Contracting Activity.
USAFE, 700 CONS/LGCB, Kapaun Air Station, Germany
Nature and/or description of the action being processed.
This requirement is for Deutz Model D2011L04i 24V Diesel rewind engine (Serial Number 10691308) and mounting kit. The rewind engine mounting kit includes the following: 24 Volt electrical system, EPA NSE Exemption label, black paint finish, 24 VDC starter, 24 VDC Alternator, 24 VDC Shutdown Solenoid, 24 VDC Glow Plugs, 24 VDC Deutz/Lofa Control Panel (illuminated, without harness), Power Take-Off Clutch (Hsg. Size 4; Clutch size 8S NACD), Engine Wire Harness (USAF Spec with Relay Sockets), Wiring Harness for Lofa Panel Gauge illumination, Exhaust pipe, Guard cooler, Throttle Lever & mounting kit, speed control, Aluminum Vernier throttle cable (75"), Truck valve (lube oil drain) Adaptor (Oil Drain), Timing Control Unit (relay) 24 Volt, Relay (Slave), Lifting eyes (engine), Parts Manual, Operators/ Instruction Manual. The new Deutz Diesel engines and mounting kit are required to complete the 10-year overhauls on all Barrier Arresting Kit (BAK-12) aircraft arresting systems in United States Air Forces Europe (USAFE). While Air Force Civil Engineer Center (AFCEC) has identified Stauffer Diesel (CAGE 4K637) as a potential supplier, any supplier may fulfill the requirement provided the product meets the required technical specifications for the BAK-12.
Description of supplies/services required to meet agency needs.
Per FAR 6.302-5(2)(i) Authorized or Required by Statute which states, " A statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source" and Per DFARS 217.7502 (b) (2), "Replenishment parts must be acquired so as to ensure the safe, dependable, and effective operation of the equipment. Where this assurance is not possible with new sources, competition may be limited to the original manufacturer of the equipment or other sources that have previously manufactured or furnished the parts as long as the action is justified" If the parts are not procured in a timely manner (February 2017), the aircraft arresting systems (AAS) at Aviano AB, Italy will fail to meet its ten-year overhaul interval as defined by T.O. 35E8-2-5-1 paragraph 5.2.
This, in turn, will then force the systems out of service. The aforementioned airfield will not be able to launch or land any fighter aircraft. Aviano AB has 51 F-16 Fighting Falcons permanently assigned to its location which rely upon the aircraft arresting systems. The decommissioning of this airfield poses an undue risk to these permanently assigned fighter aircraft as well as any fighter aircraft destined to Aviano AB as a transient or temporarily assigned fighter asset.
Further, if the BAK-12 systems go out of service, the USAF must close the runway in order to perform an on-site repair and inspection of the existing systems if the overhauled systems are not completed.
Statutory authority permitting Other than Full and Open Competition.
FAR 6.302-1(c)(1)(ii), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Per AFI 32-1043 paragraph 1.4 the “responsibility for item management, engineering, and procurement support is consigned to the appropriate AFLCMC, presently at Warner Robins Air Logistics Center.”
Per an AFLCMC memo, the Deutz Model D2011L04i 24V Diesel rewind engine has been specified as the only approved replacement to the older Wisconsin gas rewind engines for the BAK-12 and MAAS units. Because of the form, fit and function requirements for the BAK-12/MAAS items and the phasing out of lower emission engines, the USAF has pursued and obtained a National Security Exemption to the EPA emissions requirements to be able to purchase the Deutz Tier 4i (Interim) engine. (See the Attached NSE Waiver)
While there may be other engines with the same power output, and/or newer components and features, there are no other known engines with the same footprint, PTO dimensions, capabilities and most importantly, which are EPA waivered. There are very limited requirements for quantities of this engine from the AF and the program office knows of no other users for this engine besides the AF, the AAS OEM, and possibly FMS users. The engine and associated parts has recently been assigned an NSN but it is unknown at this time if all required components will be included with NSN 2815016337017 because there are currently no supply items with NSN 2815016337017 in stock. Due to the need to maintain the USAFE 10 year overhaul schedule for the Aviano AB AAS the engines must arrive no later than February 2017.
Furthermore, ordering the engines at this time using NSN 2815016337017 will give us an unknown product that will not meet the Air Force's time requirement, which would result in the closing of the Airfield at Aviano Air Base due to the operation of uncertified AAS systems.
Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
AFLCMC has identified Stauffer Diesel supplier, Cage Code of 4K637 and Part Number 1849, as a viable source of supply. However, it is possible for another supplier to provide the same engine and mounting kit capable of meeting the same technical specifications.
Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
According to the market research results obtained by 700CONS/LGCB, there are numerous American and German companies that are willing to compete this requirement. Thus, there is a sufficient competition available for this requirement to ensure the competition requirements of the Defense Procurement and Acquisition Policy (DPAP) MEMO of 21 August 2014 are met, and the prices are fair and reasonable.
Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Stauffer Diesel is not the original manufacturer of the Deutz Diesel rewind engine; it is originally manufactured in Germany. While Stauffer has been identified as a viable supplier, other suppliers may be able to meet the technical specifications listed above.
Any other facts supporting the use of Other Than Full and Open Competition.
I have determined, in accordance with FAR 6.302-1(c)(1)(ii), that the circumstances of this contract action deem only a single brand name can satisfy this requirement.
List of sources, if any, that expressed interest in the acquisition.
A number of American as well as German companies expressed their interest in competing this requirement as a result of market research conducted by 700 CONS/LGCB.
A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
435 CTS, along with AFCEC, AFLCMC and DLA, is constantly evaluating new solutions with the intent to broaden our ability to seek a fairer and more open competition environment in the future.
