Single Source Justification (Simplified Acquisition)

Section B: Description of the Supplies/Services Required
The MTS-206 is a portable test set for the AGM-65 Maverick Missile System used by foreign militaries. It combines the test capabilities of an I-Level test set in a compact, rugged enclosure with associated interface cabling. The MTS-206 performs parametric functional tests on Maverick missile system components including: AGM-65 Missile and AGM-65 Missile Sections (All-Up-Round, Guidance Control Section & Center-Aft Section, all versions in Tactical and Training configurations [with appropriate target simulators]), LAU-117 and LAU-88 Maverick launchers (all versions), and Launcher-Missile Clusters. The MTS-206 is based on the PXI (Pci eXtensions for Instrumentation) architecture. This requirement is to repair 2 ea MTS-206 Test Sets for a Foreign Military Sales (FMS) customer.
Section C: Justification for Soliciting from a Single Source
The authority permitting other than full & open competition is 10 USC 2304 (c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Upon approval to solicit from a single source, the Government will negotiate a contract with Marvin Test Solutions, Inc.
The MTS-206 was developed by Marvin Test Solutions as part of an AGM-65 Maverick Missile Foreign Military Sale (FMS) package awarded to Raytheon Missile Systems. Due to the specialized nature and use of the MTS-206 with live munitions the design of the MTS-206 requires certification by the US Air Force Non-Nuclear Munitions Safety Board (NNMSB) for use by USAF personnel. The USAF was able to observe test events through development, specifically an informal qualification test utilizing inert assets. Additionally, the MTS-206 was presented at the NNMSB, and although not USAF NNMSB certified, the board found the MTS-206 possessed an adequate degree of design safety for USAF operational use in May of 2004. No formal documentation was developed for the USAF as part of this FMS effort, which includes a lack of a validated/verified Technical Order (user operating instructions), and qualification, acceptance documents. This is an urgent requirement for our partnering nation; the time to develop, qualify, produce, and ship a new test set would present a significant delay of at least two years in delivery to meet the partnering nation's requirements and result in duplication of costs which the USG estimates to be $720,236. The MTS-206 has already been developed, tested, validated, and produced by Marvin Test Solutions.
Additionally, the level of effort for current repair or estimated future repairs does not warrant pursuit of the necessary technical data or rights to technical data to develop an organic repair, or allow for competitive acquisition without a qualification of sources. The services required by the FMS country is for repair of an existing test set and no development or production is required as part of this effort. Due to the FMS packaging, the USAF retains obligations under that agreement to include repair of FMS purchased assets. Outside of the single FMS package, Marvin Test Solutions has sold the MTS-206 through Direct Commercial Sales and provided long-term support for those sales with engineering, calibration services, training, spares and repairs.
Section D: Efforts to Obtain Competition
Market research was performed and documented in a Market Research Report on 22 July 15 to identify company(s) that can provide required repairs of the MTS-206 which is a portable test set for the AGM-65 Maverick Missile System used by foreign militaries.
