Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.
The Air Force Materiel Command's Air Force Life Cycle Management Center (AFLCMC), Digital Directorate, Aerospace Management Systems Division (HBA), Contracting Office (HBAK), 75 Vandenberg Drive, Hanscom Air Force Base (AFB), MA 01731-2103 is the contracting organization responsible for this proposed contracting action and is seeking approval for this Justification for Other Than Full and Open Competition. II. Nature and/or description of the action being processed.
AFLCMC/HBAK intends to award a production contract to AAR Mobility Systems, 201 Haynes Street, Cadillac, MI 49601.
The production contract, awarded under the authority of this Justification and Approval (J&A), allows the United States Air Force (USAF) to purchase sixteen (16) sets of electric ISO mobilizers. Ancillary items include shipping to the final destination and a standard one (1) year warranty. These mobilizers are necessary for the transportation of shelters and containers for the Deployable Instrument Landing System (D-ILS). This contract is expected to be awarded on a Firm Fixed Price basis. Delivery is expected to start within 120 days of contract award with final delivery within nine (9) months of contact award, in accordance with Government-requested schedule. This AAR mobilizer contract will be awarded in accordance with Federal Acquisition Regulation (FAR), Part 12, "Acquisition of Commercial Items."
III. Description of supplies/services required to meet agency needs.
The USAF will purchase sixteen (16) sets of ISO electric mobilizers to support D-ILS Production Units (PU) 6, 7, 8, and 9.
Each D-ILS system requires four (4) sets of mobilizers to transport the two (2) shelters and two (2) containers. These mobilizers are an integral part of the D-ILS system and are the primary means of transportation over rough terrain and in remote areas. PUs 6 and 7 will be delivered to Robins AFB, GA in November 2019 and February 2020 and PUs 8 and 9 will be delivered to Ramstein Air Base (AB), Germany in March 2020 and May 2020. The Government requires that support equipment deliveries line up with D-ILS system deliveries.
Following performance testing with both diesel mobilizers and electric mobilizers in 2015, electric mobilizers were specified by Air Force Flight Standards Agency (AFFSA), the Lead Command for D-ILS, due to their reliability and overall level of performance. Additional requirements for the mobilizers set forth by AFFSA are Type IV transportation, hydraulic lift, and capability to support/transport the weight of both D-ILS and Deployable Radar Approach Control (D- RAPCON) shelters, containers, and antennas. D-RAPCON containers weigh up to 17,600 lbs., which is more than D-ILS containers, so their weight led to the requirement for 12-ton mobilizers.
IV. Statutory authority permitting other than full and open competition.
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(B), where only one responsible source and no other supplies or services will satisfy the agency requirements without "unacceptable delays in fulfilling the agency's requirements."
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
After conducting market research efforts, the Approach and landing Systems Branch (AFLCMC/HBAB) has determined that AAR Mobility Systems remains the only company that currently has the capability to produce the highly specialized system of electric mobilizers complying with DoD transportation requirements. This contractor is the only one capable with complying with the requirements office (AFFSA) and capable of meeting the Government's schedule for the electric mobilizers to be delivered and accepted by the Government in order to meet the D-ILS systems production schedule. Twelve (12) sets were originally purchased under GSA Schedule GS07F0065L but are no longer available under the GSA award. To attempt competition, market research, in addition to research done by program engineers, was accomplished through a Sources Sought Synopsis (SSS), solicitation number FA8730-19-C-ISO1, posted to FedBizOpps.gov (FBO) on 18 June 2019. The posting was available for fifteen (15) days and AAR Mobility Systems was the only respondent.

Market research did not reveal any additional 12-ton electric mobilizer manufacturers. A Notice of Contract Action (NOCA), solicitation number FA8730-19-C-ISO2 was posted to FBO on 22 July 2019 stating that AFLCMC/HBAK intends to award a contract to AAR Mobility Systems. There were no responses received to the NOCA.
AFLCMC/HBAB based on the information provided by the market research has demonstrated that an award to any other source would result in unacceptable delays in fulfilling the Air Force's requirement. The estimated time of delay is based upon both standard manufacturing practices and AFLCMC/HBAB experiences in past awards of setting up production lines, arranging supplier agreements and AFLCMC/HBAB original mobilizer testing times. Together it is not unreasonable to expect, at a minimum, a delay of eighteen months (18 months) before another company would be able to deliver any electric mobilizers leaving D-ILS systems unable to be transported and thus precluding the ability of the war fighter to accomplish specific missions.
Accordingly, AAR Mobility Systems is the only firm capable of providing the supplies and services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
As described in Section V, a SSS was posted to FBO on 18 June 2019 to assess availability of an ISO electric mobilizer which meets the requirements described in Section III. The SSS allowed fifteen (15) days for responses. AAR Mobility Systems was the only respondent to the SSS and their offering meets all requirements set forth by the Government.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The price associated with this effort will be determined to be fair and reasonable to the Government through price analysis which will be conducted in accordance with FAR Part 12, "Acquisition of Commercial Items". In addition to the analysis of pricing data received, the PCO will use the Program Office estimates, as well as the prices obtained in the November 2018 ISO electric mobilizer purchase from AAR Mobility Systems, to determine whether or not the Government is receiving a fair and reasonable price.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted by the PMO in order to advise industry of the pending acquisition and solicit inquiries from interested parties. Market research, as described in Section V of this J&A, was conducted in accordance with FAR Part 10. To date, no contractor other than AAR Mobility Systems has provided evidence of a capability to produce an ISO electric mobilizer meeting Government requirements.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Government plans to purchase ISO electric mobilizers, part number 60373-002, for all D-ILS systems as set forth in the requirement from AFFSA stated Section III. There are currently no other options that meet the Government requirement. As additional systems are needed, the D-ILS Program Office will continue to analyze other ISO electric mobilizer options if available.
XII. Certification by the Contracting Officer.
The contracting officer's signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief [FAR 6.303-2(b)(12)].
XIII. Certification by the technical/requirements personnel.
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete [FAR 6.303-2(c)].
