Section C: Justification for Soliciting from a Single Source

The justification for the single source is as follows:

Market Research indicates that other vendors are interested, however Leco Corporation is the only source that has access to the proprietary data necessary to accomplish this task. They have no intent to make their technical data available to government or commercial entities. The Government has no intention of spending to procure replacement systems. Minimal remedial maintenance has been performed on the Leco OHN836 or the Leco CS844. These pieces of equipment are used for the chemical analysis of metals and other materials used in aircraft and jet engines managed here at Tinker AFB. The data collected is used to support the warfighter.

Section D: Efforts to Obtain Competition

Review of previous contracts, Internet (Google) and FBO searches were performed to see who might be able to provide PM Services. The Program Manager was unable to find anyone other than Leco that could provide the specific required services that meets the governments needs. Leco owns the proprietary data rights to this equipment.

Section E: Steps to Preclude Future Single Source Awards

We will continue to monitor Leco to see if they implement distributorship's. We will also continue doing Independent Government Estimates to determine if a complete change out of all Leco equipment may be economically feasible in the future.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
