REFUSE COLLECTION & RECYCLE SERVICES

AT U.S. ARMY INSTALLATIONS, OKINAWA, JAPAN

1. DESCRIPTION OF SERVICES.

The contractor shall provide all management, tools, supplies, equipment, labor, manpower, and appropriate license(s), qualification(s), and permissions necessary to perform and accomplish refuse collection and recycle services at the following U.S Army Installations in Okinawa, Japan:

Torii Station, Naha Port, and Defense Logistics Agency Energy Okinawa Facilities (DLA= Chimuwan Tank Farm #1, 2 & 3, Kuwae Tank Farm #1 & 2 and White Beach Tank Farms).

1.1 BASIC SERVICES.

The contractor shall conduct appropriate transportation, collection, segregation, disassemble of recyclable items, recycle and disposal of solid waste, bulk items/industrial solid waste and recyclable items at Army Installations in Okinawa. The contractor shall transport and dispose at the authorized off-base disposal site. A copy of the landfill(s) operating permit that material is transported to shall be provided to the Contracting Officer (CO) at 18th Contracting Squadron (18CONS). The contractor is responsible for disposal being in accordance with U.S. Government, Japan Environmental Governing Standards (JEGS), in appendix D, and local prefectural industrial waste laws and regulations. The contractor shall follow the local law, Home Appliance Recycling Law, for recyclable items. The contractor shall be responsible for any permits, documents or manifest’s fees associated with the use of off-base disposal locations.

1.1.1 Collection Schedule. The contractor shall submit a collection schedule per location based on the frequency required shown in the appendix B. Proposed schedule shall be submitted to the Contracting Officer Representative (COR) for approval within fifteen (15) calendar days prior to start of contract performance. The contractor will be notified if any changes are required prior to approval. Any contractor requested changes in schedules after initial approval shall be submitted to the COR for reevaluation.

1.1.2 Contractor Furnished Scale. The contractor shall be responsible for maintaining scale calibration as required by prefecture laws and providing the COR with proof of calibration when it is performed. During contract performance costs for all manufacturers required maintenance and repairs on the scale shall be borne by the contractor. The scale shall be calibrated as specified by prefecture licensed scale calibration personnel. Proof of equipment calibration and licensing of scale calibration shall be provided to the COR when it has been done.

1.1.2.1 Weigh of Refuse and Recycled Items. The contractor shall weigh all individual loads of collected refuse and recycled items. Recycle items shall be weighted or counted per category mentioned in appendix B. The scale shall be used to weigh vehicles used in collection operations.

1.1.3 Solid Waste. The contractor shall collect solid waste and food waste from the trash stations identified in the appendix B and shall be disposed of at licensed appropriated locations off base.

Collection, transportation, recycle, disposal and segregation fees shall be the sole responsibility of the contractor. The government will designate trash stations which are areas normally adjacent to the facilities/buildings. The contractor shall also be responsible for collecting individual plastic and paper trash bags, or other similar Municipal Solid Waste (MSW) containers located in and around the trash stations. The contractor shall provide and resupply plastic bags in order to empty the trash boxes located outside the buildings and far away from the facilities/buildings.

1.1.4 Bulk Items/Industrial Solid Waste. The contractor shall collect bulk items/industrial solid waste from contractor furnished dumpsters or placed at trash stations, indicated by the COR. Bulk items such as appliances, furniture, junked auto parts, pallets, shall be collected as is. Bulk items may be loose on the ground or placed in cartons, boxes, cans, tied bundles, or other similar containers.

1.1.5 Recyclable Items. The contractor shall collect the recycle items from all Army Installations from the government furnished recycle bins located inside the buildings indicated shown in appendix B and other locations indicated by the COR. The contractor shall provide and resupply plastic bags to the government furnished recycle bins to make easier the collection of these items.

The contractor shall make efforts to recycle industrial solid waste/construction demolish waste such as concrete, asphalt, wood and scrap steel, and items mentioned in appendix B.

1.1.5.1 Recycle of Electrical Appliances. The recycling work involves collection, transportation, disassembly, disposal and recycle of electrical appliances, such as air-conditioners, TV, refrigerators, freezers, washers, dryers, and computers mentioned in appendix B, regardless of manufacturer in accordance with local law, Home Appliance Recycling Law. Manifest shall be accompanied as it mentioned in paragraph 1.1.7.

1.1.5.2 Recyclable Materials Acceptance. Environmental Division, US Army Garrison Okinawa will indoctrinate all the Army tenants to meet acceptance recycle criteria, such as PET bottles and glasses shall be cleaned, with no labels, no caps and lids, cardboards shall be folded, etc. However, in some cases the recyclable materials do not meet the acceptance criteria, set by Environmental Office, the contractor is still responsible to collect these items, segregate and to make these items recyclable and then conduct appropriate disposal for items non-recyclable.

1.1.5.3 Automotive Batteries. The contractor shall collect any automotive batteries visibly present at refuse collection areas or on the curbside for pick-up. The contractor shall tape with electrical isolation tape the terminals before the collection to avoid short-circuit issues.

1.1.6 Permanent Contractor Furnished Dumpsters. The contractor shall provide total of thirteen

(13) EA, 4 ton capacity steel dumpsters and maintain in serviceable condition for permanent placement at Army Installations. The COR will indicate the specific locations to place these dumpers. The contractor shall provide one (1) 2 ton capacity or smaller dumpster with a lid to place cardboards for recycle at Bldg 200 (Havana’s Restaurant), Torii Station. The customers will not be required to perform any special preparation of disposed items, like sorting or removing nails. However, items identified as hazardous, not disposable, will NOT be placed within contractor furnished dumpsters. The contractor shall deliver and pick up dumpsters as scheduled at the locations indicated by the COR. COR shall notify contractor when these dumpsters are no longer required at a given location.

1.1.7 Manifest and Monthly Reports. The contractor shall prepare and submit to the COR manifest of all recyclable items to ensure a complete audit trail from point of origin to ultimate disposal.

Also, monthly reports of all recyclable/non recyclable items diverted to dispose/recycle not later than 10 working days of the immediate succeeding month. The monthly reports shall be per locations such as Torii Station, Naha Port, Chimuwan Tank Farm #1, 2 & 3, Kuwae Tank Farm

#1 & 2 and White Beach Tank Farms. The contractor may coordinate with the COR for the report format. The contractor shall submit a monthly report to the COR, with the following information:

a. Name of contractor

b. Contract number and title

c. Date of delivery performance

d. List of disposed/recycled items and quantities. (Submit a copy of the original receipt).

NOTE: Quantity will be numbered and weight, in kilograms, for electrical appliances and weight of demolish waste that has been diverted to disposal/recycle.

e. Where items were disposed (Specify location of collected items).

f. Notes of any deficiencies found, including quantity of trash containers that may need replacement due to missing lids and/or holes in the container.

1.1.8 Torii Beach Summer Season. The contractor shall increase the frequency from April to October, Monday through Sunday. The collection shall be twice a day, in the morning and afternoon. The COR may ask to extend the Torii Beach Summer Season collection frequency period till November. There shall be no additional cost to the government for the Torii Beach Summer Season performance.

1.1.9 Government Furnished Trash Boxes. The contractor shall participate with the COR in an “Initial Joint Inspection/ Inventory of Government Furnished Trash Boxes” before the start of the contract. The COR inspection will be used as an inventory on government trash boxes, condition and locations.

1.1.9.1 Government Furnished Trash Boxes and Trash Stations Clean-Up. The cleaning schedule shall be provided to the COR at the beginning of each fiscal year. The contractor shall clean the government furnished trash boxes and trash stations four (4) times a year with an interval of three

(3) months between each cleaning schedule. The contractor shall clean the trash boxes at off base site. The contractor shall use only water in high pressure spray to clean the government furnished trash boxes. The trash stations shall be swept and NOT rinse with water. Cleaning shall include all interior and exterior areas of the trash boxes and trash stations to ensure all refuse, residue, and odors are completely removed. The contractor shall return the trash boxes to the government after the cleaning is done in good condition as documented by the “Initial Joint Inspection/ Inventory of Government Furnished Trash Boxes”. The COR will inspect the cleaned trash boxes prior to return to its original location.

The contractor shall maintain all government furnished trash boxes in full operational condition.

The contractor shall inform of any damaged or missed to the COR as soon as it is acknowledged.

If the reason of damage is by the contractor, the deficiency shall be corrected by the contractor within the determinate period agreed between the contractor and COR. If the reason of the damage is by an unknown, the contractor shall notified the COR as soon as it is acknowledged and the contractor is not responsible to correct this deficiency.

1.1.10 Spillage Clean-Up. The contractor shall be responsible for cleaning up any spills caused by the contactor or the government, loose debris, etc., within a 10 feet (3 meters) radius of the trash boxes/recycle bins/dumpsters.

1.2 SPECIAL REQUIREMENTS.

1.2.1 On Call Services. On call services are required in order to support events/festivals and immediate requirements such as typhoon and other calamities. The service shall be performed according to the specifications stated in this PWS and the requirements made by the COR. The COR will make service calls from Monday to Friday within the contractor’s regular office hours.

The contractor shall provide the service toward these call services at least the following day of the call made in case of immediate requirements.

1.2.1.1 Temporary Contractor Furnished Dumpsters. The contractor shall provide additional 4 ton capacity steel dumpsters besides the dumpsters mentioned in the para.1.1.6. The COR will coordinate with the contractor for the needed requirements under the on call services. These dumpsters shall be emptied, removed or relocated by COR directions. Waste collected shall be considered solid waste, food waste, bulk items/industrial solid waste and recycle items. If the contractor finds other materials waste, in these dumpsters they shall be segregated appropriately, recycled and disposed by the contractor.

3.1 UTILITY. The government will provide water and electricity at no cost to the contractor when available.

4. GENERAL INFORMATION.

4.1. QUALITY CONTROL.

4.1.1 The contractor is required to control the quality of services delivered to the government.

The overall quality must meet the specified performance thresholds for each requirement in the Services Summary.

4.1.2 Records of inspections shall be kept and made available to the government throughout the contract performance period and for the period after contract completion until final settlement of any claims under this contract.

4.2. QUALITY ASSURANCE.

The government will periodically evaluate the contractor’s performance by appointing the Contracting Officer’s Representative (COR) to monitor performance to ensure services are received. The COR will evaluate the contractor’s performance through Periodic Inspection on-site inspections and receipt of complaints from base personnel. The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the government may decrease the number of quality control inspections if merited by performance.

4.2.1 The Contracting Officer’s Representative(s) (CORs) is the authorized government representative(s) who will perform assessments of the contractor’s performance. Subsequent to contract award, the identity of the COR(s), with a letter defining their duties and authority will be promptly furnished to the successful offeror.

4.2.2 The COR(s) will inform the contract manager in person when discrepancies occur and will request corrective action. The COR(s) will make a notation of the discrepancy on their surveillance checklist with the date and time the discrepancy was noted and will request the contract manager (or alternate contract manager) to initial the entry on the checklist.

4.2.3 Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer (CO) through the COR(s).

4.2.4 The services to be performed by the contractor during the period of this contract shall at all times and places be subject to review by the CO or authorized government representative(s).

4.3. SECURITY REQUIREMENTS.

Security and base access requirements are contained in clause 5352.242-9000 “Contractor Access to Air Force Installations.” Except U.S. military installations where the required refuse collection and recycle services are performed, only two (2) contractor employees (contract manager and its alternate) shall require for base pass for access to Kadena Air Base. Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base. Procedures for commercial vehicle access to the base are subject to change without prior notice.

4.3.1 ID Passes, Badges and Vehicle Stickers. The contractor is responsible to obtain such clearances and/or passes as required for his/her employees to enter the U.S. military installations

prior to start to work. The contractor shall be responsible for all passes issued to his/her employees under this contract. Applications shall be coordinated through the CO or designated government representative. At the time of application, Security Forces may conduct a background check on employees. Upon termination of employment, the contractor shall be responsible for returning identification cards and base passes to Security Forces within 24 hours.

4.3.1.1 The contractor shall submit a request for base passes for his employees to the 18th Contracting Squadron, Attention: 18 CONS/LGCB, Kadena Air Base, for recommendation of approval by the Pass and ID Section. After approval from 18 CONS/LGCB, the contractor shall follow the instructions for acquiring designated pass ID for entry into applicable Marine and Navy facilities at Camp Foster, Bldg 456, at DSN 645-2239/7519 or from off base dial 098-970- 2239/7519. The contractor shall follow the instructions for acquiring designated pass ID for entry into Army Facilities (Torii Station, Naha Port and DLA Facilities=Kuwae Tank Farm #1 & 2, Chimuwan Tank Farm #1, 2 & 3 and White Beach Tank Farm) from Torii Station Pass Office, at Bldg 240, Torii Station, at DSN 644-4688 and from off base dial 098-970-5555 (Operator) and after the tone changes, dial 644-4688 or talk to the operator to be connected to 644-4688.

DLA-Energy Okinawa, call as Chibana Compound, is located nearby the outside of Kadena Air Base gate 3. The application documents shall be processed through DLA-Energy Okinawa, Bldg 53135 at DSN 632-4761 or from off base dial the operator at 098-938-1111 (Operator) and after the tone changes, dial 632-4761.

4.3.1.2 For vehicle access, follow the instruction from Vehicle Registration, Bldg 5638, Camp Foster, at DSN 645-3200 or from off base dial 098-970-3200. The prime contractor shall be responsible for all passes issued to his/her or his subcontractor’s employees under this contract.

The government reserves the right to obtain certification of receipt for all base passes upon termination of employment or completion of contract, prior to payment of final invoice.

Contractor employees will be required to display identification badges.

4.4. PHYSICAL SECURITY.

The contractor shall be responsible for safeguarding all government property provided for contractor use (if applicable). At the close of each work period, government facilities, property, and materials shall be secured.

4.5. HOURS OF OPERATION.

4.5.1. Normal Hours of Operation. The contractor shall perform the services required under this contract during the following hours: 0730 thru 1800 hrs, Monday thru Saturday, except U.S Holidays. However, the contractor shall perform the services from Monday through Sunday under para 1.1.8. The contractor may work, with prior approval of the CO, extended hours to ensure timely completion of work at no additional cost to the government

4.5.1.1. Recognized Holidays. The contractor is not required to provide service on the following days: New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Days, Thanksgiving Day, and Christmas Day. If the holiday falls on Saturday, it is observed on Friday. If the holiday falls on a Sunday, it is observed on Monday.

* If a holiday falls on Saturday it will be observed the proceeding Friday. If it falls on a Sunday it will be observed the following Monday. If the scheduled site collection is less than five (5) times per week, the refuse collection shall be accomplished the normal day prior to the designated holiday. Any collection rescheduled under this paragraph shall be accomplished in addition to all normal collections for this day. Holiday rescheduling shall be provided at no additional cost to the government.

4.6. CONSERVATION OF UTILITIES.

The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions which prevent the waste of utilities which include the following:

4.6.1 Lights shall be used only in areas where and when work is actually being performed.

4.6.2 Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by the contractor or by contractor employees unless authorized.

4.6.3 Water faucets or valves shall be turned off after the required use has been accomplished.

4.6.4 Government telephones shall be used only for official government business.

4.7. RECORDS.

The contractor shall be responsible for creating, maintaining, and disposing of only those government required records that are specifically cited in this PWS or required by the provisions of a mandatory directive listed in Applicable Publications and Forms. If requested by the government, the contractor shall provide the original record or a reproducible copy of any such record within five working days of receipt of the request.

4.8. ENVIRONMENTAL CONTROLS.

4.8.1. Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable Japan Environmental Governing Standards (JEGS) in appendix D, Department of Defense, prefectural and local environmental laws and regulations and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect.

4.8.2. Notification of Environmental Spills. If the contractor spills or releases any substance into the environment, the contractor or its agent shall immediately report the incident to Army Fire Department at 911 and the COR. The liability for the spill or release of such substances rests solely with the contractor and its agent. The contractor is responsible for spill clean-up, remediation and disposal in accordance with appropriate laws and regulations.

4.8.3. Use of Hazardous Materials. The contractor’s use of any hazardous materials will require the submittal of a Safety Data Sheet (SDS) in English and in Japanese for each item utilized. The contractor shall prepare to obtain the approval through the COR from the Fire Department, Safety and the Environmental Office prior to the use of the item. The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, FA527018Q0003 temperature, cleanliness, and materials handling. The contractor shall be responsible for the proper handling, labeling, storage and disposal of hazardous materials in accordance with all existing laws and regulations set forth by the Prefecture Government of Okinawa, Japan. Storage of hazardous material on the installation is prohibited and all hazardous material will be removed from the installation at the end of each work day as it is mentioned in DFARS 252.22-7006 “Prohibition on storage and disposal of toxic and hazardous materials (Apr 2013)”

4.8.4 Employee Contact with Hazardous Waste. The contractor’s personnel may during the course of refuse collection discover items identified as hazardous in JEGS, within the refuse containers or at a designated refuse collection location. Hazardous waste collection and disposal is excluded from this PWS. The contractor shall not remove the hazardous item from its current location. The contractor shall notify the COR of the hazardous item, and its location. The contractor shall contact the COR who will confer with servicing Fire Department personnel and with the U.S. Army Garrison Okinawa, Directorate of Public Works, Environmental Office at 644- 4910 to determine proper disposal.

4.9. GOVERNMENT OBSERVATIONS.

Government personnel, with the CO coordination, may observe contractor operations. However, these personnel may not interfere with contractor performance or make any changes to the contract.

4.10. SAFETY REQUIREMENTS.

4.10.1. Contractor shall conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work in a safe manner as required by OSHA 2206, General Industry, Occupational Safety and Health Standards (29 CFR 1910) http://www.osha.gov/, 2016 Japan Environmental Governing Standards (JEGS) by US Force Japan and general safety requirements of EM 385-1-1, dated 03 November 2003, “US Army Corps of Engineers, Safety and Health Requirements Manual” in appendix F.

4.10.2. Develop and provide at the start of the orientation period or the start of the first operational performance period (if there is no orientation period) a safety plan for the protection of government facilities and property and to provide a safe work environment for contractor personnel.

4.10.3. Provide protection to government property to prevent damage during the period of time the property is under the control or in possession of the contractor.

4.10.4. Include a clause in all subcontracts to require subcontractors to comply with the safety provisions of this contract as applicable.

4.10.5. Ensure personnel have the following on-base emergency services phone numbers programmed into their cell phones:

4.10.6. Record and report promptly (within one hour) to the CO or COR all available facts relating to each instance of damage to government property or injury to either contractor or government personnel.

4.10.7. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the CO.

4.10.8. If the government elects to conduct an investigation of the accident/mishap, the contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.

4.10.9. Include a clause in each applicable subcontract requiring the subcontractor's cooperation and assistance in accident reporting and investigation.

4.10.10. The contractor will be responsible for instructing his employees in safety measures considered appropriate. The contractor shall not permit placing or use of any equipment in traffic or other locations in such a manner as to create safety hazards. Whenever applicable, the contractor will provide and place appropriate warning signs at work areas and its removal after completion of work.

4.10.11. All safety precautions shall be exercised when working in and around DLA storage facilities. All contractor equipment shall be equipped with proper safety and noise-limiting devices and shall be kept in safe operating condition at all times.

4.10.12. All contractor vehicles shall be in good mechanical and safe operating condition. All vehicles shall keep dry chemical type fire extinguishers on each vehicle. These vehicles are subject to inspection at any time.

4.10.13. All contractor employees entering DLA areas shall not have matches or lighters in their possession. Smoking is prohibited at DLA Facilities (Kuwae Tank Farm 1, 2, Chimuwan Tank Farm 1, 2 & 3, White Beach Tank Farms and DLA Patrol Road). The contractor shall ONLY smoke in designated areas at Torii Station, Bolo Point, Naha Port and Naha Annex.

4.10.14. Fire & Emergency Services.

The contractor shall be responsible to follow the Fire & Emergency Services (USAG-J Reg 420-

90) in appendix E.

4.11. CONTINUATION OF ESSENTIAL DOD CONTRACTOR SERVICES DURING

CRISIS IAW DoDI 3020.41, Operational Contract Support, paragraph 2.c, it is determined that Refuse Collections and Recycle Services at U.S. Army Installations in Okinawa, Japan, has been identified by the Functional Commander/Director as an essential service.

4.12. PHASE OUT.

4.12.1 If there is a change in contractor or if the operation reverts to in-house, the incumbent contractor will provide familiarization, to the government or the follow-on contractor, whichever the case may be, for 30 days after receipt of a notice from the CO. During the phase-out familiarization period, the incumbent will be fully responsible for the operation of the required services.

4.12.2 The government reserves the right to conduct site visits in all contractor operated facilities in conjunction with the solicitation of offers for the follow-on contract. In the event the follow-on contract is awarded to other than the incumbent, the incumbent contractor will cooperate to the extent required to permit an orderly change over to the successful contractor. With regard to the successor contractor’s access to incumbent employees, a recruitment notice may be placed in each facility.

4.13 PUBLICATIONS.

4.13.1 Compliance with all publications, regulations and operating instructions provided by the government is required when:

4.13.2 They pertain to the procedures for materials expediting herein and where the contractor is authorized by the performance work statement to accomplish the work specified in the publication, regulation or operating instructions.

4.13.3 The publications prescribe USAF policies, use of materials, procedures and processes applicable to the work requirements.

4.13.4 The contractor is required to acquire and work on the latest version of the publication.

4.14. CONTRACTOR PERSONNEL

4.14.1. Contract Manager. The contractor shall provide a contract manager and alternate contract manager (responsible in the absence of the contract manager) who shall be responsible for the performance of the services. The names of the contract manager and alternate(s) shall be provided to the CO in writing prior to the beginning of the first performance period. The contract manager and alternate(s) must be able to read, write, speak, and understand English.

4.14.1.1. The contract manager and alternate shall have full authority to act for the contractor on all contract matters relating to daily operations of this contract.

4.14.1.2 The contract manager or his/her alternate shall be available on work sites during the normal hours of operation for the CO, COR, and other government personnel designated by the CO for any matters and issues concerning the contract.

4.14.2. Contractor Employees. The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the CO as a potential threat to the health, safety, security, general well being or operational mission of the installation and its population.

4.14.2.1. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee name in English.

4.14.2.2. The contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest. Additionally, the contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to DOD 5500-7-R Joint Ethics Regulation. The contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies in AFI 64-106.

4.14.2.3. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours or deployment.

Military Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor’s ability to perform;

however, their absence at any time shall not constitute an excuse for nonperformance under this contract.

4.15. JAPANESE ROAD LAWS

4.15.1. The contractor shall comply with Japanese Road Laws while on US Military installations specifically Article 43 The Road Law (Japan). No person shall commit the following:

4.15.1.1. Damaging the road, causing roads to be littered with debris, polluting the roads with debris or fall-out from motor vehicles or otherwise defacing roads unreasonably or without due cause.

4.15.1.2. Article 43-2 (Measures to be taken to prevent cargo or things loaded on motor vehicles from falling out)

4.15.2. The agency managing a road may when there is reasonable cause for him to feel that items or cargo being carried in or on a motor vehicle may fall out and damage, pollute, or otherwise deface the road in such manner as to hinder or obstruct the traffic, order the operator of the vehicle in question to take steps or measures necessary to prevent occurrence of such hindrance by stopping operation of the vehicle, or correcting the method of loading or traveling or operation of the vehicle.

4.16. REQUIRED INSURANCE by JAPANESE LAW

4.16.1. The Contractor shall procure and maintain during the entire period of his performance under this contract the following minimum insurance on each vehicle used by the Contractor at the work site.

4.16.1.1. Type: Automobile Property Damage Insurance Amount: ¥3,000,000 or Dollar equivalent Bodily Injury Insurance Amount: ¥30,000,000 or Dollar equivalent

4.16.1.2. All vehicles must be properly inspected/insured in accordance with Japanese Compulsory Insurance (JCI) requirements.

4.16.2. Prior to the commencement of work hereunder, the Contractor shall furnish to the CO a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the U.S. Government in such insurance shall not be effective for such period as may be prescribed by the laws of the state in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the CO.

4.17 CONTRACTOR MANPOWER REPORTING (CMR).

The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address: https://www.ecmra.mil/Default.aspx The required information includes: (1) the Contracting Office, CO and COR; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including sub-contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-contractors); (7) Total payments (including sub-contractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information); (11) Locations where contractor and sub-contractors perform the work (specified by zip code in the United States and nearest city, country, when in and overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of contractor and sub-contractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not exceed 12 months ending 30 September of each government fiscal year and must be reported by 31 October of each calendar year.
