PART I - THE SCHEDULE

SECTION B

SUPPLIES OR SERVICES AND PRICES/COSTS

SUPPLIES OR SERVICES AND PRICES/COSTS

This solicitation is intended to result in an award of a requirements‐type Indefinite Delivery contract as defined in FAR 16.5 for a total ordering period of 5 years. FAR 15 Contract by Negotiation will be used. All clauses/provisions in the contract are important and the contractor shall ensure that it has reviewed and understands each one. This contract has ordering periods and no options. Therefore, no mods will be issued to open up those periods. The ordering periods represent prices valid for the 12 months represented by each of the 5 ordering periods.

All quantities within the schedule are Best Estimated Quantities (BEQs). The BEQs in this solicitation are not a guarantee to the Contractor that the estimated quantities will be ordered, or that conditions affecting requirements will be stable or normal. Failure of the Government to acquire such items in amounts or quantities described in the Schedule as estimated will not entitle the Contractor to any equitable adjustment. BEQs do not represent a minimum or maximum quantity.

This acquisition is expected to reach the certified cost and pricing data threshold. Certified cost and pricing data is required to be submitted with proposal to support the proposed price as fair and reasonable. This data includes the basis of estimates for labor hours and materials, the support for direct labor rates via payroll, and the support of indirect rates by providing the last two year actual rates (if there is a substantial difference between prior and proposed rates, provide an explanation). The Government wishes that the proposal include a working cost model within Excel to allow for evaluation and negotiation in a timely manner. See DFARS 252.215-7010(d) and 252.215-7012. If the Contractor wishes to have a proposal kick off meeting, please contact the Contracting Officer to set up a phone call.

The Government anticipates that orders for Foreign Military Sales (FMS) requirements will be issued under this contract. However, no orders for FMS requirements will be issued unless a valid letter of Offer and Acceptance for the items to be ordered has been signed by the United States Government and the FMS customer's Government.

Orders for FMS requirements will identify the FMS customer, applicable funding, and other appropriate information.

Note to Contractor: Foreign Military Sales 10 TO 15 DAYS PRIOR TO SHIPMENT, CONTACT THE DCMA/ACO TRANSPORTATION OFFICE FOR SHIPPING

ADDRESS/INSTRUCTIONS.

CALENDAR DAYS: All references to "days" are hereby defined as "calendar days", unless noted otherwise.

Clauses fill in apply:

52.215-20 Alt III: Cost models in functional Excel

52.216‐21: (f) the Contractor shall not be required to make any deliveries under this contract after completion of all orders placed within the ordering period.

52.216‐18: (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the contract schedule. Such orders may be issued from date of award to end of final ordering period.

The pricing arrangement for this contract will be Firm Fixed Price. Delivery orders may be placed from time to time, at any time, during each contract period.
