II. Nature and/or description of the action being processed.
Approval is requested to award a sole source Indefinite-Delivery, Indefinite-Quantity (IDIQ), with a performance period of one
(1) year and eight (8) months, for a total of 20 months. The Contract Line Item Numbers (CLINs) will consist of a mix of both
Firm-Fixed-Price (FFP) for dai ly labor and Cost-Reimbursement (COST, no-fee) for t ravel, materials and spares. This contract will bridge services between the existing contract (FA7037-10-D-0001) and the follow-on contract that will be awarded using
Full and Open competition. The anticipated award date for t he follow-on contract is September 2016, RFP# FA7022-15-R-0006.
The bridge contract will provide for continued operations and maintenance on the two (2) mobile sensors platforms aboard US
Naval vessels, as well as manning of the Mobile Sensors Management Office (MSMO) at Patrick AFB, FL. The period of performance for this bridge effort is 31 October 2015 through 30 October 2016, plus an option to exercise a two (2) month period, and the six (6) month option to extend services. As a Sole Source acquisition to the incumbent contractor, the Bridge contract w ill not require any phase-in period.
Ill. Description of supplies/services required to meet agency needs.
Required services are currently being procured on an IDIQ type cont ract and FFP/Cost Reimbursement CLINs, with the company Raytheon Technical Services Company (RTSC). Under the contemplated contract, RTSC will provide the following services to sustain the Mobile Sensors O&M Program. The Performance Work Statement (PWS) describes work to be performed by RTSC in support of both Mobile Sensor Platforms and the Mobile Sensors Management Office (MSMO) to meet the requirements:
(1) 76,350 - 112,570 man-hours will be acquired for performance based highly specialized technical services performing radar operations and maintenance (O&M ) of the Mobile Sensor Platforms. This range of hours is based on the indeterminate nature of real world taskings and historical data. Radar operat ions are conducted in accordance with (IAW) mission requirements. These requirements vary according to mission objectives, timing of launch activities, and distance to support areas. The mobile sensors consist of two platforms: COBRA KING on board the United States Naval Ship (USNS) Howard 0.
Lorenzen, and GRAY STAR on board the USNS Invincible. This support involves program management, operations, maintenance, logistics, and sustainment engineering of all radar and su pport instrumentat ion, support Regular Overhaul (ROH, i.e., "shipyard") periods every other year with two-week Maintenance Repair Availabilities (MRAs) on or about every 120 calendar days.
(2) Approximately 31,320 man-hours will be acquired for t he cont ractor MSMO to support this effort involving program management, operations, maintenance, logistics, and sustainment engineering of all radar and support instrumentation. All instrumentation systems are requ ired to be in a full mission capable (FMC) status, 24 hours a day, 7 days a week (24/7), unless otherwise directed by the Mobile Sensor Program Offi ce (MSPO). It is the MSPO's plan to alternate the ROH periods for the two systems so that they do not occur in the same ca lendar yea r. All maintenance periods are subject to change based on ops tempo.
These highly specialized services shall include but are not lim ited to the following:
a. Planning for and execution of t he O&M - Organizational maintenance, sustaining engineering to maintain sensor performance specificat ions;
b. Whole Life Engineering, and Life Cycle Logist ics of all radar hardware, software and support equipment - Provide Integrated
Logistics Support (ILS) for the radars, communications; and support equipment on the two vessels and from the Mobile Sensors
Management Office (MSMO) located at Patrick AFB, Florida;
c. Operate, maintain, and sustain the Software Maintenance Management Facility (SMMF) co-located with the MSMO at PAFB, Florida - Analyze system performance data to maintain baseline and support improvements and modifications;
d. Maintain configuration control, and process and implement approved configuration change requests;
e. Provide sustaining engineering for the radars, communications, and support equipment on the two (2) vessels and from the
Mobile Sensors Management Office (MSMO)-Pre-mission planning, mission collection, post-mission processing, mission data distribution, configuration management, documentation management (to include instruction manuals, drawings, etc);
f. Operate the radars, communications, and support equipment on board the two (2) vessels; and
g. Maintain the radars, communications, support equipment, and controlling software on board the two vessels.
It is anticipated that the total contract value of this procurement will be approximately $14,584,088 of FY16 3400 appropriations for a one year bridge contract, $2,547,509 of FY17 3400 appropriations for a 2 month option to exercise (if needed), and $7,342,111.29 of FY17 3400 appropriations for a 6 month option to extend services (if needed) .
IV. Statutory authority permitting Other than Full and Open Competition.
10 U.S.C. 2304(d)(1)(B), as implemented by FAR 6.302-1(a)(2)(iii), "For DoD, NASA, and the Coast Guard, services may be deemed to be available from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in (A) substantial duplication of costs to the government that is not expected to be recovered through competition, or (B) unacceptable delays in fulfilling the agency's requirements."
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The sole source bridge contract is for the continued performance of highly specia lized technical services from the original source and award to any other source would result in unacceptable delays to fulfill AFTAC's mission requirements. The bridge performance includes a base year plus a two month option period, allowing for the necessary time needed to receive Contract Approvals and Authority for the highly-technical evaluations on the 5-year follow-on contract, now anticipated to be awarded by 25 September 2016.
(1) Training to obtain the skills necessary in operating and maintaining the COBRA KING and GRAY STAR radars are not available commercially or through government sources. The GRAY STAR radar was acquired in the mid-90's as a proof of concept technology demonstration by the US Air Force through the Massachusetts Institute of Technology (MIT}. There was only one system built and it was transferred to the USAF with limited documentation. Two of the current Operations and Maintenance (O&M) contractor's employees were on the original team of engineers and have been with the program since inception. These two individuals have performed virtually all of the training for the remaining personnel. The COBRA KING radar acquisition was begun in 2002 with the system being transferred to the USAF in 2014. As part of the acquisition process all of the current O&M contractor's personnel were involved in a one-time factory training given by the original equipment manufactures (OEMs).
Other than the OEM's instructors, these RTSC personnel are the only personnel with this knowledge and training. To assemble and develop the required courses needed to replicate this level of training would take longer than the time available to award this bridge contract.
(2) O&M of these radar systems require an extensive and specialized supply chain along with a qualified reach back capability.
This logistical capability was developed by RTSC over years of research, and required the development of unique professional relationships to ensure timely support. It would take another contractor in excess of six (6) months to establish and set up similar capabilities.
(3) Operating out of foreign ports in support of this contract required RTSC to have established relationships with local and foreign businesses in order to provide timely and adequate goods and services. The time needed to initiate and establish these relationships at the foreign ports utilized by this contract is longer than normally required. The time to establish is longer than the time available to compete, evaluate, and award the bridge contract without a break in service.
(4) The O&M of the communication centers on board the vessels require personnel with security clearances and specialized training. These clearances and training take an extensive amount of time due to required time frames of other government agencies, and is beyond the time frame available for awarding this bridge contract without a break in service. Examples: a) the Single Scope Background Investigation required for special access programs, and b) training for the operation, control, and inventory management of cryptologic devises.
(5) Personnel assigned duties on GRAY STAR in the CENTOM theater are required to have medical clearances that include complete physicals and vaccinations for anthrax and small pox. The anthrax series of vaccinations entail shots at the 6th, 12th, and 18th month mark after the initial shot.
Justification and Approve. )&A) for Other Than Full and Opf ':ompetition
(6) RTSC has the resources needed to continue performing the assigned mission with the lowest risk to the government. Any other contractor will require more time then what is available to become fully mission capable by 31 Oct 2015. Given sufficient time to "phase-in", another contractor could attain the resources needed to accomplish the mission, but the amount of time needed to accomplish this far exceeds the time available to award the bridge contract without a break in service.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
(1) RTSC has provided the services since 1998. The current contract, FA7037-10-D-0001, is a 5-year (base plus four option years) FFP/Cost-Reimbursement contract where RTSC has provided exceptional services as evident by the exercising of contract option periods and survei llance ratings. The acquisition for the current contract was accomplished through open market competition and yet the only proposal submitted was the incumbent, RTSC.
(2) On 23 July, 2014 25AF/ PK (CL-Patrick AFB, FL) posted on FedBizOpps the Sources Sought Synopsis for the follow-on contract, Mobile Sensors O&M, with an anticipated 5-year period of performance period of 31 Oct 2015 - 30 Oct 2021 (FA7037-15-R-MSMO-Ol). Four (4) large busi~esses responded to this posting and were considered capable of performing the Mobile Sensors O&M requirements. The four (4) large businesses were: Lockheed Martin, BAE Systems Inc, Exelis Inc. and Raytheon Technical Services Company, LLC. No small businesses responded to the sources sought synopsis.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated cost of this acquisition will be considered fair and reasonable based on the following methods: cost analysis will be performed and certified cost and pricing data received; a technical evaluation will be performed by the project officer and team who have extensive expertise in the field of environmental analysis, and knowledge of the work to be performed; and, field pricing assistance will be requested from the cognizant Defense Contract Audit Agency {DCAA), if information available in house is inadequate to determine a fair and reasonable price.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted for the follow-on solicitation/contract (RFP# FA7022-15-R-0006). The follow-on contract will be based on full and open competition and is anticipated to be awarded by 26 September 2016. Market research conducted and documented for the follow-on efforts (Market Research Report dated 02 Sep 2014) demonstrate "Limited Sources" and no small businesses capable of performing the Mobile Sensors requirements. The CO has determined that market research conducted on the follow-on contract is recent and applicable to this sole source effort due to any additional market resea rch not adding va lue, therefore new market research will not be performed.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
None
X. List of sources, if any, that expressed interest in the acquisition.
Lockheed Martin, BAE Systems Inc, Exelis Inc. and Raytheon Technical Services Company, LLC.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Mobile Sensors O&M follow-on contract will be solicited as a Request for Proposal using Full and Open competition, utilizing full trade-off source selection procedures IAW FAR Part 15 and MP5315.3, Source Selection, April 2014 Edition.
A 5-year, FFP/CR, IDIQ follow-on contract is in works. The current procurement is pending Business Clearance (CDP #2) with an anticipated RFP release date of late June 2015. In accordance with FAR Part 37.102, performance-based contracting methods will be used to the maximum extent practicable during the acquisition of Mobile Sensors sustainment and enhancement support services. AMIC Det-2 and AFICA Business Clearance will be required prior to the formal re lease of the Request for Proposal. Award will be made to the offeror proposing the combination of factors most advantageous to the Government based upon an integrated assessment of the evaluation factors.
