SECTION B
SUPPLIES OR SERVICES AND PRICES/COSTS
All offerors are encouraged to read the entire solicitation. It is of the upmost importance that offeror comply with the requirements set forth in the solicitation and adhere to the instruction of:
Section L: “INSTRUCTIONS, CONDITIONS, AND NOTICES TO RESPONDENTS FOR PROPOSAL PREPARATION USING LOWEST PRICE TECHNICALLY ACCEPTABLE (LPTA) PROCEDURES” and
Section M: “EVALUATION FACTORS FOR AWARD USING LOWEST PRICE TECHNICALLY
ACCEPTABLE (LPTA) PROCEDURES“
A single award contract is contemplated but the Government reserves the right to issue multiple awards if needed or no award at all. Upon award of contract, the initial Delivery Order (DO) will be issued for the minimum quantity of 56 each. If multiple awards are made, any future orders that may be placed will be issued among awardees based on the following criteria:
Quality – Valid Quality Deficiency Reports & Item improvement such as 202s are evaluated Relevant Past Performance – Delivery of final product and system reporting (CAV AF).
Price – Safe, fast delivery and visibility of US Air Force assets is required, the overhaul prices is an important factor when awarding subsequent delivery orders.
As stated in Section B “Initial delivery schedule of 25 each 30 days ARO plus proposed material lead time and subsequent deliveries of 20 each every 30 days. Contractor shall begin production even if all reparables on order have not been received. The contractor is authorized to “Rob-back” subassemblies or parts for installation on another end item to meet delivery requirements.” Contractor shall submit material lead time as a part of their proposal. Material lead time shall be realistic for delivery schedule is very important to the Government. If a contract is awarded, material lead time will be built into delivery schedule.
The Government does not intend to hold discussion but may hold discussion if it is deemed necessary.

Over & Above (O & A) requests shall be reviewed by the cognizant Tinker Engineering Authority in conjunction with the Procurement Contracting Office (PCO). If approved, O & A work will be negotiated by the PCO with assistance from DCMA/DCAA as necessary IAW with DFARS 252.217-7028. At the discretion of the Contracting Officer, the negotiation of approved O&A may be delegated to the DCMA Administrative Contracting Officer on a case by case basis. Items covered in Appendix A (Performance Work Statements (PWS)) , or the Technical Order(s), WILL NOT be candidates for O & A reference paragraph 2.2.2 of the PWS. Offerors shall have taken these issues into consideration when they proposed their unit prices during competition for the basic contract(s)

All wooden lumber, wooden pallets, and wooden containers produced entirely or in part of solid wood packing material (SWPM) shall be constructed from heat-treated (HT) material (HT 56 degrees centigrade or 133 degrees Fahrenheit for 30 minutes). Certification/marking is required by an accredited agency recognized by the American Lumber Standards Committee (ALSC). SHIPMENTS BY FAST TRANSPORTATION (APR 2008)
The Contracting Officer may at any time during performance under this contract/order, by written authorization through the ACO, authorize Fast Transportation for the total contract/order quantity or any portion thereof. The authorization will specify method of transportation to be used and quantity of end items effected. Transportation methods include but are not limited to those discussed in (a) and (b) below.
(a) Transportation for end items on this contract are authorized to ship via air/land utilizing a Government approved carrier.
(b) End Items may be shipped by one of the methods listed below:
(1) Domestic Shipments – Ship overnight/Next Day Service.
(2) International Shipments – Ship via a carrier who can provide door-to-door priority service to include delivery with two to three days and customs clearance to final destination(s).
(c) Foreign Military Sales (FMS) Shipments are excluded from the above procedures.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 15 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

(5) Computing penalty amount. The Government will compute the interest penalty in accordance with the Office of Management and Budget prompt payment regulations at 5 CFR part 1315.
(i) For the sole purpose of computing an interest penalty that might be due the Contractor, Government acceptance is deemed to occur constructively on the 7th day (unless otherwise specified in this contract) after the Contractor delivers the supplies or performs the services in accordance with the terms and conditions of the contract, unless there is a disagreement over quantity, quality, or Contractor compliance with a contract provision. If actual acceptance occurs within the constructive acceptance period, the Government will base the determination of an interest penalty on the actual date of acceptance. The constructive acceptance requirement does not, however, compel Government officials to accept supplies or services, perform contract administration functions, or make payment prior to fulfilling their responsibilities.

(a) Definitions. As used in this clause—
(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.
(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.
(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.
(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. Information regarding WAWF is available on the Internet at https://wawf.eb.mil/ .
(c) The Contractor may submit a payment request and receiving report using other than WAWF only when—
(1) The Contracting Officer authorizes use of another electronic form. With such an authorization, the Contractor and the Contracting Officer shall agree to a plan, which shall include a timeline, specifying when the Contractor will transfer to WAWF;
(2) DoD is unable to receive a payment request or provide acceptance in electronic form;
(3) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment; or
(4) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System).
(d) The Contractor shall submit any non-electronic payment requests using the method or methods specified in Section G of the contract.
(e) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payment requests.
