I. Contracting Activity.

This justification for other than full and open competition is to support the 76 CMXG Tube and Cable Shop . The contracting office to support this procurement is Air Force Material Command, AFSC/PZIMA, located at 3001 Staff Drive 2S76, Tinker AFB, OK 73145.

II. Nature and/or description of the action being processed.

This acquisition will be a commercial, one-time, sole source, firm-fixed price purchase. This is a new contract action to acquire a tube bending machine to manufacture aircraft tubing assemblies. This machine will replace the existing end-of life tube bending machine.

III. Description of supplies/services required to meet agency needs.

One (1) Pines CNC 040 Hydraulic Tube Bending Machine with the following Capabilities/Specifications:

Machine shall work in conjunction with the existing tooling in the Tube and Cable shop Swing Away Wiper Die Holder Direct Acting Stationary Arm Fan Cooled Heat Exchanger Safety Laser Scanner TS Control to communicate with Multi-System MM600

Turnkey Installation required: Installation expense includes delivery of machine to site (FOB: Destination);

Removal of machine from shipping truck (using Riggers); placement of machine in plant; leveling, mounting of machine to floor; connect to existing electrical mains and shop air supply. Installation task shall not exceed 10 days.

Total value of supplies is estimated $242,855.00, with delivery to be 22 weeks after order.

IV. Statutory authority permitting Other than Full and Open Competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1)(or 10 USC

2304(c) (1)) as implemented by the Federal Acquisition Regulation (FAR) Subpart 13.501(a) entitled "Sole source (including brand name) acquisitions."

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The Tube Bending Machine must meet the following key requirements:

• Swing away wiper die holder. The swing away wiper die holder is a Pines'-patented design feature both a safety feature and a design feature that automatically pivots the wiper die out of the way when the tube carriage must approach the bend die.

Maintaining close and precise contact of the wiper die tip is critical to bend quality, and decreases manufacturing time, labor and scrap material required by other methods. Thus, the Swing Away Wiper Die option is critical to the use of the Tube Bender machine at Tinker Air Force Base.)

• Machine shall work in conjunction with the existing tooling in the Tube & Cable shop. The Tube Bending Machine must operate with the shops existing inventory of (estimated) 1,000 pieces of tooling (bend dies, wiper dies, inserts, etc.) of various sizes to accommodate various raw materials (Aluminum, Stainless Steel, Titanium, Inconel, Nickel) for bending.

The Tinker AFB SME has noted that the use of Pines' tooling on a non-Pine's machine has resulted in damaged and unusable tooling. This is due, in part, to the different, and sometimes proprietary mounting methods for dies and inserts in the tube bending machines. The use of non-manufacturer specific tooling requires adapters which can compromise the safety factors of the machine, resulting in lower quality bends and greater scrap (unusable products) or damaged dies and inserts.

Market research (see discussion in Section VIII) determined that the Pines' CNC 040 Tube Bending Machine is the only

Updated: 15 Mar 16 Page 3 of 4 product that meets both key requirements. After searching known markets, it was confirmed that CNC 040 Tube Bending Machines are only sold/distributed through Pines Engineering, a division of Ajax Tocco Magnethermic Corporation.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The Sources Sought Synopsis was posted to FedBizOpps for public review/response for 14 days and received multiple responses, of which only Pines' Engineering response met all of the technical criteria.

The commercial solicitation requirement will be posted to FedBizOpps for public review and appropriate response IAW FAR 5.203.

The Government will continue to monitor the market to determine if Pines Engineering will allow authorized distributors for CNC 040 Tube Bending Machine requirements in the future.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will perform price analysis to ensure the prices for items identified for procurement are fair and reasonable to both the Government and the contractor.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

IAW Far 10.001(a)(2), market research has revealed these items are commercial as defined in FAR 2.101.

Methods used to complete the Market Research were previous similar contracts for this product, a Dynamic Small Business Search defined by NAICS Code 333514, telephone calls, Internet searches, GSA Advantage, and Subject Matter Expert (SME) historical knowledge, as well as a publicly published Sources Sought Synopsis.

The Market Research determined there are other types of tube bending machines used across the Aerospace Industry.

A Sources Sought Synopsis (FA8125-16-Q-0087) was issued from 19 Aug 2016 - 2 Sep 2016 for a tube bender machine to determine if other tube bending machines were available to meet the performance requirements as described in Section III.

Additionally, vendors were asked to describe 3 past experiences with previous projects similar in complexity to the requirement and asked to discuss if their product worked with the existing tooling inventory (sample tooling inventory was included in Sources Sought Synopsis), and what modifications - if any - would be required to ensure their product was inter-operable with the existing tooling inventory.

The Item Description published within the Sources Sought notice identified multiple requirements, including two that are essential to provide quality end products: 1) inter-operate with the existing (approx.) 1,000 pieces of tooling inventory currently owned by the Tinker AFB 76th CMXG Tube and Cable Shop and 2) provide the required Swing Away Wiper Die.

Three firms responded to the Sources Sought Request. The only firm that identified a Swing-Away Wiper Die option was Pines Engineering. Additionally, while the other 2 firms asserted that the provided solutions would inter-operate with the existing tooling, neither offered evidence of previous ability to inter-operate with custom tooling, or plans to ensure the tooling was usable without additional adaptations to the tube bending machine or existing tooling.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

After searching known markets, it was confirmed via phone call and email with Pines Engineering Sales Manager, Pines Engineering is the sole Authorized Distributor of the CNC 040 Tube Bending Machine.

Current in-house maintenance support personnel are trained, certified and proficient in the maintenance and repair of the Pines machine. Procuring a different tube bender machine by a different manufacturer will incur additional costs and time in training of personnel.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The Government will continue to monitor the market to determine if Pines Engineering allows authorized distributors for CNC 040 Tube Bending Machine requirements in the future.

The Government will review future requirements and perform additional surveys to determine new supply sources for future efforts. Future requirements will be advertised with a sources-sought synopsis.
