III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

76 SMXG, 555 SMXS/MXDEF has been providing the Common Engine Transfer System

(CETS) to their customer for almost 10 years. The Southwest Electronic Energy (SWE)

Corporation specially designed the battery and battery charger for CETS upon its inception.

These items have numerous special requirements such as size, shape, weight, voltage requirements, and protective circuitry that were designed by SWE for CETS. SWE owns the proprietary rights to the battery and battery charger for CETS, and is the only source who can deliver these required, mandatory, specially configured items for CETS. 555 SMXS/MXDEF have been procuring these specific items from SWE as needed since 2005 on sole-source contracts.

Under the contemplated contract, Southwest Electronic Energy Group (SWE) will provide the following supplies in sustainment of the Common Engine Transfer System (CETS) program:

(1) Supply and deliver approximately 50 to 150 CETS batteries each year of this contract. If all option years are exercised, the period of performance of this effort will be from February

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

Southwest Electronic Energy Corp. is the manufacturer and has no distributors. This item has numerous special requirements such as size, shape, weight, voltage requirements, and protective circuitry that were designed by SWE for 555

SMXS/MXDEF. Therefore, SWE owns the proprietary rights to this item. MXDEF has found no other company who can configure this item to the required configuration. These CETS batteries and battery chargers are required to begin assembly of CETS. It is not possible to solicit, evaluate, and determine the technical effectiveness and reliability required to meet the customers’ performance standard and need within a timely manner from soliciting offers from other sources at this time.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

With the assistance of the Requiring Activity, the cost of the acquisition will be deemed as fair and reasonable by the Contracting Officer.

Price reasonableness will be based on the contractor’s commercial proposal and the Requiring

Activity’s acknowledgement that the pricing is fair and reasonable based on their expertise of the required material.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

There is only one responsible and reliable source for these required items. SWE is the sole distributor of this item. Therefore, basic market research was conducted for the procurement of these items.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

This procurement is not for new development. This requirement is to sustainment a fully fielded system. Thus, It is not possible to solicit, evaluate, and determine the technical effectiveness and reliability required to meet the customers’ performance standard and need within a timely manner from soliciting offers from other sources at this time. FAR 6.302-
