Single Source Justification (Simplified Acquisition)

Section A: General Contract Information

Contracting Activity: AFSC/PZIMB

Project/Program Name: Fisher FTIR

Purchase Request/Identification Number: F3YCEB6188A002

Section B: Description of the Supplies/Services Required

76 MXSG requests preventative maintenance (PM) and over and above (O&A) on the Fisher FTIR Microscope and Spectrometer. The FTIR is used in the analysis of organic materials and analysis of gases. These instruments require periodic maintenance and verification of the optical bench and microscope to insure accuracy of results.

Section C: Justification for Soliciting from a Single Source

Market Research was conducted and it was determined after searching known markets that there is only one company, Thermo Electron North America, LLC , which can meet the requirements of this contract. Thermo Electron North America, LLC is the original equipment manufacturer (OEM) and retains proprietary data rights to the software for this equipment. Fisher FTIR systems are commercial items that the government has requested the data rights but the OEM will not sell them.

Section D: Efforts to Obtain Competition

Based on the Market Research conducted, the data use rights nature of the software and diagnostic techniques, it is in the best interest of the Government to use a Sole Source Contract to the OEM (Thermo Electron North America, LLC). Reached out to three (3) known market vendors all unable to meet the requirement: Eles Corporation, Carl Zeiss Microscopy, and Prescott's.

Section E: Steps to Preclude Future Single Source Awards

The government will continue to research the market for another acceptable vendor. We will also address the situation to engineering to see if they can provide another means to repair the Fisher FTIR systems in the future. As of now, Thermo Electron North America, LLC have all the data rights for these commercial items and will not sell for government use rights.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
