Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

This justification is executed by the Air Force Medical Operations Office (AFMOA) PMO, Fort Detrick, MD, on behalf of the Lackland Air Force Base Hospital. The contracting agency for this request is 10 CONS/LGCB located at the United States Air Force Academy (USAFA).

II. Nature and/or description of the action being processed.

The action being requested is a name brand acquisition for (2) Olympus Evis Exera III Endoscopic Systems, (4) Evis

Exera III HD Colonoscopes Dual Focus, (2) Evis Exera HD Pediatric Colonoscopes, (4) Evis Exera III HD Dual Focus

Gastroscopes, and (1) Evis Exera II Therapeutic Video Duodenscopes. The Government intends to procure this requirement through other than full and open competition IAW FAR 13.500(a). FAR Parts 12 and 13 procedures will be used and a new firm fixed price contract will be awarded.

A combined synopsis/solicitation will be posted on www.fbo.gov. An opportunity to quote this requirement will be afforded to any company that can provide evidence they can provide the requested product.

III. Description of supplies/services required to meet agency needs.

The proposed action is to acquire (2) Olympus Evis Exera III Endoscopic System, (4) Evis Exera III HD

Colonoscopes Dual Focus, (2) Evis Exera HD Pediatric Colonoscopes, (4) Evis Exera III HD Dual Focus Gastroscopes, and (1) Evis Exera II Therapeutic Video Duodenscopes. List of equipment to be purchased is as follows:

IV. Statutory authority permitting Other than Full and Open Competition.

41 U.S.C. 1901, as implemented by FAR 13.501(a)(1)(ii)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The purchase of additional Olympus products will allow the continued use of older technology and cross compatibility in the use of already owned Medivator reprocessing equipment. Pentax is the only other

Endoscopic manufacturer. Switching to Pentax technology will either require costly modification to current reprocessing equipment or purchase of new reprocessing equipment and render the current inventory of Olympus scopes obsolete.

The Olympus EVIS EXERA III Endoscopy System and endoscopes is the newest technology from Olympus with high definition enhanced Image Quality, NBI (Narrow Band Imaging), Dual Focus, Pre-freeze Function, Wider

Angles, Forward Water Jet connector, RIT (Responsive Insertion Technology), ScopeGuide and one-touch connector capabilities. This system and endoscopes will replace old inventory and enhance patient care.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A sources sought was posted to FedBizOps on 3 March 2016 with a closing date of 10 March 2016. The intent of the sources sought was twofold, first to determine that the conclusion reached from the initial research was correct and indeed Olympus was the only brand that could meet the requirement. In an effort to assist with that determination the sources sought included a list of sixteen salient characteristics that the end user required. No manufacturer outside of Olympus responded indicating that they could provided a comparable product nor where there any responses providing feedback indicating that the salient characteristics limited competition as requested in the sources sought. The second purpose was to identify third party vendors that were capable and authorized to sell the Olympus product line. The posting identified two additional vendors along with the manufacturer that are capable and authorized to sell the product line. The two additional companies were; Alliant health Care, a verified Service-Disabled Veteran-Owned Small Business, and Proaim Americas, a minority-owned small business.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine pricing for the Endoscopic Systems to be fair and reasonable in accordance with FAR 13.106-3. Since more than one response is anticipated, the Contracting Officer will utilize competitive quotations to assist with determining fair and reasonable pricing.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research, in accordance with FAR Part 10, was conducted to the maximum extent practicable, and supports that this is a commercial type commodity sold to the general public. Endoscopic Systems are used by hospitals and clinics across the country and as such the equipment is widely available.

The Endoscopic Systems are not unique to military medical facilities and is not being modified to meet military requirements. Internet searches were conducted and Sources Sought Solicitation was posted to FedBizOps in search for other manufacturers, but no other brand could meet the required qualifications.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

A combined Synopsis/solicitation, along with the Justification and approval Document (J&A), will be posted on FedBizOps and any challenges will be evaluated.

X. List of sources, if any, that expressed interest in the acquisition.

Alliant Health Care, Proaim Americas, and Olympus

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

In this case, every effort was made to allow competition for this purchase. Since Olympus has authorized retailers and they offer the only product that will meet the needs of the government, there is opportunity for competition as a Name brand purchase.
