Single Source Justification (Simplified Acquisition)

Section B: Description of the Supplies/Services Required

This contemplated contract is to repair the Pneumatic Actuated Fire Suppression System (FSS) within the A/F37T-10 Noise Suppressors (Hush Houses) at the following locations; Barnes ANG and Joe Foss Field ANG. The United States Air Force uses Noise Suppressors to reduce overall noise levels of jet engines under test and each is equipped with a Fire Suppression System (FSS). The FSS utilized is a "total flooding" system and is required during engine testing in the event of a fire within the Noise Suppressor.

Section C: Justification for Soliciting from a Single Source

Based on the limited available data rights and the requirement need date, the only viable recommendation is to seek a sole source acquisition of this repair capability from Hiller Systems Inc. Accordingly, Hiller Systems Inc. is the only firm capable of providing the service above without the U.S. Air Force experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. Based on estimates by Noise Suppressor engineers, a re-engineering effort would take two years and cost approximately $5M resulting in duplicate and time schedule issue delays. The government would not be able to recoup this cost through competition. Furthermore, the government has requested a ROM to purchase the drawings, software, and data; however, Hiller Systems has responded that the data is proprietary and they are not interested in furnishing a quote, which will further delay the repair of the FSS located at Barnes ANG and Joe Foss Field ANG. This will result in an unacceptable risk level to human life and system safety which is serious and poses additional unacceptable risk to aircraft mission rates, engine spare levels, and safety for personnel. This installation will benefit the USAF by allowing the warfighter to test and maintain engines critical to USAF mission success.

Section D: Efforts to Obtain Competition

The program office is operating under a $73.5M IDIQ contract that pertains only to the Noise Suppressor and not the Fire Suppression System. As a separate contract the program office had a FSS contract, however, it expired in May 2013. The program office is currently supplying the field with standalone tactical contracts that are sole source to the OEM, Hiller Systems to repair current systems. The program office is engaged in developing a $249.8M Full and Open competition, with a proposed 8 year, long term acquisition to provide the fleet with a contract that will encompass the Noise Suppressor and Fire Suppression System which will remove the program from sole sourcing actions. Additionally, the program office will require the necessary data be delivered to the government as part of this contract effort which will allow for future competition. The IPT held an Industry Day to determine the available competition the market has to offer. In addition, the IPT has developed the necessary documents (i.e. Market Research, Performance Work Statement, ESIS, ASP, SSP, etc.) to actively put out a request for proposal. Currently, the Request For Proposals is being reviewed for release. The IPT anticipates awarding this contract in May 2018.

Section E: Steps to Preclude Future Single Source Awards

The program office is unable to forecast when systems will fail, however, the long term contract is being diligently worked and the IPT is working aggressively to have the contract awarded by the proposed award date of May 2018.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
