Justification and Approval (J&A) for Other Than Full and Open Competition

NOTE: If a Justification and Approval was approved for the preceding acquisition, a copy of the approved J&A for the predecessor action must be included in the staff package for approval of the instant J&A. This applies to J&A staff packages that are submitted for review and approval at a level above the contracting officer. The predecessor J&A will be used as a reference document by the approving official.

I. Contracting Activity.

II. Nature and/or description of the action being processed.

Equipment sustainment which requires evaluation and repair of ) and ) thermal imaging systems.

III. Description of supplies/services required to meet agency needs.

The requires repair services of 15 FLIR Surveillance Inc ThermoVision 2000/3000 thermal imaging cameras with cooled detectors (SLRTI) P/N 614005655 NSN 5855-01-632-0210 for long range surveillance applications from FLIR, back to OEM specifications and in accordance with Program Office and qualification testing standards. These repairs are a continuation of contract FA8307-15-M-0108, which incorporated the evaluation of these 15 SLRTIs, in support of under utilizing . The delivery of these items are to be staggered starting 60 days ARO. has 21 additional SLRTIs requiring evaluation and repair to be included with this effort. The delivery of the remaining 21 SLRTIs will be negotiated.

IV. Statutory authority permitting Other than Full and Open Competition.

10 USC 2304(c)(1) -- Only one responsible source and no other supplies or services will satisfy agency requirements

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The THV-2000/3000s are on the HAF/A4S Approved Equipment List (AEL) for as promulgated by the , , dated 21 Apr 15 which identifies qualified, AF approved equipment which satisfies the requirements of AFI 31-101 and AFMAN 31-108 for use in providing capabilities to assist in protecting and location . FLIR is listed as the only source on both Program Office Source Control Drawings for the THV-2000/3000 (IBDSS10000-085/086). The Government ( ) has tested and and certified these imagers and would require complete recertification for any other vendors repairs to ensure the items meet OEM specifications as the Government does not own or possess the specification drawings. Utilizing any vendor other than the OEM would result in incurring duplicative costs the Government surmises would not be recovered through competition and result in unacceptable repair delays. Any vendor other than the OEM performing repairs would be required to submit their repaired product to for certification testing and be approved by which averages eight months and costs approximately $26,000 per test.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A Sources Sought was posted 13-20 Jan 16 seeking qualified vendors interested in performing the above listed evaluations and repairs with one respondent, HurleyIR who is not currently certified by and the . It is also readily apparent to the Government that the respondent (HurleyIR) is not ready to perform the required repairs of the FLIR THV-2000/3000s based on the following observations from their response: HurleyIR does not have the capabilities to initiate immediate repairs required;

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will accomplish cost and price analysis in strict accordance with guidance contained in FAR 13.106-3 and its supplements and will use the information below to evaluate and determine a fair and reasonable price:

a. Technical Evaluation of proposed repair effort will be conducted to ensure the government's needs are meet.

b. Previous repair data from PIDS will be used to determine reasonableness of repair price.

c. Repair sales data from the vendor may be used also to ensure the Government is receiving fair market pricing on repair efforts.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Through various Internet searches, referring to the Program office and a Sources Sought posted 13 Jan - 20 Jan 16, FLIR Surveillance Inc has been determined to be the sole approved repair facility for these evaluations and repairs.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Every feasible effort will be made to promote competition whenever practical considering technical data, cost and security constraints. are jointly responsible for promoting competition in the ODT&E stage of system acquisition and post RFI on FedBizOps when soliciting vendors. In the event that another vendor meets the minimum qualifications and acceptance testing the Program Office will update the Source Control Drawing and inform of that vendor's ability to evaluate and repair these imagers. HurleyIR was provided guidance on how to become a certified repair source.

XII. Certification by the Contracting Officer.
