I. Contracting Activity.

II. Nature and/or description of the action being processed.
This action will result in a modification to the Firm Fixed Price Contract FA8601-15-C-0040 not to exceed from to . This effort will be for a four month period of performance.
III. Description of supplies/services required to meet agency needs.
Under the existing contract, , provides janitorial services for the Child Development Centers (CDC) and National Air and Space Intelligence Center (NASIC) on Area A. These services include all management, tools, equipment, and labor necessary to ensure the custodial services are performed to present a clean, neat, and professional appearance. This includes cleaning and maintaining the floors, trash collection and removal, restroom and locker room cleaning services, and snow and ice removal.
Contract FA8601-15-C-0040 expires on 31 March 2019. The last option expired on 30 September 2018, and the Option to Extend the Services in accordance with 52.217-8 was executed to allow time for the source selection to take place.
The requirement was solicited on 1 December 2018, and offers were received on 17 December 2018. Based on the Market Research Report, which relied on several difference market research techniques, including issuing a Sources Sought, it was expected that offerors would respond to the solicitation. However, offerors responded to the solicitation. In addition to receiving the requirements documents late and issuing the solicitation while already in the 52.217-8 extension period, the Government was not prepared for the number of sources, and as a result, has been slower than anticipated in evaluating the offers. Up to this point, the Government has established a competitive range and is currently in the beginning phase of discussions. As a result, the effort cannot be awarded in time to prevent a break in service. A break in service for the custodial services to the CDC and NASIC would constitute a critical disruption of essential services to the base. Without custodial services, both the CDC ad NASIC would have to be closed, which would impact the ability of Wright-Patterson Air Force Base to function and pose a risk to national security.
The requested dollar amount for this Justification and Approval is for four months. These four months are based on an aggressive schedule in order to limit the use of other than full and open competition. It is the Government's intent to conclude the ongoing source selection as quickly as possible in order to fulfill the agency's need using full and open competition.
IV. Statutory authority permitting other than full and open competition.
10 U.S.C. 2304(c)(2), Unusual and Compelling Urgency, as implemented by FAR 6.302-2; and 10 U.S.C. 2302b, Implementation of Simplified Procedures, as implemented by AFFARS 5313.501.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The custodial contract services the CDC and NASIC on Area A. DoDI 1402.5 requires that individuals who have regular contact with children under 18 years of age in DoD-sanctioned child care services must have complete background checks, including sex offender registry and an Installation Records Check before they can perform services at the CDC.
These requirements are coordinated through the Services Squadron Security Monitor, and maintained by the CDC Director. The contractor employees cannot begin work until the criminal history background check has been initiated and completed. The current contractor already meets all of these requirements. Furthermore, the discontinuation of these custodial services is not an option due to sanitation, health, and safety issues risking the well-being of children and Government personnel within those buildings. Neither the CDC or NASIC can be shut down due to the critical function the CDC serves at Wright-Patterson Air Force Base and the critical function NASIC serves this nation, thus, creating an unusual and compelling urgency to temporarily use other than full and open competition.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
The CDC/NASIC custodial contract has been solicited as an 8(a) requirement, and offerors submitted proposals in December 2018. However, the proposals have taken longer to evaluate than expected. As a result, the effort cannot be put on contract quickly enough to meet the break in service date of 31 March 2019. The subject contract will be a stopgap to allow the competition for the custodial effort to conclude, so the custodial contract can be restored to a competitive 8(a) requirement. Going forward, it is the priority of the Government to maintain this requirement as a competitive 8(a). In order to prevent a break in service requiring a bridge contract from occurring in the future, the Government intends to perfect the requirement and issue the solicitation prior to exercising the -8 Option to Extend Services, so that it has more time to evaluate and award the requirement without risking a break in service.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The contractor for the current CDC/NASIC custodial contract has agreed to use the rates from the current contract for this extension. The rates on the current contract were found to be fair and reasonable based on adequate price competition, as defined in FAR 13.106-3(a)(2). Additionally, these rates were also compared to an Independent Government Estimate (IGE) used for the follow-on acquisition, as well as to the rates proposed by offerors for the follow-on.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
There is currently an ongoing source selection for the CDC/NASIC custodial contract. The solicitation was issued, and companies responded with proposals. However, due to the requirement that criminal background checks be initiated and completed prior to beginning work at the CDC, it is unlikely that any of these companies could meet the security requirements of the contract before the current contract ends.
IX. Any other facts supporting the use of Other Than Full and Open Competition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Moving forward, it is the aim of the Government for the CDC/NASIC custodial contract to remain a competitive 8(a) requirement. In order to achieve this goal, the Government is committed to performing more thorough Market Research, which will inform the timeline for solicitation and evaluation. Additionally, the Government will prepare and release the requirement prior to the expiration of the contract, giving more time for evaluation and negotiation prior to the end of the contract. Finally, the Government will take this effort's timeline as a frame of reference to ensure requirements are solicited in time to get them properly awarded as competitive actions.
