I. Contracting Activity.

II. Nature and/or description of the action being processed.
This Individual Justification and Approval (J&A) authorizes use of other than full and open competition procedures to procure:
Quantity: One (1) Coordinate Measuring Machine and support equipment
The resulting New Contract is sole source, requirements type, negotiated action for a commodity with associated services.
Commercial Commodity, Contract Type: Firm-Fixed Price (FFP). This effort is not a Bridge Action.
The Contractor shall supply, install, and train on one (1) Coordinate Measuring Machine. The Contractor shall ensure the items are in full operational capacity.

Estimated Award Date of Contract: 1 December 2018
Acquisition History: This is a replacement requirement for current Zeiss Prismo CMM that has obsolete equipment.
III. Description of supplies/services required to meet agency needs.
Under the supply contract, the Contractor shall furnish, ship, install, assemble and verify and calibrate:
One (1) Coordinate Measuring Machine in accordance with the manufacturers equipment specifications and the applicable Statement of Work (SOW)

FUNDING: The funding source for the resulting contract is through the Capital Investment Fund (CIP) (97X4930)
IV. Statutory authority permitting Other than Full and Open Competition.
The authority for this action is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(A) "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements".

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Only One Responsible Source (FAR 6.302-1(a)(2). Carl Zeiss IMT is the only known manufacturer of a Coordinate Measuring Machine with the specifications required by the government. This equipment/source is the only known system that can utilize the existing adapter plates, special stylus systems, the Zeiss VAST XT scanning head, the Zeiss LineScan Laser Scanning System, and the Zeiss DotScan Vision System which are currently utilized in the lab with other existing Zeiss CMMs.
Market research was conducted and it was found that Carl Zeiss IMT is the only source that can meet all requirements, which are proprietary to them. Results from the Sources Sought Synopsis indicate that Carl Zeiss IMT is the only contractor that can meet the requirements required by the Government.
The Engineer at 76 MXSS/MXDTAD believes that award to any other source would result in unacceptable delays in fulfilling the Air Force requirements herein. No other contractor can meet the requirement, therefore a contractor would need to develop a machine that meets the Governments requirements.
Accordingly, Carl Zeiss IMT is the only firm capable of providing the supplies described in section III above without the US Air Force experiencing unacceptable delays in fulfilling its requirements.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Sources Sought Synopsis (SSS) and was posted onto Federal Business Opportunities (FedBizOpps) on 27 Jun 2018 with a response date of 12 Jul 2018. The synopsis number was FA8126-18-R-0010. The purpose was to identify sources capable of supplying a Coordinate Measuring Machine that satisfied the Governments requirements as described in the Statement of Work.
Two (2) Contractors responded to the SSS:

Cage Code: 1WUK4 250 Circuit Dr North Kingstown RI 02852-7441
The responsible Engineer determined that only Carl Zeiss was capable of meeting the Governments requirement.
In accordance with (IAW) FAR 5.201 this proposed contract action will be synopsized and the solicitation will be posted in FedBizOpps.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government and Contractor. Being a commercial item, Certified Cost and Pricing Data cannot be requested, however, Other than Certified Cost and Pricing Data and redacted invoices of similar Coordinate Measuring Machine provided at other installations or places of business will be used for comparison purposes. Price reasonableness will be determined using price analysis IAW FAR 15.404-1(b), and supported by a technical evaluation and analysis by the Subject Matter Expert (SME).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
In accordance with (IAW) FAR 10.001(a)(2) and (3), market research was conducted between 1 May 2018 and 12 Jul 2018 through historical data and current market research results, concluded that this equipment is commercial in nature. Based on the research of contractors listed in prior market research on historical contracts, along with conducting new searches for vendors that could have possibly entered the industry, only one source was found to have the capabilities, technology and expertise to fulfill this requirement adequately.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
No further information at this time.

Hexagon was determined to be not capable of meeting the Government's requirements in the SOW.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Based upon proprietary OEM rights and the complex nature and sophistication of the equipment required to support the mission, we are unable to remove or overcome the resulting barriers to competition.
