SUPPLIES OR SERVICES AND PRICES/COSTS
The government plans to award a contract for the supplies or services specified in the schedule. A firm-fixed price contract is contemplated. The production quantities set forth for each contract line item (CLIN) are stated as the minimum, medium and maximum quantities. Only one of the quantities will be awarded based on the need of the Government at the time of award.
Surplus Note to Contractor: Subject Parts are deemed acceptable for procurement under the following conditions:
1) Parts must be new and in original condition and container unopened. 2) Government surplus material must have original contract number, part number, NSN, CAGE code and date of acceptance clearly marked and legible from initial manufacturer. 3) Vendor must show where and when parts were obtained as surplus. 4) Original manufacturer of offered parts must be an approved source. No item will be accepted with damaged or altered packaging and/or if it does not meet the aforementioned criteria for acceptance. All assets that do not comply with engineering source approval criteria will be returned to vendor as unacceptable at no cost to the Government.
Should an award be made to a source that is not surplus these provisions in the contract will be removed. Should a surplus item be awardable in partial quantities there may be a split award between new and surplus items.

(a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(b) The Contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.
(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) (1) Use of funds appropriated (or otherwise made available) by the Continuing Appropriations Act, 2016 (Pub. L. 114-53) or any other FY 2016 appropriations act that extends to FY 2016 funds the same prohibitions as contained in sections 743 of division E, title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.
(2) The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.

(a) Invoice payments—
(5) Computing penalty amount. The Government will compute the interest penalty in accordance with the Office of Management and Budget prompt payment regulations at 5 CFR part 1315.
(i) For the sole purpose of computing an interest penalty that might be due the Contractor, Government acceptance is deemed to occur constructively on the **** day (unless otherwise specified in this contract) after the Contractor delivers the supplies or performs the services in accordance with the terms and conditions of the contract, unless there is a disagreement over quantity, quality, or Contractor compliance with a contract provision. If actual acceptance occurs within the constructive acceptance period, the Government will base the determination of an interest penalty on the actual date of acceptance. L-01 PROPOSAL PREPARATION INSTRUCTIONS
A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit cost data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
C. Specific Instructions:
1. PRICE PROPOSAL - Submit original
(a) Complete blocks 12, 14, 13, 15, and 27 of the RFP Section A, SF1447. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These sections constitute the model contract.

(c) Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in.
(d) If applicable, provide a copy of the letter from the Small Business Administration (SBA) showing proof of Section 8(a) status.
2. TECHNICAL PROPOSAL – Fill in unit prices and total amounts in Section B.
(a) Technical- Complete Proposal Package: The offeror shall submit a proposal that contains the completed model contract and any applicable documents. Section B shall be filled in with unit prices and extended prices. Offer shall contain a delivery schedule for all proposed quantities. All applicable clauses shall be filled in with the appropriate data, unless included in a relevant Basic Ordering Agreement (BOA).
D. Documents submitted in response to this RFP must be fully responsive to and consistent with the following:
1. Requirements of the RFP and government standards and regulations.
2. Evaluation Factors for Award in Section M of this RFP.

SECTION M
EVALUATION FACTORS FOR AWARD
EVALUATION CRITERIA FOR AWARD (OCT 1997)
(IAW FAR 13.106-2(b), FAR 14.201-5(c), FAR 15.204-5(c))
M001 SOURCE SELECTION
a. Basis for Contract Award This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures, Appendix A, 04 March 2011 and Air Force Mandatory Procedures 5315.3 04 May 2011. These regulations are available electronically at the Air Force (AF) FARSite, http://farsite.hill.af.mil. The Government will select the proposal with the lowest evaluated price from among those meeting the acceptability standards for non-price factors. Contract(s) may be awarded to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and is judged, based on the evaluation factors, to represent the lowest price technically acceptable proposal. While the Government will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
b. Number of Contracts to be Awarded The Government intends to award up to 1 contract for the F101 Turbine Blade Damper spares acquisition.
The Government will eliminate any competitive advantage resulting from an offeror's proposed use of Government-furnished property (GFP).
c. Discussions If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.
d. Solicitation Requirements, Terms and Conditions Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award.
Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
M002 EVALUATION FACTORS
a. Evaluation Factors The following evaluation factor will be used to evaluate each proposal. The Government will evaluate proposals for acceptability, but will not rank the proposals by the non-price factors.

b. Technical Factor The Government’s technical evaluation team shall evaluate the technical proposals on an acceptable or unacceptable basis, assigning one of the ratings described below. If the technical factor is evaluated as “Unacceptable” it will render the entire proposal unacceptable and, therefore, unawardable. Only those proposals determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

The proposals shall be evaluated against the following technical factor:
Factor 1: Complete Proposal Package Description: This factor evaluates the offeror’s proposal package for completeness and comprehension of the requirement and capability to perform.
Measure of Merit: This requirement is met when the offeror’s proposal provides both unit pricing and extended pricing, contains delivery schedule for all proposed quantities, and provides information required by the clauses with a low to moderate risk of unsuccessful contract performance .
c. Price Factor Offerors whose price is determined to be unreasonable, unbalanced, or unaffordable may not be considered for award.
(1) The offeror’s Price proposal will be evaluated by developing the Total Evaluated Price (TEP) where the unit price on each line item will be multiplied by the quantity to equal the extended prices, and then added together. The technically acceptable proposals will be ranked from lowest to highest.
(2) Reasonableness: The offeror’s Price proposal will be evaluated to ensure it is fair and reasonable, pursuant to FAR 15.404.
