PERFORMANCE-BASED WORK STATEMENT FOR
Global Broadcasting System (GBS) Engineering Services
309th SOFTWARE MAINTENANCE GROUP HILL AFB, UTAH
(520 SMXS)

1. DESCRIPTION OF SERVICES
The purpose of this contract is to transfer knowledge from the contractor to the Government by providing temporary interim support in assisting the 309th Software Maintenance Group (309 SMXG) with the sustainment of the Global Broadcast Service (GBS) that is being transitioned to 100% organic support at Hill Air Force Base, Utah under Depot Source of Repair (DSOR) #10-146.
2. SCOPE
The contractor shall be certified as a Level 3 Capability Maturity Model Integration (CMMI) company. Under the direction of DSOR #10-146, the Defense Enterprise Computing Centers (DECC) Global Broadcast Service (GBS) Satellite Broadcast Manager (SBM) and Receive Broadcast Manager (RBM), will be sustained by the 309th SMXG, Hill Air Force Base, UT. 309th SMXG engineers do not have the domain expertise to sustain this service at this time and requires subject matter experts (SMEs) experienced in the development / design of the system to transfer this knowledge to organic personnel. The Place of Performance will be primarily at the contractor facility.
3. BASIC SERVICE REQUIREMENTS
3.1 Tier II Operations Support Requirements (Includes On Call Support)
3.1.1 The Contractor shall use disciplined systems engineering processes including, but not limited to; requirements development, technical management and control, system/software design and architecture, Integrated Risk Management, Configuration Management, Data Management, test, evaluation, verification and validation practices throughout the period of performance of task orders in accordance with AFI 63-101/20-101 Integrated Life Cycle Management.
3.1.2 The Contractor shall provide Tier II Operations Support to include 24/7 on-call support to the GBS Operations Center (GBSOC) with two (2) hour(s) response time. The Contractor shall provide operational technical support and troubleshoot operational issues. The Contractor shall provide on-call support for technical assistance, support of multiple software versions, training, testing and maintenance, 24-hours a day, 7-days a week, 365 days a year. The Contractor shall maintain and conduct an annual SBM Operator Training course for the GBSOC operations staff and other Government personnel. (Services Summary #1)
3.1.3 The Contractor shall provide Tier II RBM Operations Support to the GBSOC and directly to the Services as the RBM GRS release(s) is fielded by the DoD Services. This includes supporting the transition of the Legacy RBMs to RBMs running GRS.
3.1.4 The Contractor shall report GBS documentation deficiencies found to appropriate organization. The Contractor shall act as a GBS liaison to DISA DECC and DISA Consolidated Communications Center (CCC). The Contractor shall assist with troubleshooting source integration issues and provide Continuity of Operations (COOP) and reconstitution support to the GBSOC.
3.1.5 The Contractor shall support planning, preparation and execution of test events, technology transitions and satellite constellation changes as directed by the Government. The Contractor shall assist the Government in installation and verification of changes made to the SBM Mission Unique Equipment (MUE), shared DECC Infrastructure, Primary Injection Point (PIP) and Teleport networks as directed by the Government.
3.1.6 The Contractor shall informally train and perform systematic GBS domain knowledge transfer to the 309 SMXG of the Tier II Operations activities.
3.2 DECC GBS Domain Subject Matter Expert (SME) Reach back Sustainment Support
3.2.1 The Contractor shall analytically and systematically evaluate problems of work flows and network usage, organization, planning and develop appropriate corrective action. The Contractor shall design architecture to include the software, hardware and communications to support the total requirements as well as provide for present and future cross-functional requirements and interfaces. (Services Summary #2)
3.2.2 The Contractor shall provide support, analysis and research into complex problems and processes relating to the subject matter. The Contractor shall serve as a technical expert on executive-level project teams providing technical direction, interpretation and alternatives.
3.2.3 The Contractor shall work under consultative direction toward predetermined long-range goals and objectives. The Contractor may be required to self-initiate assignments. The Contractor shall determine and pursue courses of action necessary to obtain desired results.
3.2.4 The Contractor shall provide SBM and RBM sustainment reach-back support to 309 SMXG and MCL to include:
3.2.4.1 Investigating System Problem Reports (SPRs) as requested
3.2.4.2 Evaluate and verify proposed changes to the GBS DECC infrastructure
3.2.4.3 Providing SBM release installation and verification support
3.2.4.4 Providing GRS release development support and regression testing support
3.2.4.5 Supporting the MCL Deficiency Review Board (DRB) and Engineering Review Board (ERB)
3.2.4.6 Manage and support technology refresh and integration efforts as required (i.e. Conditional Access Services, TRASNSEC Capabilities, Cross Domain Solutions, Bandwidth Expansions, Split-IP, Broadcast Uplink Transitions, Native Multi-Cast)
3.2.4.7 Maintaining the existing sustainment procedures (B014)
3.2.4.8 Other development activities as directed by the Government
3.2.5 The Contractor shall develop engineering change studies, engineering change requests (CRs) and engineering change proposals (ECPs) for recommended changes in the GBS DECC architecture and the associated test and support environment software/hardware. For activities that are not within scope of the Performance-based Work Statement (PWS), engineering change packages (ECPs) shall be prepared IAW applicable Contract Data Requirements Lists (CDRLs) to include updated source data for Time Compliance Technical Orders (TCTOs), Technical Orders/Technical Manuals and the GBS System Requirements Document (SRD). The Contractor shall assist the 309 SMXG to produce prototype designs and oversee development and testing for proposed changes.
3.2.6 The Contractor shall engineer solutions as required and prioritized by the Government to include assigned SPRs, Cyber Security (formerly IA) compliance requirements, requests for product improvements, and COTS Obsolescence Resolution tasks written against GBS system products.
3.2.7 The Contractor shall informally train and perform systematic GBS domain knowledge transfer to the 309 SMXG of the SBM and RBM to include the design, development, and operational troubleshooting of the GBS.
3.3 Cyber Security Support of the SBM and RBM
3.3.1 The contractor shall perform information assurance activities including the documentation and testing required to maintain all appropriate Authority to Operate (ATO) certifications for the SBM and RBM. The contractor shall evaluate Information Assurance Vulnerability Alerts (IAVAs) as they are released by CYBERCOM for applicability and creating the appropriate SPRs. The contractor shall evaluate Security Technical Implementation Guide (STIG) updates as they are released by CYBERCOM for applicability and creating the appropriate PRs. The contractor shall provide regular Plans of Actions & Milestones (POA&M) updates as required to maintain the SBM, and RBM accreditation. (Services Summary #3)
3.3.2 The contractor shall evaluate the Cyber Security impacts of the proposed solutions for all SBM and RBM PRs. The contractor shall perform a Risk Assessment of all SBM and RBM releases prior to their installation and fielding at the operational sites. The contractor shall support the transition from DIACAP to the Risk Management Framework (RMF) per NIST SP 800-53 Version 4 for the SBM and the RBM packages.
3.3.3 The Contractor shall informally train and perform systematic GBS domain knowledge transfer to the 309 SMXG of the information assurance activities.
3.4 Sigonella Primary Injection Point (PIP) Site Support (Option CLIN)
3.4.1 Sigonella PIP SME Reach back Support - The Contractor shall provide Sigonella PIP DECC Enclave sustainment reach-back support to 309 SMXG and MCL to include assisting in designing, implementing, and testing changes to the Sigonella PIP DECC Enclave baseline.
3.4.2 Cyber Security Support of the Sigonella PIP Site Support - The contractor shall perform information assurance activities including the documentation and testing required to maintain all appropriate Authority to Operate (ATO) certifications for the Sigonella PIP. The contractor shall evaluate Information Assurance Vulnerability Alerts (IAVAs) as they are released by CYBERCOM for applicability and creating the appropriate SPRs. The contractor shall evaluate Security Technical Implementation Guide (STIG) updates as they are released by CYBERCOM for applicability and creating the appropriate PRs. The contractor shall provide regular Plans of Actions & Milestones (POA&M) updates as required to maintain the Sigonella PIP accreditation. The contractor shall evaluate the Cyber Security impacts of the proposed solutions for Sigonella PIP PRs. The contractor shall perform a Risk Assessment of the Sigonella PIP updates prior to their installation.
3.5 Travel
3.5.1 The Contractor shall travel as needed for project purposes including, but not limited to program support and software maintenance activities. The Contractor shall coordinate specific travel arrangements with the Government to obtain advance, written approval for the travel that may be conducted. The Contractor’s request for travel shall be in writing and contain the dates, locations and estimated costs of the travel in accordance with the basic contract clause H047. Costs associated with contract travel shall be in accordance with FAR Part 31.205-46 Travel Costs.
3.5.2 If any travel arrangements cause additional costs to the task order that exceed those previously negotiated, written approval by the Contracting Officer is required, prior to undertaking such travel. The Contractor shall travel using the lower cost mode transportation commensurate within the mission requirements. When necessary to use air travel, the Contractor shall use economy class or similar accommodations to the extent when they are available and commensurate with the mission requirements. Travel will be reimbursed on a cost reimbursable basis; no profit or fee will be paid.
3.5.3 The Government estimates travel will be performed at a minimum, quarterly, to support release and major technical interchange meetings to the following locations: Oklahoma City, OK; Shriever AFB, CO; Peterson AFB, CO, Mechanicsburg, PA; Hill AFB, UT; Sigonella, Italy (specific to section 3.5). The Contractor shall travel to other locations as directed by Government.
3.6 Monthly Status Report (Services Summary #4) (CDRL A001) (DI-QCIC-80555A)
3.6.1 The contractor shall provide a Monthly Status Report for the reporting period ending on their financial month-end. This is typically between the 20th and 28th of the month. The contractor shall provide this report to the Contracting Officer (CO), the Contracting Officer Representative (COR) and the Government PD for the program or other designated Government representative within the first seven (7) business days of the subsequent month.
3.6.2 Reports shall provide status and progress of the project(s) being worked on and financial information related to the contract. All data deliverables will be referenced in the monthly status reports.

5. Contractual Requirements
5.1 Place of Performance
5.1.1 The Place of Performance will be primarily at the contractor facility. Contractor personnel shall augment 309 SMXG with on-site contractor support to work with civilian personnel on an as needed basis in a team environment on depot software maintenance activities. Locations for support may include but are not limited to Hill Air Force Base, UT; Oklahoma City, OK; Peterson AFB, CO; Shriever AFB, CO; Mechanicsburg, PA; and Sigonella, Italy (specific to section 3.4). The Government will provide no permanent working space in any of the above mentioned facilities.
5.2 Government Furnished Property (GFP)
5.2.1 The Contractor shall be responsible for safeguarding all Government property provided for Contractor use. At the close of each work period, Government facilities, property, and materials shall be secured.
5.3 Facilities and Government Furnished Equipment and Personnel for Off-Site Support
5.3.1 The contractor shall have the capability to establish or have access to the facilities, equipment, and qualified personnel necessary to meet the requirements of the PWS. The contractor shall have the ability to obtain and effectively utilize these facilities, equipment, and qualified personnel. The Government is not obligated to provide these facilities/equipment.
5.3.2 A supplemental list is provided that includes the listing of property that is provided in support of this PWS. All property provided to the contractor shall remain the property of the Government. The contractor shall conduct a joint inventory with the Government and turn in this equipment to the Contracting Officer Representative upon request or completion of the Task order. If the contractor proposes alternative tools, models, equipment etc., in supporting the requirements of the PWS, the verification, validation, and accreditation of those items shall be included in the proposal.
5.4 Non-Personal Services
5.4.1 The Government will neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor feels that any actions constitute, or are perceived to constitute personal services, it shall be the contractor’s responsibility to notify the Contracting Officer immediately. These services shall not be used to perform work of a policy/decision making or management nature, i.e., inherently Governmental functions. All decisions relative to programs supported by the contractor shall be the sole responsibility of the Government.
5.5 Contractor Identification
5.5.1 All contractor/subcontractor personnel shall be required to wear AF-approved or provided picture identification badges so as to distinguish themselves from Government employees. When conversing with Government personnel during business meetings, over the telephone or via electronic mail, contractor/subcontractor personnel shall identify themselves as such to avoid situations arising where sensitive topics might be better discussed solely between Government employees. Contractors/subcontractors shall identify themselves on any attendance sheet or any coordination documents they may review. Electronic mail signature blocks shall identify their company affiliation. Where practicable, contractor/subcontractors occupying collocated space with their Government program customer should identify their work space area with their name and company affiliation. Refer to Clause H063 of the overarching ID/IQ contract.
5.6 Contract Management
5.6.1 The Contractor shall establish and provide a qualified workforce capable of performing the required tasks. The workforce may include a project/task order manager who will oversee all aspects of the contract. The Contractor shall use key performance parameters to monitor work performance, measure results, ensure delivery of contracted product deliverables and solutions, support management and decision-making and facilitate communications. The Contractor shall identify risks, resolve problems and verify effectiveness of corrective actions. The Contractor shall institute and maintain a process that ensures problems and action items discussed with the Government are tracked through resolution and shall provide timely status reporting. Results of contractor actions taken to improve performance shall be tracked, and lessons learned incorporated into applicable processes. The Contractor shall establish and maintain a documented set of disciplined, mature, and continuously improving processes for administering all contract and Task Order efforts with an emphasis on cost-efficiency, schedule, performance, responsiveness, and consistently high-quality delivery. The Contractor shall provide transition plans as required.
5.6.2 The Contractor shall provide the Government, via email, a month Contractor’s Progress Report (same as monthly report in section 3.6 with the below information added), in Contractor format, which will provide program cost information and the tasks accomplished each month by the Contractor. The Contractor shall obtain Government approval of the report format and content prior to the first submittal. The Contractor shall submit the report as outlined in the associated CDRL (A001). Information contained shall match the Contractors monthly invoice. The Contractor shall provide, via email, interim financial status information as requested by the Government. The financial report shall contain sufficient information both in breath and detail to provide the Government a means to track all expenditures related to this contract.
5.7 Quality Control
5.7.1 The Contractor shall have in place a Human Resource Management Program to ensure qualified candidates are identified, screened, placed, monitored, and trained/retained to fulfill service requirements. The Contractor shall accomplish requirements by employing and utilizing qualified personnel with appropriate combinations of education, experience, knowledge, training, abilities and skills, as well as physical capabilities. The Contractor shall maintain clear organizational authority and responsibility to effectively manage and control personnel. This shall be accomplished without requiring Government employees to engage in the contractor’s operational or human resource management processes. The Contractor shall have an internal process in place to ensure that work or labor hours reported by employees are accurately reflected on billing invoices and monthly reports.
5.7.2 The Contractor shall establish and provide all reasonable means to ensure that performance of this contract in a Government facility is fully complementary with, and does not run counter to, any written local operating procedure or policies that may be provided by the Government. This is consistent with the contractor’s exclusive right and authority to supervise and control its employees.
5.7.3 The Contractor’s Quality Control Program is the means by which he assures himself that his work complies with the requirement of the contract. This plan shall be provided as part of the task order proposal but shall not be evaluated for award. The Contractor shall make appropriate corrections and modifications to the plan and obtain acceptance of the plan by the contracting officer before the start of the first operational performance period. Updates shall be provided whenever there is a change. (A083).
5.7.4 The plan shall reflect the contractor’s overall approach, internal management controls, processes, and procedures for reporting to the Government on identified aspects of quality issues. The plan shall identify the means by which the contractor will ensure quality effectiveness and demonstrate comprehensive management and review of data. The plan shall describe what is measured, how often it is tracked and provided, who reviews and assures that appropriate action is initiated when trends are unfavorable, who the Government will contact for contractor quality issues, what method and process is used to track and resolve issues, where reports are sent and maintained, and how often quality issues are reviewed and reported. The plan shall identify how the contractor identifies and resolves deficiencies, identifies potential improvements, and maintains and makes available to the Government, documentation reflecting quality control inspections and any corrective actions taken. The Contractor shall provide copies of all discrepancies to the COR.
5.8 Safety Requirements
5.8.1 In performing work under this task order, the Contractor shall conform to the safety requirements contained in this Performance-based Work Statement and the Safety, Fire Protection and Health Specification Industrial Safety Requirements (attached) for all activities related to the accomplishment of the work. Take such additional immediate precautions as the contracting officer may reasonably require for safety and mishap prevention purposes. Implement a safety program in accordance with the applicable contract clauses and their accepted Safety and Health Program Plan. (A099).
5.8.2 Contractors shall comply with Occupational Safety and Health Act (OSHA) (Public Law 91-596) and OSHA Standard 29 CFR 1910 for the protection of their employees. It is the Contractor’s sole responsibility to make certain that all safety requirements are net. Additionally, the Contractor is responsible for the safety and health of all subcontractor employees. The 309 SMXG and Hill AFB are pursuing recognition under OSHA’s Voluntary Protection Programs (VPP). To achieve and maintain this level of recognition, all contractors working on the installation shall receive the same level of safety and health protection as Government employees. All contractors are required to familiarize themselves with the requirements of VPP. Information on the VPP can be accessed at http://www.osha.gov/dcsp/vpp/index.html.
5.8.3 The Contractor shall provide to the Government, on an annual basis, injury and illness rates for employees working onsite at a government facility during the previous calendar year under this contract; specifically the Total Case Incidence Rate (TCIR) and Days Away, Restricted, or Transferred (DART) rates consistent with OSHA’s recordkeeping requirements. These rates shall be provided by 01 Feb of each year for comparison with corresponding injury and illness rates provided by the Bureau of Labor Statistics (BLS) based on the appropriate North American Industrial Classification System (NAICS) code and shall be included in any subsequent OSHA VPP Application or Annual Self Evaluation as required. 6. GENERAL INFORMATION
6.1 Security Requirements
6.1.1 The contractor shall be required to obtain security clearances for all of their employees. In addition, the contractor shall be required to obtain a security clearance of SECRET. A DD Form 254 will be required for all personnel.
6.1.2 520th SMXS or the Government Program Director will assist contractor in processing the necessary DoD forms to obtain base or area badges for access to Government facilities if needed.
6.1.3 The contractor shall comply with all clearance and access requirements throughout the period of performance.
6.2 OPSEC Requirements
6.2.1 The contractor shall familiarize all new employees and conduct refresher sessions in the areas of Operations Security (DOD Contract Security Classification Specification) addendum and Operations Security (AFI 10-701 Operations Security as supplemented, and AFI 31-401 Information Security Program, Standards for Storage and Handling Classified Material as supplemented).
6.3 Hill Network Access
6.3.1 Access to the Hill AFB computer network for onsite (Hill AFB) support may be required to accomplish the requirements of this PWS. The following shall be completed prior to receiving that access.
6.3.1.1 For those contractor employees who require government computer access only, a National Agency Check with written Inquiries (NACI) must be submitted. For those contractor employees who require a higher level of investigation for a security clearance and government computer access, a National Agency Check with Local Agency Checks and Credit Check (NACLC), Secret or a Single Scope Background Investigation (SSBI), Top Secret, must be submitted. 6.3.1.3 If a government provided e-mail account is required the contractor will take Information Assurance Awareness Training prior to receiving access to that account, and annually thereafter.
6.3.1.4 Contractors are required to report in a timely manner (3 days AFI 33- 202_AFMCS1) to the appropriate security manager & Functional System Administrator, personnel who no longer need network or AIS access.
6.3.1.5 The contract administrator shall complete a "Request for Identification Credential (AFMC Form 496)" for each employee of the contractor requiring access to Hill AFB. The requests shall be submitted to Pass and Registration (South or West Gate Visitors Center).
6.4 Badge/Common Access Card (CAC) Information/Unescorted Entry Authorization
6.4.1 The user security manager shall complete an “Unescorted Entry Authorization Certificate” (AF Form 2586) for each employee requiring entry into controlled areas. The request shall be submitted to Pass and Registration (South or West Gate Visitor Center)
6.4.2 If needed, the contractor employee shall also obtain a Building ID and access card from the appropriate Building Security Manager.
6.4.3 When the period of performance is complete and/or contractor leaves work on this project they shall have 5 working days to terminate all their network user account and to return all access cards and base identification badges.
6.5 Quality Control
6.5.1 The contractor shall establish Quality Control Plan to ensure the requirements of this contract are provided as specified. The contractor's quality management program shall comply with the minimum quality management systems elements specified in the American National Standards Institute (ANSI), American Standards Organization (ASO), and International Standard Organization (ISO) family of standards. 6.6 Quality Assurance
6.6.1 The Contracting Officer Representative (COR) is the authorized government representative(s) who will perform assessments of the contractor’s performance. Subsequent to contract award, the identity of the COR(s), with a letter defining duties and authority will be promptly furnished to the contractor
6.6.2 The COR(s) or alternate(s) will inform the task manager when discrepancies occur and will request corrective action. The COR(s) or alternate(s) will make a notation of the discrepancy on the assessment checklist with the date and time the discrepancy was noted and will request the task manager (or authorized representative) to initial the entry on the checklist.
6.6.3 Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contract Officer (CO), not to the COR(s).
6.6.4 The services to be performed by the contractor during the period of this contract are at all times and places subject to review by the CO or authorized representative(s).
6.6.5 The Government will periodically evaluate the contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government representative will evaluate the contractor’s performance through inspections and receipt of complaints from base personnel.
6.6.6 The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints.
6.7 Government Observation
6.7.1 Government, other than CO and COR(s), may from time to time, with CO coordination, observe contractor operations. However, these may not interfere with contractor performance or make any changes to the contract.
6.8 Data Rights
6.8.1 The 520th will have all the rights and access necessary to GBS data required to maintain the GBS system as currently established with the GBS Program Office (the acquiring and owning government agency). This contract does not establish or modify the GBS Program Office’s rights or claims to GBS data as presently understood or lawfully established. The 520th will not release restricted source code outside of the GBS software sustainment effort. However, it should be understood that the Government reserves the right to challenge any restrictions to technical data relating to the GBS Program. The Government shall have unlimited rights to all software developed (new) or government purpose rights for software modified (delta) during the performance of this contract. The Government may use such items for any other purpose as stated in the Defense Federal Acquisition Regulation Supplement (DFARS) definitions of “government purpose rights” or “unlimited rights”.
6.8.2 In addition, all materials, if supplied to the contractor is the sole property of the Government and may not be used for any other purpose accept for what it was intended.
6.9 Hours of Operation
6.9.1 The contractor shall perform the services required under this contract during the following hours when on site at Hill AFB: Typical Workdays will be 8 to 9 hours long and will work within the flexible start schedule that HAFB has. In the event, the contractor shall be available to support work hours outside of the aforementioned typical work day via coordination and approval of the 520th. Contractors are not authorized compensation for attendance at base functions unless directly related to project assignments as authorized by the project director.
6.10 Observance of Legal Holidays and Excused Absence
6.10.1 Government personnel observe the following holidays and contractor access will be limited or unavailable:
· New Year's Day
· Martin Luther King's Birthday
· President's Day
· Memorial Day
· Independence Day
· Labor Day
· Columbus Day
· Veteran's Day
· Thanksgiving Day
· Christmas Day
6.10.2 In addition to these days designated as holidays, the Government observes the following days:
· Any day designated by federal statute
· Any day designated by executive order
· Any day designated by a President of the United States proclamation
6.11 Records
6.11.1 The contractor shall be responsible for creating, maintaining, and disposing of only those government required records that are specifically cited in this PWS. If requested by the government, the contractor shall provide the original record or a reproducible copy of any such record within five working days of receipt of the request.
6.12 Training
6.12.1 The government may provide training to the contractor, on an as needed basis. This training must be pre-approved by the government program manager. Special base access, computer security training and security training will be provided to the contractor Employees by the appropriate government agency.
6.13 Installation-Specific Safety and Health Standards
6.13.1 Voluntary Protection Program (VPP)
6.13.1.1 Hill AFB, along with the entire Air Force, has adopted the VPP as recognized by Occupation Safety Health Association (OSHA). Consequently, VPP impacts all “applicable contractors” operating on Air Force Installations. It is the contractor’s responsibility to ensure its onsite employees and managers have a comprehensive understanding of VPP as well as full compliance with OSHA requirements. Onsite contractor personnel will participate in the safety activities provided for 520th employees. Detailed information on VPP is available on the OSHA website (http://www.osha.gov/dcsp/vpp/index.html). Contractors, whether regularly involved in routine site operations or engaged in temporary projects such as construction or repair, must follow the safety and health rules of the installation or VPP site.
6.13.1.2 VPP requirements apply to contractors whose employees work more than 1,000 hours per quarter. The contractor shall flow down these requirements to all subcontractors who qualify as applicable contractors under this contract.
6.13.1.3 Contractors are required to provide from their OSHA 300 information on the Total Case Incident Rate/Days Away Restricted or Transferred (TCIR/DART) rates. Submit to the CO as part of the installation’s annual OSHA VPP self-evaluation report. (CDRL A003) (DI-MGMT-80227)
6.13.2 Safety Program
6.13.2.1 The contractor shall maintain its safety program at the contractor location that ensures protection of Government personnel and property. Additionally, the contractor shall follow the rules and guidelines of the customer location for contractor personnel working on-site. (See Appendix C)
6.13.2.2 In the event of an accident/mishap, the contractor shall take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence. A written or email copy of the mishap/incident notification shall be sent within three calendar days to the Government Representative, who will forward it to 309 MXW safety. 6.14 Time and Accounting
6.15 Scope Change
6.15.1 Any matter concerning a change to the scope, prices, terms or conditions of this contract will be referred to the CO and not to the COR.
6.16 Communication
6.16.1 The contractor shall inform government management of problems and risks that could impact the mission or organization during weekly status meetings. Cooperates and coordinates with others within the assigned organization, and functions well as a member of a project or government product team.

SECTION I - GENERAL REQUIREMENTS
A. Safety Program Requirements.
The contractor will implement a safety program plan that ensures protection of Government personnel and property. The program will consist of, as a minimum:
1. Mishap reporting, as defined in paragraph B1 below.
2. A Safety Plan that addresses, as a minimum, the subjects listed in Section II –Specific Requirements, and will be used during the performance of the work described in the contract. The Safety Plan will be accepted by OO-ALC/SE (Safety Office) prior to commencement of any work described in this contract.
3. Routine and recurring surveillance to ensure the safety requirements of this contract are enforced.
4. Competent personnel to provide surveillance of the Safety Plan.
5. Identification of segregated work site locations for operations that cannot be co-mingled with general industrial operations and the process for ACO approval of operations and changes at these specific sites.
6. All contractor personnel shall be trained and qualified to perform their duties safely.
7. The contractor shall include a clause in all subcontracts requiring the subcontractors to comply with the safety provisions of this contract, as applicable.
B. Mishap Notification
1. The contractor shall notify OO-ALC/SE (801-586-6038) or the Hill AFB Command Post (801-777-3007) after normal duty hours, and the designated Government Representative (GR), i.e., the ACO, PCO, or DCMA COR (Contracting Officer's Representative) within one (1) hour of all mishaps or incidents at or exceeding $2,000 (material + labor) in damage to DOD property entrusted by this contract, even if the government is wholly or partially reimbursed. This notification requirement shall also include physiological mishaps/incidents. A written or email copy of the mishap/incident notification shall be sent within three calendar days to the GR, who will forward it to OO-ALC/SE. For information not available at the time of initial notification, the contractor shall provide the remaining information no later than 20 calendar days after the mishap, unless extended by the ACO.
Mishap notifications shall contain, as a minimum, the following information:
(a) Contract, Contract Number, Name and Title of Person(s) Reporting
(b) Date, Time and exact location of accident/incident
(c) Brief Narrative of accident/incident (Events leading to accident/incident)
(d) Cause of accident/incident, if known
(e) Estimated cost of accident/incident (material and labor to repair/replace)
(f) Nomenclature of equipment and personnel involved in accident/incident
(g) Corrective actions (taken or proposed)
(h) Other pertinent information
2. The contractor shall cooperate with any and all government mishap investigations. Additionally if requested by government personnel or designated government representative (GR), i.e., the ACO, PCO, or DCMA COR, the contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records, until released by safety investigators.
3. The contractor shall provide copies of contractor data related to mishaps, such as contractor analyses, test reports, summaries of investigations, etc. as necessary to support the government investigation.
4. The contractor shall support and comply with the safety investigation and reporting requirements of AFI 91-204, Chapters 1 – 5.
C. General Safety Requirements:
| If the safety plan is modified, the contractor shall submit the proposed modification, in writing, to the Contract Administration Office safety representative. |
| The contractor is solely responsible for compliance with all federal, state and local laws, the Occupational, Safety and Health Act (OSHA) (Public Law 91-596) and the resulting standards, OSHA Standards 29 CFR 1910 and 1926, as applicable, Air Force Occupational Safety and Health Standards (AFOSH STD), to include AFI 91-203, Air Force Consolidated Occupational Safety Instruction, AFI 91-204, Safety investigations Reports, AFPAM 91-210, Contract Safety, and the protection of their employees. Additionally, the contractor is responsible for the safety and health of all subcontractor employees. All documents required as a result of OSHA 29 CFR 1910 and 1926 regulations, (i.e. certifications, training, respiratory protection program, workplace hazard assessments), shall be made available to the COR upon request. |
| The contractor shall ensure assigned personnel are adequately trained and qualified for the task being performed. Brief all personnel on the hazards involved with operations and applicable precautions to be taken. |
| Hazard Assessment. In accordance with 1910.132(d)(2), the contractor shall conduct a certified Hazard Assessment on all work areas. A follow-on survey shall be conducted by the contractor when the workload or environment conditions change. If respirators are necessary to protect the health of the employee or whenever respirators are required by the contractor, the contractor employer shall establish and implement a written respiratory protection program according to 29CFR 1910.134. |
Contractor personnel must receive Explosive Safety Awareness Training if their duties require entry into the Explosive Clear Zone. This training will be provided by the OO-ALC Safety Office. Contact Eric Covington at 586-0168.
A Risk Assessment will be required prior to any work being accomplished, if munitions will remain in the facility.
Compliance with OSHA and other applicable laws and regulations for the protection of contractor employees is exclusively the obligation of the contractor. Note: AFOSH STDs are annotated because many of the Air Force Standards exceed the OSHA standard criteria. If a conflict is noted, the most stringent requirement takes precedence. The government shall assume no liability or responsibility for the contractor's compliance or non-compliance with such requirements. The contractor shall furnish to each of his/her employees a place of employment, which is free from recognized hazards. The contractor shall brief his/her employees on the safety requirements of this contract and on hazards associated with prescribed tasks. The contractor is responsible for compliance with OSHA Public Law and the resultant standards identified within. In addition, the contractor is required to flow down the safety requirements/specification to all subcontractors. This applies to Federal Acquisition Regulation (FAR) 12 commercial acquisitions as well. This contract shall in no way require persons to work in surroundings or under working conditions which are unsafe or dangerous to their health. The contractor must coordinate and perform work so as not to impact the safety of government employees or cause damage to government property. This requires providing personnel with protective equipment and associated safety equipment as may be necessary. The contractor must also protect personnel from hazards generated by the work. If the contractor employs BILINGUAL speaking employees, they must post bilingual signs and have written procedures for specific tasks in applicable languages.
SECTION II – SPECIFIC REQUIREMENTS
The contractor’s prepared Safety Plan shall:
1. Demonstrate a management commitment to employee safety and health
1. Identify applicable rules and regulations
1. Identify the roles and responsibilities of Management, Supervisors, Employees and Safety Coordinator
1. Identify work to be performed and location of expected operations
1. Provide a description of safety program, safety monitoring responsibilities, organizational structure, and contact information for on-site personnel
1. Include a work hazard analysis of the worksite and operations to be performed to include baseline hazard identification and required control measures
1. Identify employee safety and health training requirements and the documentation process
1. Include emergency response plans and procedures that relate to protection of government personnel and property
1. Include hazard reporting procedures and identify individual(s) responsible for the correcting identified hazards
1. Identify procedures for accident reporting and investigation
1. Identify the process for tracking controlled hazards in contractors work area
The contractor shall ensure that each element identified below is adequately addressed in detail in the safety and health plan:
PEDESTRIAN CROSSWALKS: All contractor personnel are required to use the closest crosswalk, or traffic controlled intersection when crossing the road. Pedestrians must look both ways to ensure the coast is clear before stepping out into the crosswalk. Pedestrians DO NOT have the right of way unless they are already in the crosswalk. Contractor vehicle operators have the same responsibilities as pedestrians, to share the road and mutually observe and yield to pedestrians.
MOTOR VEHICLES: Contractor shall comply with the standards in: DoD Directive 5525.4, Enforcement of State Traffic Laws on DoD Installations", Nov 2, 1981, Para 3-4; DODI 6055.4, DoD Traffic Safety Program, 20 Jul 99; AFI 91-207, USAF Traffic Safety Program, 22 May 07; and AFI 91-207 AFMC SUP1, The US Air Force Traffic Safety Program, 1 Oct 07. Each applies to all persons at any time on an Air Force Installation and includes all leased, owned, or privatized property including housing areas.
