I. Contracting Activity.

AFSC/PZIMA, supporting the 566 AMXS/MXDVA submits this Justification for Other Than Full and Open Competition on contracting action for B&B Tritech Brand 9095N at an estimated total cost of .

II. Nature and/or description of the action being processed.

This is a Sole Source Justification and Approval (J&A) authorizing use of Other Than Full and Open Competition to procure two hundred-forty (240) 50 gallon drums for B&B Tritech 9095N peroxide activated paint remover to support the Navy C-130 Aircraft De-paint workload Programmed Depot Maintenance (PDM) production line.

The resulting new firm-fixed price contract will be awarded to support the 566 AMXS/MXDVA PDM in the 76 AMXG. This peroxide activated paint remover will be used to remove aircraft paint from the exterior of Navy C-130s.

III. Description of supplies/services required to meet agency needs.

The two hundred-forty (240) 50 gallon drums for B&B Tritech 9095N peroxide activated paint remover in staggered shipments must be provided by B&B Tritech for the cleaning of the exterior of Navy C-130s per the governing authority and QPL for the Navy PDM process.

IV. Statutory authority permitting Other than Full and Open Competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1)(or 10 USC 2304(c) (1)) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The governing authority for C-130 Local Engineering Specification (LES) Identification Number: CP62-06-RR-1053, Amendment 2, Dated 15 Dec. 2011, specifies the use of peroxide activated paint removers for use on C-130 aircraft exteriors.

It then states "Based on available test data and successful usage history . . . B&B 9095 paint remover is considered an acceptable alternative for use on C-130 aircraft as specified by procedures in the base document." In the concluding instructions, the C-130 LES CP62-06-RR-1053, Amendment 2 directs "Utilize B&B 9095 paint remover in accordance with procedures detailed in LES CP62-06-RR-1053 as an alternative to Turco 6881 paint remover."

(Turco 6881 cannot be disposed of properly without endangering or damaging the waste-water management system of the site in the quantities required by the C-130 workload.)

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The procured product must be listed on the QPL and be in compliance with the governing authority LES CP62-06-RR-1053, Amendment 2. The only such product is B&B 9095 paint remover. No substitute materials are acceptable. The only source for this product is the manufacturer B&B Tritech as described in section X below.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer, through price analysis, will determine prices fair and reasonable to the government. The Contracting Officer will assure the commodity acquired is negotiated at a price that is fair and reasonable to both parties.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

The Program Management Specialist conducted market research by email, websites, and telephone calls (23 May 2016).

Based on the responses of known licensed paint stripper/chemical resellers and talking with B&B Tritech Inc, a determination was made that a) the product is a commercial purchase and b) sources other than B&B Tritech Inc. do not have the ability to sell B&B 9095N aircraft paint stripper. On 23 May 2016, B&B Tritech Inc. was contacted directly. The result of the conversation was a confirmation that B&B Tritech is the sole distributor and that they will not allow the sale of their product and/or data rights.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Unnecessary delays or failure to procure this material could cause work delays to the aircraft PDM production line.

X. List of sources, if any, that expressed interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

In an effort to identity and remove barriers to competition, the Government will continue to monitor the marketplace for source development and continue discussions with B&B Tritech Inc. regarding additional approved sources. However, until other vendors can become qualified to the aforementioned standards and provide approved products, no further actions may be taken.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
