Response to Questions – 13 April 2016

1. When the government provides the sample bags to the contract awardee, will the bags have to be returned to the government? Can they be disassembled by the contractor?

Yes, the bags will need to returned unaltered. The bags are to be used as a visual aid.

2. When, after the issuance of the award, will sample bags be provided to the contractor? Will the thirty day first article deadline start on the date of the award, or can it start sometime after the contractor receives the sample bags?

The bags will be provided as soon as possible, upon request. The thirty-day first article deadline will start on the effective date of the award.

3. If the government disapproves a first article, what is the time period in which the vendor must resubmit a corrected first article?

If the Government disapproves a first article, the Government has the option to request additional first articles; these should be submitted as soon as possible. If resubmission of first articles causes the contractor to be unable to meet the delivery deadlines, the Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule (ref: 52.209-4, Alt I, pg 16 of solicitation).

4. The contract states that the vendor must supply the government with first articles of each bag within thirty days of the date of the contract. Is the date of the contract the same as the receipt of order? Or, will there be a period of first article production, review, (and potential corrections) that is BEFORE the beginning of 120 day deadline after receipt of order (ARO)? Or, does the first article 30-day deadline and the 120 ARO deadline occur concurrently?

The effective date of the contract is the same as the receipt of order. The first article thirty-day deadline and 120 day delivery date suspense are concurrent.

5. Are the quantities requested in this contract the same as what was requested in the previous contract?

The estimated quantities requested in this contract are similar to what was requested in the previous contract.
