JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
A. Due to the circumstances described herein, this activity requests authority to acquire the services listed in this document using Other Than Full and Open Competition as prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
B. This action is necessitated as a result of delays in awarding a follow-on contract. Initially a competitive acquisition was attempted by the AFLCMC/HBGC office but was delayed due to issues involving the level of data rights possessed by the Government, technical data corrections and processing of critical documents. In an effort to streamline training device procurements the decision was made to transfer this requirement to
In the interim, the AFLCMC/HBGC office requires continuing support for the J-STARS
E-8C ATD.
C. This action will result in the award of a new 18 month contract which will be a Firm Fixed Price, Time and Materials, and Cost Reimbursable No Fee, C-Type contract. The contract will include a 9 month basic period and (3) 3 month option periods. This requirement will be awarded to the following source currently possessing the experience, expertise, and data to provide ongoing support:

Block Training will be halted as a result of aircrews being unable to meet their Air Combat Command Ready Aircrew Program requirements (AFI 11-2E8) and standard pre-deployment requirements. If the ATDs experience a break in service, a significant amount of the training requirements will be placed on operational aircraft, negatively impacting the availability of aircraft for operational crew training and hindering the fleet’s availability to meet war time tasking. Some of the training requirements, such as abnormal and emergency procedures, would not be able to be met due to Safety of Flight constraints this lack of ability to train aircrew will result in increased flight risk for the Joint STARS platform and its crew members. The contract requires the current contractor to ensure Air Combat Command standard trainer availability rate of 95%. Therefore, the Government cannot wait the estimated 24 months for a non-incumbent source to be able to perform on this requirement. Accordingly, Rockwell Collins is the only firm capable of providing the supplies and services described in Section III above without the U.S.
Air Force experiencing unacceptable delays in fulfilling its requirements.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
This requirement will be synopsized on the Federal Business Opportunities web page citing conditions requiring sole source award while a future competitive award is pursued. Although the Government does not own the data to support the acquisition of these services from any other source, any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential for subcontracting possibilities.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
In accordance with FAR 15-403.4, the contractor will be required to provide certified cost or pricing data to be used in supporting the Government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Management Agency (DCMA) and expert technical personnel supporting the program. The Government will negotiate a fair and reasonable price for both parties.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED
The Market Research was completed on 27 April 2015 pursuant to FAR 10.001 and 10.002 to determine the proper strategy for the continued sustainment of the ATDs. The market research inclusive dates were approximately August 2013 to March 2014.
The following market research methods and techniques were utilized:

XII. CONTRACTING OFFICER’S CERTIFICATION
The contracting officer’s signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief (FAR 6.303-2(b)(12)).
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
