This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number for this requirement is FA5422-17-Q-0713 and is hereby issued as a Request for Quote (RFQ) using FAR Part 12, Acquisition of Commercial Items. The 724 EABS Contracting Office Air Base 201 Agadez, Niger requires the following item:

Brand name Or Equal, Alaska Structures Small Shelter System Partitions.

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 effective 19 January 2017 and DFARS DPN 20161222 effective 22 December 2016 and AFFARS AFAC 2017-0127 effective 27 January 2017. The North American Industry Classification System code (NAICS) is 314910, with a Small Business Size Standard of 500 Employees. This requirement is being solicited for full and open competition without a set-a-side. All interested parties must quote on all items.

Addendum to FAR 52.212- 1 - Instructions, Conditions, and Notices to Offerors

52.212- 1 INSTRUCTIONS TO OFFERORS- - COMMERCIAL ITEMS

Addendum to 52.212-1(c), Period for Acceptance of Offers. The paragraph is tailored as follows:

“The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers.”

ADDENDA TO 52.212-1, PROPOSAL PREPARATION INSTRUCTIONS

A. To assure timely and equitable evaluation of the proposal, the offeror must follow the instructions contained herein. The proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation. The response shall consist of two parts:

Part I – Price Proposal Part II – Technical Capability.

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit cost data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

C. Specific Instructions:

Offers will first be reviewed by total price from lowest to highest, then technical acceptability. If the lowest priced proposal is deemed technically acceptable, no further evaluation will be conducted and the contract will be awarded.

1. PART I – PRICE PROPOSAL - Submit one electronic copy of the completed Pricing Schedule Worksheet located on page 2 of this RFQ. This pricing shall include delivery within 105 days ARO to Air Base 201 Agadez, Niger Africa. Submit one electronic copy of the completed Vendor information sheet located on page 3 of this RFQ. Electronic copies must be compatible with Microsoft Office programs.

(a) Complete both the unit price and total price blocks. The offeror must fill out and sign page 3 of this RFQ. In doing so, the offeror accedes to the proposed contract terms and conditions as written in the RFQ, with attachments. The RFQ constitutes the model contract that will be created with the Contracting Officer’s acceptance.

(b) Insert proposed unit prices and total price on the Pricing Schedule Worksheet. The extended amount must equal the whole dollar unit price multiplied by the number of units.

The Pricing Worksheet must be completely filled in. The Quote must be for all requested items.

(c) Documents submitted in response to this solicitation must be fully responsive to, and consistent with the following:

1. Requirements of the RFQ (Item Numbers).

2. Evaluation Factors for Award.

2. PART I – TECHNICAL CAPABILITY –

The Technical portion of the proposal shall be assessed as ‘acceptable’ or ‘unacceptable’. The evaluation process will consider the following:

a. The Offeror shall provide responses to the sixteen questions on p.7 of this RFQ. The Offeror's responses will be evaluated to determine its understanding of the requirements and the qualifications to provide the requirement of this RFQ. Information shall be detailed enough to allow the government to make the technically acceptable or unacceptable determination.

1. Is this a brand name quote?

2. What size shelter is the partition system built for?

3. How many rooms does the partition system create?

4. Is this a partition system with framed fabric/canvas/vinyl walls, Or is this system frameless with curtains?

5. What are the wall frames constructed of?

6. What materials are the walls constructed with?

7. Describe how the wall material is held in place?

8. Does this partition system meet the U.S. Berry Amendment?

9. What type of doors are used for each room?

10. What are the dimensions of the doors to each room?

11. What is the height of the partition walls parallel to the center hallway?

12. Where are the air vents located? What size are these vents?

13. Describe the four walls perpendicular to the hallway? How are these walls built accommodate the air plenum?

14. What is the weighted thickness of the wall materials?

15. Describe how the partitions meet the following standards?

16. Is there a warranty?

Addendum to FAR 52.212-2 - Evaluation Factors for Award

52.212- 2 - - Evaluation - - Commercial Items

(a) The Government will award a contract resulting from this RFQ to the responsible offeror whose offer conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Price;

(ii) Technical acceptability of the item offered to meet the Government requirement; technical acceptability will be determined from the offerors responses to the questions on page 7 of this RFQ.

(b) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2:

BASIS FOR CONTRACT AWARD: This is a competitive RFQ that utilizes FAR Part 13, Simplified Acquisition Procedures, and will utilize the lowest price technically acceptable evaluation procedures and fair and reasonable determination. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Offerors, the offeror accedes to the terms of this model contract. Offerors must clearly identify any exception to the RFQ terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

A. Price Evaluation. Initially, offers will be ranked according to price. An offeror’s proposed prices will be determined by multiplying the quantities identified on the Price Schedule Worksheet by the unit price for the item to confirm the extended amount for the line item.

B. Technical Acceptability Evaluation. The contracting officer will seek responses to the sixteen questions located on page seven of this RFQ. The Offeror's responses will be evaluated to determine its understanding of the requirements and the qualifications to provide the requirement of this RFQ. Information shall be detailed enough to allow the government to make the technically acceptable or unacceptable determination. Any responses found unacceptable shall deem the entire quote technically unacceptable.

C. If the lowest priced evaluated offer is determined to have an ‘acceptable’ technical evaluation, then that offer represents the Lowest Price Technically Acceptable for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

D. If the lowest priced offeror is not determined to have an ‘acceptable’ technical evaluation, the next lowest priced offeror will be evaluated and the process will continue (in order by price)

FA5422-17-Q-0713 Page 9 until an offeror is determined to have an ‘acceptable’ technical evaluation or until all offerors are evaluated.

E. Offerors are cautioned to submit sufficient information and in the format specified in the RFQ to permit a meaningful assessment of technical acceptability. Offerors may be asked to clarify certain aspects of their quote. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revisions.

F. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, any Final Proposal Revision (FPR) will be considered in making the source selection decision. If the offeror’s proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the Final Proposal Revision are subject to evaluation and may introduce risk that the offeror’s proposal be determined unacceptable and ineligible for award.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

5352.201- 9101 - - Ombudsman (Jun 2016)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

ALASKA 9-ROOM FABRIC PARTITION SYSTEM

MANUFACTURER’S PART NUMBER (AK-PS/10-01)

MINIMUM SALIENT FEATURES FOR OR EQUAL PARTITIONS

Partition system shall fit inside an Alaska Small Shelter System, or Alaska 20’ X 32.5’ shelter, without any modifications to the existing shelter.

Partitions will create 10 rooms (Five rooms on each side) with a hallway down the center.

This requirement is for a partition system. A privacy curtain system will not meet the specifications of this requirement.

The partition system shall consist of aluminum (or similar metal) frames and fabric/canvas or vinyl walls. When installed, the wall material shall secure to the metal frame.

The partition system shall be made of materials that meet the U.S. Berry Amendment.

The system shall include 10 double zipper or solid entry door/panels. These panels are the access doors into each room. The access doors shall be between 30”-36” wide.

The partition walls parallel to the center hallway, will not be more than 8’ high. This height will allow the existing air plenum to distribute air into the rooms.

The partition wall parallel to the center hallway shall also include a vent or screen in each room approximately 12”X12”. The purpose of this vent is to allow the circulation of air.

The four partition walls perpendicular to the center hallway, may be taller than 8’ high.

These four partition walls may extend up to and attach to the tent arch support beam.

When installed these partitions may become one continuous wall that extends from both sides of the tent and fit around the air plenum, or this may be two independent walls that are not connected to but end prior to each side of the plenum.

The fabric/canvas/vinyl panels shall be made from 14oz vinyl material or similar weighted thickness. The panels shall also meet the following standards:

o NFPA 701 Small Scale o ASTM D6413 o BS 7837-1996 o ASTM G21

System includes a 5-yr non-prorated warranty.
