Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

II. Nature and/or description of the action being processed.
System Program Office (SPO) Engineering is requiring that Program Depot Maintenance (PDM) maintenance be required to use load cells if they intend to remove two or more concurrent splice plates or more than one milk bottle at a time. In order to keep the flow days at the required amount, PDM must concurrently work the tasks. Without the requested additional load cells, SPO will not authorize concurrent work.
III. Description of supplies/services required to meet agency needs.
The 76 AMXG is requesting utilization of funds for the 565 B52 Intercomp Load Cell Purchase.
The requested equipment specifications are outlined below.
A. 132 each 1” Diameter Stud (Part Number 140022) B. 66 each 50k-lb Load Cells (Part Number 100277) C. 66 each 10k-lb Load Cells (Part Number 100275) D. Six (6) each AC100 CPU (Part Number 140669) E. 132 each Load Cell Radio Adapters (Part Number 140658)
All equipment must be interoperable with the existing Intercomp AC100 CPU (part number 140669) currently in use by the AMXG System Program Office to allow concurrent work.
IV. Statutory authority permitting other than full and open competition.
6.302-1(c)(1), as modified to reflect the procedures at FAR 13.501(a) in accordance with 41 USC 1901
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
All equipment must be inter-operable with the existing Intercomp AC100 CPU (part number 140669) currently in use by the AMXG System Program Office to allow concurrent work. Intercomp is the only brand that can supply the products that will be interchangeable with the current Intercomp Load Cell kits. Intercomp does not utilize distributors. OEM (Intercomp) will only sell to the end user. The OEM is the only responsible source available for the B52 Load Cell procurement due to proprietary data and interoperability issues.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market research was conducted via the Internet, telephone calls and emails to 4 companies who manufacture, maintain, or sell load cells. All companies including the OEM, Intercomp Corp. stated that the OEM did not utilize distributors or resellers and the OEM only provided the equipment to the end users.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure that the items identified are procured at fair and reasonable prices to the Government. The contract will be awarded IAW FAR Part 12, 13.5, and 15. Price analysis will be conducted based on comparison to previous procurement of same/similar supplies/commodities procured by the Government.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research for this requirement began with a search performed on the Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code 333997 along with the terms “load” and “cell”. Three (3) vendors from DSBS were returned in the results. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide products that would integrate with the existing government-owned Intercomp products to allow concurrent work on the aircraft and meet the required flow days for the depot repair. An Internet search was performed for products meeting the specifications for this requirement. After speaking with the Intercomp POC, Erik Larson, it was determined, that Intercomp is the only brand that can supply the products that will be interchangeable with the current Intercomp Load Cell kits. Intercomp does not utilize distributors. Received a response from a IWCS Scale LLC, a small business, that stated that there are restrictions on the requested part numbers and the OEM (Intercomp) will only sell to the end user. The products specified for this requirement are available from the OEM, Intercomp, on the GSA website. In summary, there is only one responsible source that can provide this requirement to the government.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The government will continue to monitor the market and research companies that would be capable of providing products that would be interchangeable with the Intercomp CPU equipment currently in use.
