Purchase of annual maintenance updates to KenCast FAZZT Digital Delivery System Software used for the Global Broadcast Satellite (GBS) system. This purchase is for the annual updates to support the following existing software licenses in a mature satellite broadcast system.

Section C: Justification for Soliciting from a Single Source or Brand Name
This software has capabilities that are unique to GBS. To redevelop a duplication of the software system it would cost the government between and approximately 7-9 years to develop and implement.
Based on Market Research, KenCast Inc. is the owner, manufacturer and provider of software maintenance (technical support/software updates/upgrades). At this time, KenCast does not have nor allow resellers to support their software.
Section D: Efforts to Obtain Competition
Market Research did not identify any other sources to support this item. A Request for Information (RFI) #149274 notice was posted on the NETCENTS-2 ITCC mandatory source website on 19 July 2016 with responses due by 29 July 2016. The objective of the RFI was to determine if any contractors other than KenCast, Inc. were capable of the skills, knowledge, and data resources to provide the necessary software. As part of the RFI, the government requested to know whether any vendors would be able to provide the necessary product. No NETCENTS-2 product vendors responded.
Further research was conducted on 29 July 2016 and KenCast Inc. was contacted to request a list of distributors or secondary vendors of their

KenCast Inc. provided a letter stating they will not participate in NETCENTS-2 products contracting vehicle for distribution of their software through resellers. KenCast indicated they will no longer provide their proprietary software through a reseller and no other vendor or distributor can legally obtain access to the software or make duplicate copies since it is protected by copyright and patent laws. KenCast Inc. is the sole proprietary supplier of the FAZZT Digital Delivery System software licenses and annual maintenance.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
It is anticipated that future purchases will require a single source justification since the software is protected by copyright and patent laws. However, the requiring activity with continue to conduct market surveys to determine other viable product options or potential future sources if KenCast Inc. begins to provide FAZZT Digital Delivery System Software thorough resellers.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
