MEMORANDUM FOR RECORD 24 April 2009
SUBJECT: Clarification of Past Performance Volume for T-38 Wing RFP (FA821808R73114)
1. The purpose of this memorandum for record is to clarify the Section L ‘Instructions to Offerors’ requirements for the past performance volume, specifically paragraphs 5.1.5 and 5.1.6.
2. Paragraph 5.1.5, Questionnaires, currently instructs each offeror to send out Past Performance Questionnaires to each of the offeror’s, critical subcontractors, teaming contractors, three POCs as identified in the contact list of the PPIS. The intent is to have each offeror send questionnaires only to the offeror’s (not subcontractor) three government/commercial POCs for each PPIS submitted. Section L will be updated as soon as possible to reflect the correct intent; draft verbiage is as follows:
5.1.5 Questionnaires: The offeror shall send out the Past Performance Questionnaires (See Section L Attachment 2) to each of the offeror’s three (3) government/commercial Points of Contact (POCs) identified in the contracts listed in each of the Past Performance Information Sheets (PPIS). – (remainder of paragraph will remain the same)
3. Paragraph 5.16, Subcontractor Consent Form, currently explains to offerors that the purpose of the form is for subcontractors to consent to the release of their past performance information to the prime offeror. The intent is not for the subcontractor past performance information to be released directly to the prime contractor, but rather to inform all parties that subcontractor past performance may be released to prime offerors in the course of exchanges or discussions. Section L will be updated as soon as possible to reflect the correct intent; draft verbiage is as follows:
5.1.6 Subcontractor Consent Form: Past Performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the potential release of their past performance information to the prime offeror. The intent is not to directly release subcontractor past performance to the prime offeror, but the potential exist for information to be released to prime offerors in the course of exchanges or discussions.
