I. Contracting Activity.
This Justification and Approval to request authority for Other Than Full and Open Competition supports requirements generated for the Air Force Life Cycle Management Center (AFLCMC), Support Equipment & Vehicles Division (WNZ), Mission Generation Branch (WNZBA). The contracting authority for this requirement is the Support Equipment & Vehicles Contracting Branch (WNKAA). The purchase request number supporting this contracting action is FD2060-17-32041
II. Nature and/or description of the action being processed.
Due to the circumstances described below, this activity will acquire the following using Other Than Full and Open Competition (OTF&OC) procedures: This action will result in the award of a One time buy contract. The period of performance for this contract is estimated to be six (6) months. This requirement will be purchased from the following source:

III. Description of supplies/services required to meet agency needs.
The -16, PTMLB) is a portable, trailer mounted, purely resistive, digitally controlled load bank that is used as a mobile test set for maintenance checks, inspections, or testing of various types of electrical power sources, including multiple configurations of the flight line generator sets (-60, -86, B809/A, B, D, and E models) and solid states frequency converters (SSFCs). This load bank has a critical application since it is the only load bank in the AF inventory that supports testing of the F-22 and F-35 270 VDC power supply requirements. Troubleshooting of fault conditions that may occur during the PTMLB's test set up, test operation, and calibration is performed through navigation of the PTMLB screen/display menu utilizing troubleshooting instructions provided in Technical Order (TO) 33AA7-56-31. Troubleshooting and fault diagnostics of the PTMLB is controlled and operated by the software embedded in the micro-controller. The micro-controller is also the brain of the PTMLB that controls all of the PTMLB's functions including display.
There are two (2) different configurations of the PTMLB software and hardware fielded: first configuration covers PTMLB's with serial numbers 005-085; second configuration covers PTMLB's with serial numbers 086 and onward. TO 33AA7-56-31 only reflects first configuration.

This action requires a modification to the diagnostics in the software for both configurations of the fielded PTMLB's to add more features to improve PTMLB's troubleshooting.
This actions requires a revision to TO 33AA7-56-31 to reflect two different configurations of the fielded PTMLB's hardware and software along with revised troubleshooting guidance.
Estimated dollar amount for this contract is Estimated period of performance is 6 months.
IV. Statutory authority permitting Other than Full and Open Competition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The agency's minimum needs can only be satisfied by the unique supplies or services available from Testek Inc. The -16 PTMLB is not a Commercial Off the Shelf (COTS) item. It was developed to replace aging -8 load banks and accommodate additional 270 volts direct current (VDC) capability to test the F-22 power supply requirements that the -8 load banks didn't provide. The PTMLB was designed by Testek Inc. to meet specific USAF requirements outlined in purchase description PD04WRLEE41 (dated 16 August 2004) that derived from requirements correlation matrix (RCM) developed by users' community.
The PTMLB is used to test various types of the United States Air Force (USAF) generators as well as USAF solid state frequency converters (SSFC). The PTMLB is capable of testing 60 hertz (Hz) and 400 Hz alternating current (AC) power sources as well as 28 VDC and 270 VDC power sources. While the commercial market offers different types of dedicated AC or DC load banks, there is no load bank exists in the commercial market that combines all 4 listed electrical power characteristics in one (1) load bank design. The commercial marketplace simply doesn't have need for the combined, varied AC and DC voltages that the military requires. As such, the -16 PTMLB is a military unique design that provides unique capabilities not found in the commercial market.
Additionally, the Government is not in possession of any technical/software data or software distribution rights except the data provided in the PTMLB manual, TO 33AA7-56-31. The design of the PTMLB and software is proprietary to Testek Inc.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This requirement will be synopsized on the Federal Business Opportunities web page citing conditions, which preclude F&OC. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Although the Government is not in possession of any technical/software data or software distribution rights except the data provided in the PTMLB manual, TO 33AA7-56-31. The design of the PTMLB and software is proprietary to Testek Inc.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
In accordance with FAR 15.403-4(a)(1), the contractor is required to provide other than certified cost or pricing data to support the Government's evaluation of the proposed cost. The proposed cost elements of labor, labor hours, types and quantities of material and other direct costs, and direct and indirect rates will be negotiated by the government based on recommendations from the Defense Contract management Agency (DCMA), and recommendation from the TOMA office. The contract price will be negotiated in accordance with the procedures in FAR part 15 ensuring the ultimate cost to the Government is fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted pursuant the FAR 10.002. The market research conducted for this need included a review of the six (6) previous companies that replied to the initial Sources Sought Survey issued by the Small Business Office for the -16 load bank acquisition effort. Each of the sources technical capabilities were reviewed as it relates to the current requirements for this effort. This effort will be used to procure CD and TO for the load bank previously purchased through contract FA8533-05-D-0003.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
There are no load banks currently in the commercial market combining all 4 listed electrical power characteristics in one (1) load bank design that meet the -16 PTMLB requirement. The commercial marketplace simply doesn't have need for the combined, varied AC and DC voltages that the military requires. As such, the -16 PTMLB is a military unique design that provides unique capabilities not found in the commercial market. Additionally, this particular effort requires a modification to the diagnostics in the software for both configurations of the fielded PTMLB's to add more features to improve PTMLB's troubleshooting and requires improvements to the technical content of TO 33AA7-56-31. While some of commercial companies are capable of providing military T.O. that would meet the Air Force Technical Manual Contract Requirements (AF TMCR) requirements outlined in TM-86, none of these companies, except Testek Inc., will be able to fulfil the requirements for this subject effort due to Testek's proprietary rights to the PTMLB design and the software.
