JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

The B-2 has an urgent requirement for Five (5) AN/PLM-4 High Power Radar Signal Simulator (RSS) testers. Currently the USAF' only B-2 WG is not able to verify system operation efficiently for the non-self-radiating antenna array known as Band 4. This contract procurement effort is needed to acquire Radar Signal Simulators (RSS) AN/PLM-4 for the 509 Bomb Wing to be able to operational check and troubleshoot aircraft systems. This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm-fixed price, fixed-quantity, non-commercial, sole source contract. The acquisition is not a bridge contract as defined in the AF Bridge Action Reduction Plan. The estimated value of this procurement contract will be with an estimated award date of Dec 18.

The contemplated “C’ type contract will be with Harris Corporation, Commercial and Government Entity (CAGE) code 91417, for the manufacture of the High Power Radar Signal Simulator with an anticipated delivery date of 180 days after contract award. This individual J&A is to support the rationale that only one responsible source exists and no other supplies will satisfy agency requirements.

One asset was purchased by the SPO and not 424 SCMS for test and evaluation in the field, this procurement will be the second purchase of this item by the Air Force but the initial 424 SCMS purchase.

This items function is to provide: The Radar Signal Simulator (RSS) AN/PLM-4 is a user programmable, lightweight, highly mobile test set that generates pulse and scan modulated Radio Frequency (RF) signals. Using internal antennas, the RSS radiates toward the Electronic Warfare Antennas System Under Test (SUT), allowing the user to evaluate the SUT operation or perform diagnostics and fault isolation.

V. DEMONSTRATION THAT THE CONTRACTORS’ UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

The AN/PLM-4 High Power Radar Signal Simulator (RSS) tester designed by Harris Corporation is the only tester that satisfies all 12 existing Integrated Product support Elements for use on B-2 aircraft. This design was developed through WR-ALC and exceeds all requirements needed for the B-2. One asset was purchased by the SPO for test and evaluation in the field, this is the second purchase of this item by the Air Force.

Harris is the sole owner of the technical data required to fabricate and deliver P/N:

FT0100-6. No other firm has the data and drawings to build the tester that is being requisitioned.

The 424 SCMS believes that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the Air Force’s requirement.

Accordingly, Harris is the only firm capable of providing (the supplies or services) described in section III above without the U.S. Air Force experiencing substantial duplication of cost likely to exceed that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. The software that enables this device to validate threat detection integrates with B-2 Mission Planning software, it’s believed that introducing a newly developed RSS tester from a new supplier would likely result in full integration the and B-2 WSSC. This product design is needed as a flight line support equipment item for B-2 Software Sustainment and aircraft modernization efforts.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

This requirement will be synopsized in http://www.FedBizOpps.govas a notice of proposed contract action IAW FAR 5.201 with an estimated posting date of 12 Sep 18.

A Sources Sought Synopsis was also conducted to notify Harris licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the FedBizOpps website on 02 Apr 18 under the solicitation number FD2030-18-01447-02 with a response date of 03 May 18. All interested sources are listed in section X.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. A detailed price analysis will be performed. The Contracting Officer may request a technical evaluation from the Defense Contract Management Agency (DCMA) to aid in the evaluation of the contractor’s proposal. The Contracting Officer may seek audit assistance from the Defense Contract Audit Agency (DCAA) if necessary.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

In accordance with FAR 10, market research concluded as of 31 Jan 18 for line item, including inquiries of available Air Force data systems, such as the Joint Engineering Data Management Information and Control System (JEDMICS), the Military Engineering Data Asset Locator System, and the Contractor Integrated Technical Information System. The requirement cannot be modified or satisfied with commercial or a modified commercial item. These are non-developmental items. Research indicates that due to the unique application of these items to the B-2 aircraft, no alternate equipment or substitutes that might fill the Government's needs are available. Market research, in accordance with FAR Part 10, was conducted on 16 Mar 18 by inquiry of Parts Manufacturer Approvals, HAYSTACK and a web search of Google and the Thomas Register. This research revealed that there is not a commercial item available to meet this requirement. The item described in Section III will be used in military applications and no commercial or non-developmental substitutes are available.

Other companies that perform similar efforts exist in the marketplace, but they do not possess the applicable technical data/tooling/etc. required to meet the Government’s specifications.

A Sources Sought Synopsis was also conducted, see section VI for more details.

Based on the above, a high level of confidence exists that Harris Corp. is currently the only responsible source able to fulfill the requirements.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

The Government does not have full and unlimited rights to the vendor owned data and drawings for P/N: FT0100-06. Additionally, there is an urgent and compelling need to source and supply these replacement P/N: FT0100-6 testers.

These testers have been backordered for over three calendar years and every day the procurement is delayed our aircrew survivability is put at risk. Access to production level drawings (or repair data, as applicable) is necessary to accomplish the task of building the requisitioned RSS Testers to print.

According to the Market Research performed by the Engineer, the Government requested to purchase Data rights from the original equipment manufacturer. The OEM stated in an email dated 6 Jan 12, that they are not willing to sell data rights to the Government.

The FT0100-6 will provide the correct frequencies and signals to stimulate the B-2 antenna arrays without being altered. To emulate this test capability would mean an average of 5 years for typical R&D and Special Access Program permissions just to attain a prototype. This is a proven capability and the acquisition will not involve Special Program Access to procure new items as the design is set and approved for use on the B-2.

The analysis considered elements including engineering and program management efforts, prototype manufacturing, qualification testing, calculated future buy quantities, and discounts to the unit cost through competitive acquisition. Considering these elements, the results of this analysis showed the payback period in excess of current allowable lead time for this part to prevent mission delay. Qualification of any other source other than Harris Corporation would require full qualification and flight testing via the System Integrator Northrop Grumman.

Data rights are proprietary to Harris Corp. and they are the only qualified source to produce this unit.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

The Government will continue to synopsize future requirements IAW FAR 5.201, rescreen the item, an attempt to acquire the data necessary to qualify additional sources. Prior to contract expiration the 424 SCMS will engage with Harris requesting the sale/licensing of proprietary data, rescreen the items and monitor the market place by posting a sources sought notice to FEDBIZOPS.

There are no previous J&A to review to verify per PGI 206.304(a)(S-70).

The testers requisitioned are fully qualified, urgently needed and are vital to B-2 weapon system sustainment.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

By their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303- 2(c).
