I. Contracting Activity.

II. Nature and/or description of the action being processed.

New Contract, Contract Number / MFT S24-061 ApexAda SW MX, Sole Source vendor.

III. Description of supplies/services required to meet agency needs.

76 SWEG is requesting the purchase of ApexAda with the following specifications:

· Thirty-three (33) MNT-DAEBE5340F-T2: ApexAda Embedded Base V4.2 for Solaris/SPARC Targeting ApexAda Exec/MIPS.

· Five (5) MNT-DANEE5000F-T2: ApexAda Enterprise V4.4 for Solaris/SPARC.

· One (1) Base Year + 2 Option Years

IV. Statutory authority permitting other than full and open competition.

6.302.1 - 10 U.S.C 3204(a)(1) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Apex Provides the compiler that can run on the specific model of processor that is part of the E-3 AWACS Weapon radar system, and is used to build Software for the E-3 Surveillance radar. The ApexAda Software that has already been purchased and currently in use is required to develop the E-3 AWACS Weapon Systems Radar Software. By renewing the license agreement with PTC ApexAda software will allow 558th Software Engineers the ability to analyze, test, develop, and maintain AWACS Radar Programs. Floating licenses provide Ada, C, C++, assembly compilers, source editors, debuggers, disassemblers, and code analyzers. E-3 radar is a multiprocessor environment requiring licenses to debug radar systems APY-1 & APY-2. PTC is the original equipment manufacturer and sole distributor for the requested requirements, ApexAda. PTC retains all data rights for this software requirement.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

CONTRACTING OFFICER RESPONSE.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

In accordance DAFMAN 17-1203, mandatory use buying programs were researched in order of precedence. This effort was performed to identify companies that could provide ApexAda Software Renewal.

1. This requirement is not found on the mandatory ESI Website.

2. GSA2GIT RFQ # 1681962 was issued to 1015 vendors using (NAICS) code 511210, Federal Supply Code (FSC) (7B22) and resulted in Ten (10) responses with no interest and zero (0) capable responses to the GSA RFQ.

3. Nasa SEWP RFQ #300744 was issued 128 vendors resulting in Zero (0) responses to the NASA

SWEP RFI.

4. In review of the above and the letter dated 2024 it is determined the Original Equipment Manufacturer (OEM) is only one source that can provide this commodity for this acquisition.

5. The Independent Government Estimate (IGE) is based on the ROM received from the sole source

(OEM).

IX. Any other facts supporting the use of Other Than Full and Open Competition.
