brand able to meet these requirements without the U.S. Air Force experiencing substantial duplication of cost and effort that could not be expected to be recovered through competition and would result in unacceptable delays in fulfilling this and other requirements.

6. Fair and Reasonable Cost Determination by the Contracting Officer

It is anticipated that the receipt of competitive re-sale proposals will produce a fair and reasonable price less than or equal to the Government estimate.

7. Description of Market Research Conducted Among All Awardees

The Government estimate is based on an open market quotation provided by . To meet the customer’s fiscal requirements, AFRL Market research concluded that the required brand name hardware is available from resellers of Newport. Therefore, to promote competition, this procurement will be solicited full and open on FedBizOpps (FBO.gov).

The end-user will continue to perform market research in order to identify opportunities to maximize competition in potential future requirements and will analyze any changes to the market that may result in a decision to replace the existing products.
