SUBJECT: Single Source Justification for Serv M19-090 Durascan 70 Hardness Testers

1. 76 MXSG requested Preventative Maintenance and Calibration Service Contract for the Durascan 70 Hardness Testers.

2. Both, Durascan 70 Hardness Testers requires Annual PM’s and Calibration. The calibration is required by T.O’s F100 2-1-111, F108, GE F101, F118, F110-3 and F110-13. Due to the original equipment manufacturer, Struers Inc. having proprietary data rights to their software and the capability to provide a more in depth calibration that includes software and hardware, it is deemed that this be a Sole Source requirement.

3. After market research was conducted, it was determined that there is only one company, the original equipment manufacturer (OEM) Struers, Inc, which meets the requirements of this contract. Data rights to the software are proprietary in nature to the OEM. An inquiry was submitted to Struers, Inc. requesting if they would sell their rights to the Government. Struers, Inc. declined to sell their data rights.

4. Market research was performed reviewing Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code (811310) looking for companies that could provide preventative maintenance and calibration for the Durascan 70 Hardness Tester. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide preventative maintenance and calibration for the Durascan 70 Hardness Tester.

5. In the future, the Government will conduct market research to determine if Struers, Inc. has any distributors that are able to completely service the Durascan 70 Hardness testers or if they are willing to sell the software data rights to the Government.

6. (CONTRACTING OFFICER DETERMINATION) I have determined, in accordance with FAR 13, that the circumstances of this contract action deem only a single source is reasonably available.
