JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY
CONTRACTING AGENCY: USAFE, 700 CONS, Kapaun Air Station, Germany
ORGANIZATIONAL ACTIVITY RESPONSIBLE FOR THE PROPOSED
CONTRACTING ACTION: 435 CTS, Ramstein AB, Germany
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This requirement is for ESCO Reel Drum Side Plates (NSN 1710-00-438-9231) and Heavy Weight Fairlead Beam Assembly (NSN 1710-01-098-4984). Zodiac Aerospace has several divisions, one of which is the Zodiac Arresting Systems Division. The Zodiac Arresting Systems Division is based in the United States and produces several product lines, including ESCO – “Engineered Arresting Systems Corporation”.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS
Reel Drum Side Plates are a fundamental component of the Tape Reel Assembly on the Barrier Arresting Kit (BAK-12) Aircraft Arresting System. The side plates assure proper stacking of the BAK-12’s nylon tapes when in the battery state. The side plates are supported at the edges by steel rings faced with phenolic pads and positioned by drum ring supports. Due to the force exerted on the side plates during aircraft arrestments, the side plates regularly require replacement during scheduled overhauls.
The Heavy Weight Fairlead Beam assembly provides all parts required for the proper installation of a fairlead beam system to support the Barrier Arresting Kit (BAK-12) Aircraft Arresting System. The fairlead beam assembly, installed adjacent to a runway edge, allows the installation of the BAK-12 systems further from the edge of the runway. The fairlead beams are used to minimize the tape sweep area during aircraft arrestments. During rewind of the purchase tapes after an arrestment, the fairlead beams hold the tape in an upright position making the tape rewind easier and reducing tape wear. Fairlead beam assemblies are required for all permanent BAK-12 installations.
The requested part(s) will be used to overhaul BAK-12 Aircraft Arresting Systems in support of all United States Air Forces in Europe (USAFE) fighter aircraft operations. In accordance with T.O. 35E8-2-5-1, the BAK-12 is the standard aircraft arresting system in the U.S. Air Force and must be installed at any airfield supporting fighter aircraft operations. The BAK-12 system is a mechanical system used to rapidly decelerate a tail hook equipped aircraft in emergency situations.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
41 U.S.C. 1901 (a)(2) as sited in the Federal Acquisition Regulation (FAR) Part 13 this acquisition will be conduct pursuant to FAR Part 13.5 Permanent Authority for Use of Simplified Acquisition Procedures for Certain Commercial Items, to include FAR Part 13.501 (a) sole source (to include brand name) acquisitions.
FAR Part 13.501 (a) Sole source (to include brand name) acquisitions – Brand Name: An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer. IAW FAR 6.303-2 (c)(1) Brand Name: the particular brand name, product, or feature is essential to the Government’s requirements, and market reason indicates other companies similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
If the parts are not procured in a timely manner (June 2015), the aircraft arresting systems at Lajes AB, Portugal, Moron AB, Spain and RAF Lakenheath, UK will fail to meet their 10-year overhaul intervals as defined by T.O. 35E8-2-5-1 paragraph 5.2.
This, in turn, will then force the systems out of service. The aforementioned airfields will not be able to launch or land any fighter aircraft at their installations. Both Lajes AB and Moron AB are used as “fighter drag” landing locations when aircraft transit the Atlantic. Therefore, the decommissioning of either of these airfields poses an undue risk to fighter aircraft conducting transatlantic flights. RAF Lakenheath will not be able to perform its listed mission sets.
Further, if the BAK-12 systems go out of service, the USAF must request and be granted approval from the host nations at Lajes AB, Portugal and Moron AB, Spain to close the runways.
Runway closures will be mandatory in order to perform an on-site repairs and inspections of the existing systems if the overhauled systems are not completed. The host nation approval process generally takes six months or longer to complete. Finally, weather is an additional factor in the installation process. Delaying the current approved installation dates for Lajes AB and Moron AB will jeopardize these installations due to high winds, potentially delaying the installation process and causing the current systems to go out of service.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY
CITED ABOVE (APPLICABILITY OF AUTHORITY)
Per AFI 32-1043 paragraph 1.4 the “responsibility for item management, engineering, and procurement support is consigned to the appropriate AFLCMC, presently at Warner Robins Air Logistics Center.”
Per an AFLCMC memo, signed by Christopher S. Peisher, Aircraft Arresting System Engineer, AFLCMC/WNZEC, the USAF procured the rights to the full data package for the BAK-12 arresting system. Several suppliers have successfully competed, won and supplied a variety of replacement parts for the BAK-12 system. AFLCMC maintains a list of suppliers approved to manufacture component parts in addition to the original manufacturer in WebFLIS.
The Reel Drum Side Plates can be sourced from Lee Precision Machine Shop, Incorporated and R&R Industries, Incorporated, and Engineered Arresting Systems Corporation Zodiac Arresting Systems America. The Fairlead Beam Assembly can be sourced from R&R Industries, Incorporated or Engineered Arresting Systems Corporation Zodiac Arresting Systems America.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
Requirement will only be solicited to non-OEM vendors, as approved by AFLCMC/WNZEC, due to the uniqueness of the requirements. These vendors are listed in WebFLIS for the component parts they are approved to manufacture.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
At this time, the anticipated price to be paid by the US Government will be determined fair and reasonable IAW FAR 13.106-3(a)(2) or FAR 13.106-3(a)(1).

Per a search of WebFLIS website on 1 June 2015 the following two vendors are capable of providing the Fairlead Beam Assembly (NSN 1710010987984). Engineered Arresting Systems Corporation Zodiac Arresting Systems America and R&R Industries LTD INC.
