This aircraft is a high-demand, low-density aircraft relied upon by joint missions world wide.
1.3 Background: The AN/UPX-40 Interrogator System replaces the current AN/APX-103C system in the E-3 Airborne Warning & Control System (AWACS) Fleet. The AN/UPX-40 consists of Line Replaceable Units (LRUs) and Shop Replaceable Units (SRUs) which perform secondary surveillance of all civil and military platforms, distinguish neutral targets, identify targets as being friend or foe, and determine range, azimuth, and Selective Identification Feature codes of targets.

TAT is not suspended for repairable items delayed by the Contractor including, but not limited to, awaiting replacement parts, awaiting actions by a sub-vendor, awaiting test equipment or technician availability. TAT for repairs requiring the use of the items listed in Paragraph 4.0 above will not be calculated until the initial items are available to the contractor. Extenuating circumstances the Contractor believes to be outside of their control and wish to present to the Government for exclusion to TAT shall be evaluated by the Government Production Management Specialist (PMS) or Program Manager (PM) on a case by case basis. No previous approvals or dissaprovals shall be considered as basis towards the presented exclusion request.

The Contractor shall respond to the Government within one working day from notification of a high priority requirement to negotiate the delivery date to support the requirement. The contractor shall deliver to the negotiated date with zero (0) late deliveries. In the event that a repairable item is required by the Government on an emergency basis to fill Surge/MICAP backorders, the Government PMS or PM will notify the Contractor in writing (E-mail) as soon as the need is identified. For an item identified as a Surge/MICAP requirement under this contract, the Government hereby waives the requirement for Government witnessed acceptance test procedures (ATP) and final inspections by DCMA at the Contractor and its suppliers. This waiver applies only to the number of items necessary to fulfill the Surge/MICAP requirement and shall remain in effect until the immediate need has been satisfied.

Minor repair includes all work consisting of less than eight (8) hours of repair labor (not including test) to return the SRU to a serviceable condition.
4.4.4 SRU Major Repairs: The contractor shall conduct major SRU repairs when appropriate.
Major repair includes all work consisting of greater than eight (8) hours and less than 16 hours of repair labor (not including test) to return the SRU to a serviceable condition.
4.4.5 “Not Including Test” is defined as the technician time to isolate via ATP, verify repair via ATP, and/or environmental test time as applicable.
4.5 Missing on Induction (MOI): An LRU is subject to this MOI provision if the item received by the Contractor for repair is missing one or more SRUs. Contractor replacement of MOI SRUs is not included in the contract price. The Contractor shall immediately notify DCMA when an item is received with MOI SRUs and shall obtain written concurrence from DCMA for all units determined by the Contractor to have MOI SRUs. All such determinations, including identification of the missing SRUs, the price to replace and repair, and the DCMA written concurrence shall be provided by the Contractor to the PMS with a copy to the PCO prior to induction and/or repair of the item. If the asset is missing non-consumable items then the LRU is considered ERA.
4.5.1 The Contractor shall not induct and/or repair MOI items until instructions on how to proceed are provided to the Contractor by the PCO.
4.5.2 Items received by the Contractor missing consumable parts are not MOI items. Rather, repair of such items and replacement of the missing consumable parts are included in the contract price and the item shall be inducted and repaired by the Contractor under this contract.
4.6 Obsolete Parts
Contractor shall notify the Government of evolving obsolete part conditions and make recommendations including last-time buy opportunities and any redesign that may ensue.
Requests for funding and all related issues will be directed through the PCO. Replacement parts or re-design will be recommended to minimize impact. Efforts to replace parts or re-design are
PR: FD2060-16-00502 12
not included unless separately funded. Once determination is made that obsolescence issues apply to said reparable, it will automatically fall under the ERA.
4.7 Cannibalization: The Contractor is authorized to cannibalize (swap) SRUs or consumable items as necessary, without prior approval from the Government, to accomplish timely repair, to meet production schedule, and/or accomplish repair of Surge/MICAP requirements. All cannibalized components will be returned to a pre-cannibalized condition. No changes to the configuration of the reparables or cannablized item is authorized without prior written approval from the Government. The Contractor is not authorized to cannibalize between reparable items inducted under this contract with any other items not inducted under this contract, nor are they authorized to cannibalize between U.S. and any foreign military asssets regardless of induction under or outside of this contract.
4.8 Condemnation/Beyond Economic Repair (BER): Condemned or BER reparables are those items which are faulty to an extent where the cost to repair would exceed more than 75% of the cost to replace the item with an identical new production item (calculated by the cost to produce the item at the time of condemnation/BER).
4.8.1 In order to determine if condemnation or BER are applicable for a reparable item, the Contractor shall provide the Government with a detailed analysis in contractor format, at a level which allows the Governement to perform a technical evaluation of the proposal, to include all costs necessary to repair the item and to replace the item with a new production item.
4.8.2 If the Government concurs, the Administrative Contracting Officer (ACO) or PCO will negotiate an amount, not to exceed the respective CLIN price for the item listed in the contract and based on the incurred actuals, for the work performed by the contractor prior to the condemnation or BER.
