52.212-2 -- Evaluation -- Commercial Items.

Evaluation -- Commercial Items (Jan 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Evaluation of all offerors will be conducted as described below:

First, all offerors will be ranked from lowest to highest based on the price evaluation. Second, The lowest priced evaluated offeror will be evaluated for technical acceptability. Last, If the lowest priced evaluated offeror is technically acceptable then a past performance review will be conducted. If the lowest priced evaluated offeror is technically acceptable and past performance review returns no adverse past performance, the government will award to the lowest priced technically acceptable offeror. If the lowest priced evaluated offer is not technically acceptable and/or adverse past performance is found, the evaluation will commence until an offeror is technically acceptable and no adverse past performance has been found.

(i) price;

Pricing will be evaluated by taking the FIRM FIXED PRICE (FFP) CLINs and summing them with the labor rates proposed under the TIME AND MATERIALS CLINs.

Offerors are cautioned against proposing pricing and rates that are unbalanced and unreasonable. Any proposal containing pricing and rates that are unbalanced and unreasonable will be excluded from consideration for award.

(ii) technical capability of the item offered to meet the Government requirement;

1. Subfactor One: Maintenance Plan: The contractor’s proposal is acceptable when it demonstrates:

1.1. A feasible and sufficient maintenance plan with notional milestones detailing the periodic maintenance as detailed in PWS 1.1 to all locations listed in Appendix B. The contractor shall assume in their plan eight total unscheduled visits each year.

2. Subfactor Two: Distributorship Agreements/Experience: The contractor’s proposal is acceptable when it demonstrates:

2.1 Proof of distributorship agreements with Wagner. Proof of factory certifications in maintenance and repair of the Wagner Twin Control, Wagner Flex Control Plus and Wagner Flex Control Smart (IAW PWS 1.2.)

2.2 Evidence of four (4) or more years successful experience in equipment servicing for aerospace top coats and primers. (IAW PWS 1.2.)

2.3 The contractor shall show experience working with two (2) and three (3) component proportioning systems and multi-color proportioning systems.

2.4 Show experience with equipment capable of dispensing and mixing PPGDeft 44GN098 or other three component products with similar viscosities.

3. Subfactor Three: Safety Plan (Appendix C): The contractor’s proposal is acceptable when it demonstrates:

3.1 1 A safety plan in accordance with Appendix C of the PWS.

This is acceptable when you have provided evidence of five years of experience using this software and/or training. Evidence may include but is not limited to, names of personnel who possess the experience and number of years of experience. Approach must go beyond restatement of PWS requirements.

(iii) past performance;

Past performance will be reviewed for relevancy and for acceptable performance on past efforts. The government will use references submitted and other sources to ascertain the acceptability of past performance.

Irrelevant past performance and adverse past performance will disqualify offerors from consideration for award.

Technical and past performance, when combined, are approximately equal when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
