RFQ# F3N0498149A001

This is a combined Synopsis and Solicitation requesting quotes for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

These solicitation documents, clauses and provisions incorporated by full text or by reference are those in effect through FAC 2005-101, effective 20 Jul 2018. North American Industry Classification System Code 315990, PSC/FSC 8415.

Please provide a quote for the items listed below by 15:00 Central European Summer Time (CEST), Tuesday, 11 September 2018. All questions regarding this RFQ are due in writing by 15:00 CEST, Friday, 7 September 2018.

Questions shall be submitted via email to diane.feguer@us.af.mil. The Government has no obligation to answer any questions received after the due date and time.

The result of this RFQ will be a firm-fixed price contract for tactical holsters that meets or exceeds the requirements provided.

Responses will be evaluated on a brand name or equal basis. Currently the standard holster for Security Forces is the Safariland Model 7390 7TS ALS Mid ride Duty Holster with drop leg platform Holster (Part# 7390-450-551 (Right-handed) & 7390-450-552 (Left-handed).

Please provide the following:

Offers shall be submitted in U.S. Dollar ($) or Euro (€). Offers submitted in Euro will be converted to U.S. Dollar using the exchange rate of 0.93 Euro per U.S. Dollar for evaluation purposes to find the lowest offer.

BASIS FOR CONTRACT AWARD: Contractor should quote their lowest and final price. The US Government does not intend to hold discussions, but reserves the right to do so.

52.252-5 AUTHORIZED DEVIATIONS IN PROVISIONS (APR 1984)

(a) The use in this solicitation of any Federal Acquisition Regulation (48 CFR Chapter 1) provision with an authorized deviation is indicated by the addition of “(DEVIATION)” after the date of the provision.

252.229-7001 TAX RELIEF (SEPT 2014) - ALTERNATE I (SEP 2014)

(a) Prices set forth in this contract are exclusive of all taxes and duties from which the United States Government is exempt by virtue of tax agreements between the United States Government and the Contractor's government. The following taxes or duties have been excluded from the contract price:

(b) The Contractor's invoice shall list separately the gross price, amount of tax deducted, and net price charged.

(c) When items manufactured to United States Government specifications are being acquired, the Contractor shall identify the materials or components intended to be imported in order to ensure that relief from import duties is obtained. If the Contractor intends to use imported products from inventories on hand, the price of which includes a factor for import duties, the Contractor shall ensure the United States Government's exemption from these taxes.

The Contractor may obtain a refund of the import duties from its government or request the duty-free import of an amount of supplies or components corresponding to that used from inventory for this contract.

(d) Tax relief will be claimed in Germany pursuant to the provisions of the Agreement Between the United States of America and Germany Concerning Tax Relief to be Accorded by Germany to United States Expenditures in the Interest of Common Defense. The Contractor shall use Abwicklungsschein fuer abgabenbeguenstigte Lieferungen/Leistungen nach dem Offshore Steuerabkommen (Performance Certificate for Tax-Free Deliveries/Performance according to the Offshore Tax Relief Agreement) or other documentary evidence acceptable to the German tax authorities. All purchases made and paid for on a tax-free basis during a 30-day period may be accumulated, totaled, and reported as tax-free.

5352.201-9101 OMBUDSMAN (NOV 2017)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
