Justification and Approval (J&A) for Other Than Full and Open Competition

Page 2 of 9Updated: 15 Mar 16

I. Contracting Activity.

The Department of the Air Force, Air Combat Command, 99th Contracting Squadron, Nellis Air Force Base, Nevada.

II. Nature and/or description of the action being processed.

The 799 ABS/SCOI has a requirement to upgrade their existing SIPRNET Core Infrastructure system at Creech AFB.

. The services were somewhat restored with the use of multiple less powerful devices. This temporary solution stabilized the services, but will not be able to maintain the demand for very long. If this solution fails, there is currently no other backup system.

III. Description of supplies/services required to meet agency needs.

This requirement is to have the contractor replace and install network switches at each SIPRNET core specified to ensure they can handle all routing services for the base. They also need to be capable of supporting equipment on the DISA approved product list (APL) and work in conjunction with all current networking equipment.

IV. Statutory authority permitting Other than Full and Open Competition.

FAR 13.501(a)(1)(ii) Prepare sole source (including brand name) justifications using the format at 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901. More specifically FAR 6.302-2, Unusual and Compelling Urgency.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Cisco products are proprietary and can only be sold and worked on by Cisco or third party partners that are authorized by Cisco. In order to upgrade our current SIPRNET Cisco system, we would need Cisco or an authorized partner to fulfill the requirement. Based on previous acquisitions, one of these authorized Cisco vendors, Iron Bow Technologies, was contacted and informed us that they can fulfill the requirement.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

This requirement was going to be solicited on AFWAY in accordance with AFMAN 33-153, which mandates the use of NETCENTS2 for all Air Force information technology (IT) capabilities. Accordingly, this requirement would have been solicited on NETCENTS2 available for full and open competition. A synopsis is not required in accordance with 5.202(a)(2).

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

It is the contracting officer's determination that a fair and reasonable offer will be obtained through comparison of proposed prices in accordance with FAR 13.106-3(a)(2)(i) and FAR 13.106-3(a)(2)(ii).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

AFMAN 33-153, mandates the use of NETCENTS2 for all Netcentric Products, NetOps and Infrastructure Solutions, Application Services, IT Professional Support and Engineering Services (Advisory & Assistance Services (A&AS), and Enterprise Integration and Service Management (A&AS). Contract, FA8732-14-D-0008-S403 for CISCO equipment was awarded in FY 16. For this award there were two companies that provided quotes, Presidio Solutions and Iron Bow Technologies.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The 799th ABS/SCX has selected this system based on their current mission requirements and require this system in order to carry out their specific mission needs.

X. List of sources, if any, that expressed interest in the acquisition.

Iron Bow Technologies, which is a vendor on AFWAY/NETCENTS, was contacted and informed us they can provide a quote immediately.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

It was the intent of the government to publicize this requirement to the AFWAY vendors to allow for maximum competition.

Due to the unforeseen failure of the current system and the lack of an alternative method to sustain the critical services if the back up system fails, this was not possible.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

XIII. Certification by the technical/requirements personnel.

As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
