Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction
FOR OFFICIAL USE ONLY March 2018 Page 2 of 4
(4) Identification of the exception to fair opportunity and the supporting rationale:
The specific exception that precludes the fair opportunity process for this acquisition is FAR 16.505(b)(2)(i)(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
The ordering period for the preceding Task Order expired on 8 April 2018, and no further modifications to increase scope of the Task Order are allowable. The normal time for performing a Fair Opportunity Competition ranges from six months to one year, and if a new competition for the requirements of this acquisition were required it would incur an unacceptable delay in the critical services for AFPEO BES.
A delay in these services would severely impact the following programs for AFPEO BES as they currently have known requirements:
The HIBD Admin Support [Project ID: 3874]. This support includes staff support for the senior managers and members of the organizational staff. This includes but is not limited to researching and compiling information pertaining to certain projects/topics, reviews CDRL packages, prepares factual, clear, concise, complete and appropriately coordinated written communications.
The Shared Support program [Project ID: 394]. Shared Support currently supports 16 projects/ initiatives that include legacy contracting systems, enterprise information systems, and acquisition support systems. Within this mission area, HIBB also serves as a “basket SPO” for those projects that are at a point in their life-cycle where they either don't require dedicated resources or have not yet garnered sufficient funding for dedicated support and therefore operate in a shared support environment.
The Air Force Enterprise Information Services (AF-EIS) program [Project ID: 958]. AF-EIS is an acquisition program that will provide enterprise capabilities to support Knowledge Operations across the Air Force. The goal is to centralize the Information Services across the Air Force stovepipes currently in place at the MAJCOM, SOAs, DRUs, and FOAs.
The Air Force Command Mass Notification System (AFMC-MNS) program [Project ID: 958]. AFMC-MNS is an acquisition program that will command-wide integrated Emergency Mass Notification system (EMNS) across Air Force Materiel Command (AFMC) for both personnel emergency notification and accountability.
The Acquisition Domain Capability Integration (ADCI) Program [Project ID: 933]. Acquisition Domain Capabilities Integration (ADCI) is the capabilities planning activity for the Air Force's Acquisition Domain. ADCI activities are guided by the vision for a SOA-based integrated "Acquisition Workbench" for acquisition personnel to access tools and data necessary to perform their work.
expertise are required.
The Period of Performance (PoP) will be Modification Award Date through 17 November 2018 for HIB and Modification Award Date through 17 August 2018 for HIQ and will have the following CLINs:
1001 - CPFF - for HIB Labor Costs 1002 - CPFF - for HIQ Labor Costs 2001 - FFP - for HIB Labor Costs 2002 - FFP - for HIQ Labor Costs 3001 - CR - for HIB travel 3002 - CR - for HIQ travel 4001 - NSP - for HIB Data associated with the above CLINs 4002 - NSP- for HIQ Data associated with the above CLINs Prices and Costs will be finalized after negotiations with the current contractor are complete. CLINs will be incrementally funded via Sub-CLINs according to the individual projects being supported. These costs are for severable services crossing Fiscal Years 2018 and 2019.

The Enterprise Information Technology Data Repository (EITDR) Program [Project ID: 1962]. The EITDR Program Management Office supports the Secretary of the Air Force (SAF), Policy and Resources Directorate (SAF/A6P) who directly supports the Office of Information Dominance and Chief Information Officer (SAF/CIO/A6). SAF/A6P oversees the Air Force Information Technology portfolio management processes and Chief Information Officer (CIO) compliance reporting within the AF; and provides oversight of, and ensures CIO compliance with, all AF Department of Defense policy, congressional mandates, and AF reporting requirements for IT information systems management.
The Contracting Information Technology (CON-IT) [Project ID: 1964]. CON-IT will provide the AF with standardized, seamless, end-to-end contract management (i.e. sourcing) of services, supplies, and construction. The end-to-end contract management process includes processing of the initial user requirement through funding, source selection, contract award, contract administration, acceptance of services, supplies, or construction, invoicing, contract payment and contract close-out processes.
The Depot Source of Repair II (DSOR II) [Project ID: 2366]. The Depot Source of Repair II is the current business process tool used to determine the best and most appropriate facility to perform depot-level repairs. This program is the standardized value solution across Headquarters Air Force Materiel Command, AFMC Centers, as well as Air Force Space Command.
A delay in these services would gravely decrease the capabilities of the United States Air Force to fly and fight in Air, Space, and Cyberspace.
(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:
To ensure the final contract price will be fair and reasonable, the Government will require technical evaluations, cost analysis, price analysis, historical data, market research, and negotiations will be conducted in accordance with FAR Part 15 to ensure that the anticipated cost to the Government will be fair and reasonable. AZS has also purchased a membership to Economic Research Institute (ERI) in order to determine the market pay range for a specific position, location, and industry. This along with other on-line salary data will be used to ensure a fair and reasonable price for the 5 month Period of Performance.
(6) Other facts supporting the justification:
The reason for restricting competition now is to maintain continuity of services for the AFPEO Business Enterprise Systems (BES) Directorate, specifically the Business Sustainment Division (AFLCMC/HIB) and Enterprise Applications and Integration Division (AFLCMC/HIQ) due to the preceding PASS II IDIQ ordering period having elapsed on 8 April 2018. A Fair Opportunity Competition process for these requirements is currently on-going and expected to be fully transitioned by 17 November 2018.
(7) Actions the agency may take to remove or overcome any barriers to increasing fair opportunity before any subsequent acquisition for the supplies or services:
AFLCMC/AZS has taken all requisite approaches and maximized industry participation in the EPASS competitive effort. EPASS uses GSA OASIS SB which is a total small business set-aside, multiple award IDIQ contract. Per Policy Memo, Guidance on Mandatory Use of Engineering, Professional and Administrative Support Services (EPASS) for A&AS Contract Vehicles, dated 20 March 2014, issued by AFLCMC/CC, EPASS is a mandatory source for procurement and management of AFLCMC A&AS requirements.
This A&AS effort is slated to move to the follow on EPASS contract, currently in Fair Opportunity Competition, once the Period of Performance has ended on 17 August 2018 (HIQ) and 17 November 2018 (HIB).
