The following have been modified:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award one contract resulting from this solicitation to the responsible or whose conforming to the solicitation is determined to be the lowest price technically acceptable (LPTA) utilizing FAR Parts 12 and 13.
The Government may award without discussions; however, the Government reserves the right to conduct discussions if deemed in the Government’s best interest.
The Evaluation Factors are:
I. Factor 1 - Price
II. Factor 2 - Technical
I. Factor 1 – Price:
All offeror’s proposed price will be determined by multiplying the quantities by the unit price for each Contract Line
Item Number (CLIN) to confirm the extended amount and the total amount. The price evaluation will document the reasonableness and completeness of the total evaluated price. For the purpose of initial evaluation offer’s, the following will be utilized in resolving arithmetic discrepancies as submitted by the offeror.
(i) Obviously misplaced decimal points will be corrected;
(ii) Discrepancy between unit price and extended price, the unit price will govern;
(iii) Apparent errors in extension of unit prices will be corrected;
(iv) Apparent errors in extended prices per CLIN will be corrected.
II. Factor 2 - Technical:
Only those offers determined responsive will be considered for further evaluation. In order to be considered awardable, there must be an “Acceptable” rating in every sub-factor. To receive an Acceptable rating, the offeror must clearly meet the requirements outlined in Solicitation. If the offeror receives an Unacceptable rating, the offeror does not clearly meet the minimum requirements of the Solicitation.
Subfactor 1: Authorized CISCO Channel. The offeror must be part of the CISCO Authorized Sales and
Distribution Channel supply chain. The offeror shall procure the CISCO products, to include any warranties, from an authorized CISCO Channel. The warranty must be fulfilled by CISCO Systems and not through the offeror. The condition of the items must be “New in Box”. Refurbished, recertified, or grey market items are not acceptable.
Sub-Factor 2: Past Performance. Past Performance will be evaluated based on subjective assessment of how well the offeror performed on past recent and relevant work, as outlined in Addendum to FAR Provision 52.212-1. The offeror must receive an Acceptable rating to receive the award. This rating is based upon the offeror provided information, or information obtained from any other sources of past performance information, indicating performance of same or similar requirement. To receive an Acceptable rating based on the offeror’s performance record, the Government must have a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
(i) The Past Performance information may be obtained from the following sources:
(A) Reference List (Please see details in the Addenda to FAR 52.212-1);

(B) The contracting officer’s knowledge of and previous experience with the supply or service being acquired;
(C) Customer surveys, and past performance questionnaire replies;
(D) The Governmentwide Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov; or
(E) Any other reasonable basis (e.g. reviews in relevant websites, databases).
(b) The Government intends to award to the lowest priced, technically acceptable offer. In accordance with 13.106-
2(b)(3), the Government is not required to establish a competitive range, conduct discussions, or scores. Consistent with simplified acquisition procedures, the evaluation process is as follows:
(i) The Government will evaluate all offers for price, ranking the s from lowest to highest total evaluated price.
(ii) Technical: The lowest priced offer will then be evaluated for Technical Acceptability. If the lowest priced offer is “Unacceptable”, the next low or will be evaluated, continuing until an offer with an “Acceptable” technical rating is identified.
(iii) If the lowest priced offer is determined to be “Technically Acceptable”, the evaluation process may stop and the award may be made to that offeror, pending an affirmative price fair and reasonable determination. However, if it is determined to be in the best interest of the government, the government will continue with the evaluation and reserves the right to enter into discussions any time during the evaluation process.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the , shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
