Title:
Provide Side-Walk Erosion Control, CL #6187/ #6195
Location:
Camp Lester, Housing Area, Okinawa, Japan
1.0 General Scope: The contractor shall repair two location of eroded sidewalk bank by providing backfill soil under and against existing sidewalk between units #6187 and #6195 in Camp Lester housing area. Work to include shoring the hillside as necessary, removing the eroded soil, grading and compacting the disrupted slope to uniform condition, installing a ground cover by sodding or other type of grass, relocate trees and clear trees roots as necessary and performing any disturbed and displaced areas and utilities. All other replaced work to include removal/disposal and site work to complete a usable facility.
2.0 Project Schedule and Time Constraints:
2.1 Completion of Work: The Contractor shall be required to complete the entire work, ready for use, not later than 93 calendar days after the date of Notice to Proceed (NTP). The time for completion shall include final clean-up of the premises.
2.2 Performance Time: The contractor shall be completed within 93 calendar days. This includes material submittals, government material submittal review, procurement of materials and construction time.

2.3 Construction Schedule: The Contractor shall be allowed to work 0730 to 1730 hours, Monday through Friday, excluding US legal holidays, listed in the table below, and other days specifically designated by the Contracting Officer (CO).
U.S. Legal Holidays: The following are the only observed federal holidays.

3.0 Submittals and Construction Requirements:
3.1 SHOP DRAWING: A shop drawing shall be developed and provided that addresses the scope identified within this Statement of Work and be included as part of the contract cost. During the construction period, the Contractor shall minimize interference with existing work. Design must conform to UFC Standards, current IBC, UFGS (www.wbdg.org), JEGS, OSHA, NFPA 101 and all other applicable publications, codes, and regulations. The Government shall not be responsible for any additional costs which could have been avoided through an appropriate contractor’s design and construction.
3.2 START WORK NOTIFICATION: Before starting on-site work the Contractor shall notify the CO and Project Manager in writing, Thirty (30) calendar days prior to on-site-work starting. After approval of on-site work, the contractor shall provide written notice to the Housing Manager and Military Family Housing Occupants indicated on the statement of work within a minimum of Fourteen (14) calendar days prior to starting on-site work.
3.3 As-built drawings depicting utility plans and site plan will be provided to the Contractor for reference only in their present form. The Government bears no responsibility for the accuracy of these drawings. Actual field investigation and survey of the facility must be conducted by the Contractor to ascertain existing conditions before start of construction.
3.4 PREPARATION OF MATERIAL APPROVAL SUBMITTALS: The materials submittal must be coordinated and approved with 718CES/CENMB. Required Submittals shall be identified on an AF Form 66, Material Submittal Log by the government, submittals shall be transmitted provided an AF Form 3000.
3.5 WORK CLEARANCE REQUEST: It is the Contractor’s responsibility to prepare the Air Force Form 103 at their own expense. The work clearance request is used for any work and is submitted to the Contracting Officer Representative, reviewed and approved by the listed organizations, Security Police, Safety, Communications, Commercial Utility Company and Chief of Engineering Division or Engineering Flight Chief. Only after the permit is approved and signed by organizations and other agencies listed on the Air Force Form 103, the contractor may commence with work. Without a permit, the excavation work will be stopped, until an approved permit is obtained.
3.6 WORK PROGRESS SCHEDULE: In addition to the requirement of the construction schedule set forth in the contract, the contractor shall, when required by the Government, provide and submit to Contracting Officer Representative (COR) photographs and a detailed work progress schedule in the form of a Bar Chart Work Schedule showing the step-by-step phases of work to be accomplished prior to performing actual work. The contractor shall require coordination with COR to make a work progress schedule. The work shall, so far as practicable, be done in definite sections or divisions and confined to limited area which shall be completed before work in other sections or divisions are begun.
3.7 AVILABILITY OF LATRINE: Latrine is not available in the work area. The Contractor shall be responsible for providing latrines for his personnel. Location of the latrines shall be designated by the COR. Any and all Contractor latrines shall be removed from US Government property prior to issuance of final payment.
3.8 AVAILABILITY OF UTILITY SERVICE: The Government will furnish electricity and water to the Contactor at no cost in accordance with the contract clause entitled “Availability and Use of Utility Services” if utilities are available in the vicinity of the project site.
3.9 Joint job site inspection shall be conducted by the project engineer, user, contractor, and 18 CONS/LGCC representatives.
3.10 CONSTRUCTION SIGNS: The Contractor shall provide and maintain construction signs on the project site, as determined by the CO. Signs shall be installed on the site by the contract start date and shall be removed by the contract completion date. Location of project signs will be coordinated with the Facility Manager, and Project Manager. Request for company sign will be submitted to CO and the Project Manager in writing for approval.
3.11 BARRICADES: The Contractor shall provide bilingual barriers/signs to keep unauthorized persons from entering the airfield work or restricted work areas. Battery-powered lights will be used at night as warning signs when directed by the CO. The construction areas shall be continuously illuminated while on site work is performed during hours of darkness.
3.12 CLEAN UP OF AREA: All Contractor generated debris and rubbish shall be collected at the end of each day and deposited at locations designated by CO.
3.13.
DEBRIS AND RUBBISH ONTROL: For removal and transport of debris and rubbish, use only roadway and street designated by the COR. Remove and transport debris and rubbish in a manner so as to prevent spillage on streets or adjacent area. Contractor shall be responsible for clean-up for any spills on roadways, streets, and other areas. Burning of debris and rubbish on U.S. installations is prohibited. Concrete, masonry, and other materials not permitted to remain in place, shall be disposed of outside the limits of Government-controlled land by the Contractor.
3.14 PROTECTION OF PROPERTIES: The contractor shall protect existing plants and appliances during construction. The items that will be moved by the Contractor shall be properly stored and protected and shall be returned to the original place by the Contractor. Plumbing, wiring and other existing materials damaged during the contractor’s operations shall be repaired and replaced at no cost to the Government.
3.15 AS-BUILT DOCUMENTS: The Contractor shall provide the corrected contract drawings in CD containing all drawings in electronic CADD and PDF and all documents in WORD or EXCEL and PDF.
4.0 Special Requirements:
4.1 Relocate trees:
a. Remove and relocate existing two trees to affect the concrete sidewalk.
b. The construction contract requires the Contractor to maintain trees for a period of one year from the date of substantial completion.
4.2 This project shall provide all labor and materials to provide side walk erosion control between #6187 and #6195 in Camp Lester housing area. The contractor shall provide the best solution, and recommendation not specifically stated elsewhere in this statement of work.
5.0 Description of Work: The work consists of the following elements in addition to the drawings and specifications.
5.1
CIVIL:
1. Remove and relocate existing two trees. The relocated locations of trees are indicated on the utility plan.
2. Fill soil and compact holes. Provide top soil and sodding.
3. Install wood supports for trees.
4. Remove and dispose existing concrete sidewalk between units # 6187 and #6195 to fill soil.
5. Fill soil, grading and compacting the disrupted slope to uniform condition.
6. Provide new concrete sidewalk.
7. Provide top soil and soddng with erosion control net or tenser and pins including shoring the hillsides.
8. Provide fertilizer.
9. Maintain trees during warrantee. Watering and additional fertilizer will be required as necessary.
10. Other necessary civil work to complete a usable facility.

52.246-12 INSPECTION OF CONSTRUCTION (AUG 1996)
(a) Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
(c) Government inspections and tests are for the sole benefit of the Government and do not--
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.
(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.
(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
(g) If the Contractor does not promptly replace or correct rejected work, the Government may (1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor or (2) terminate for default the Contractor's right to proceed.
(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

PRE-FINAL AND FINAL INSPECTION
In accordance with FAR 52.211-10 the contractor is required to complete this project, ready for use, within the number of calendar days specified in the solicitation and resulting contract. To ensure adequate time to correct any deficiencies noted by the government during the final inspection, it is highly recommended that the contractor schedules such final inspection through the contract administrator at least seven (7) calendar days prior to the scheduled project completion date. The contractor is solely responsible for scheduling this inspection and is reminded that failure to complete the project ready for use in accordance with the contract terms and conditions may result in the assessment of liquidated damages as described in FAR 52.211-12, Liquidated Damages - Construction. Occasionally, minor discrepancies may be detected during the final inspection that may be considered “punchlist” items. If only minor “punchlist” items are found, another inspection may not be required. However, all punchlist items must be corrected by the contractor, and verified by the project inspector, prior to expiration of the contract period unless otherwise authorized in writing by the contracting officer. The determination as to what constitutes a minor discrepancy rests solely with the contracting officer and nothing in this paragraph shall be construed as a waiver of the government’s rights under any clause in this contract, including the right to assess liquidated damages as may be appropriate for failure to complete the project in accordance with the terms and conditions contained therein.

DESIGNATION OF GOVERNMENT INSPECTOR
The Base Civil Engineer or his authorized representative is designated as the representative of the contracting officer for the purpose of technical surveillance of workmanship and inspection of materials for work being performed under this contract. This designation in no way authorizes anyone other than the contracting officer to commit the Government to changes in the terms of the contract.

This contract contains DFARS Clause 252.232-7003, Electronic Submission of Payment Requests. This clause requires invoices for supplies and services purchased by the DoD be submitted via electronic means. The Wide Area Workflow (WAWF) system satisfies this mandatory requirement. WAWF can be accessed on the internet at https://wawf.eb.mil/.
Before using WAWF, ensure your company’s Electronic Business POCs listed in your System for Award Management (SAM) are the same individuals that will invoice through WAWF. If they aren't, changes can be made to your company’s SAM profile at https://www.sam.gov/portal/public/SAM/. Click on "Update” or “Renew” using “TPIN". SAM customer support can be reached at 1-866-606-8220.

a. The contractor shall procure and maintain during the entire period of his performance under this contract the following minimum insurance on each vehicle used by the contractor at the work site.

The Contractor will submit requests for gasoline or diesel oil tax exemption certificates to the Contracting Officer. This request will show the actual amount of gasoline or diesel oil used exclusively for the performance of this contract, with documentary evidence and detailed item breakdown to certify the accurate consumption of gasoline or diesel oil, or other necessary information and data as may be required. The Contracting Officer will issue to the Contractor a Tax Exemption Certificate for the actual amount of gasoline or diesel oil used exclusively for the performance of this contract. The Contractor shall claim all tax and customs exemptions as listed in clause CONST-H-7250, entitled, “EXEMPTION FROM JAPANESE CUSTOMS DUTIES AND TAXES PURSUANT TO STATUS OF FORCES AGREEMENT”.

JAPANESE ROAD LAWS (AUG 2001)
The Contractor shall comply with Japanese Road Laws while on U.S. military installations to specifically include:
Article 43, The Road Law (Japan) (prohibitive acts relative to roads). No person shall commit the following described acts:
Damaging the road, causing roads to be littered with debris, polluting the roads with debris or fall out from motor vehicles or otherwise defacing roads unreasonably or without due cause.
Article 43-2 (Measures to be taken to prevent cargo or things loaded on motor vehicles from falling out)
The agency managing a road may, when there is reasonable cause for him to feel that items or cargo being carried in or on a motor vehicle may fall out and damage, pollute, or otherwise deface the road in such manner as to hinder or obstruct the traffic, order the operator of the vehicle in question to take steps or measures necessary to prevent occurrence of such hindrance by stopping operation of the vehicle, correcting the method of loading or traveling, or operation of the vehicle.

REGISTRATION OF MOTOR VEHICLES (AUG 2001)
All company-owned and privately-owned motor vehicles required to be on U.S. Government facilities during the performance of this contract must be registered with Vehicle Registration, Camp Foster. Necessary decals and/or permits will be issued and displayed on the vehicles in the manner as directed by the Vehicle Registration Officer. Vehicle decals shall be removed from vehicles and turned in to Vehicles Registration, Camp Foster, at the end of the contract period or sooner when vehicles are no longer used in the performance of the contract or as directed by the Contracting Officer.

252.223-7001 HAZARD WARNING LABELS (DEC 1991)
(a) "Hazardous material," as used in this clause, is defined in the Hazardous Material Identification and Material Safety Data clause of this contract.
(b) The Contractor shall label the item package (unit container) of any hazardous material to be delivered under this contract in accordance with the Hazard Communication Standard (29 CFR 1910.1200 et seq). The Standard requires that the hazard warning label conform to the requirements of the standard unless the material is otherwise subject to the labeling requirements of one of the following statutes:
(1) Federal Insecticide, Fungicide and Rodenticide Act;
(2) Federal Food, Drug and Cosmetics Act;
(3) Consumer Product Safety Act;
(4) Federal Hazardous Substances Act; or
(5) Federal Alcohol Administration Act.
(c) The Offeror shall list which hazardous material listed in the Hazardous Material Identification and Material Safety Data clause of this contract will be labeled in accordance with one of the Acts in paragraphs (b)(1) through
(5) of this clause instead of the Hazard Communication Standard. Any hazardous material not listed will be interpreted to mean that a label is required in accordance with the Hazard Communication Standard.

(d) The apparently successful Offeror agrees to submit, before award, a copy of the hazard warning label for all hazardous materials not listed in paragraph (c) of this clause. (e) The Contractor shall also comply with MIL-STD-129, Marking for Shipment and Storage (including revisions adopted during the term of this contract).

252.229-7001 TAX RELIEF (JUN 1997)
(a) Prices set forth in this contract are exclusive of all taxes and duties from which the United States Government is exempt by virtue of tax agreements between the United States Government and the Contractor's government. The following taxes or duties have been excluded from the contract price:

If the Contractor intends to use imported products from inventories on hand, the price of which includes a factor for import duties, the Contractor shall ensure the United States Government's exemption from these taxes. The Contractor may obtain a refund of the import duties from its government or request the duty-free import of an amount of supplies or components corresponding to that used from inventory for this contract.

5352.201-9101 Ombudsman
As prescribed in 5301.9103, insert the following clause:
OMBUDSMAN (NOV 2012)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, the interested party may contact the Center/MAJCOM/DRU or AFISRA ombudsmen, CMSgt Gene Eastman, HQ PACAF/A7KP, Hickam AFB, HI 96853-5427, Telephone: (808) 449-8567, Fax: (808) 449-8572. 5352.223-9000 Elimination of Use of Class I Ozone Depleting Substances (ODS).
As prescribed in 5323.804, insert the following clause in solicitations and contracts:
ELIMINATION OF USE OF CLASS I OZONE DEPLETING SUBSTANCES (ODSs) (APR 2003)
(a) Unless the requiring activity has obtained prior Senior Acquisition Official (SAO) approval, contractors may not:
(1) Provide any service or product with any specification, standard, drawing, or other document that requires the use of a Class I ODS in the test, operation, or maintenance of any system, subsystem, item, component, or process; or
(2) Provide any specification, standard, drawing, or other document that establishes a test, operation, or maintenance requirement that can only be met by use of a Class I ODS.

(b) For the purposes of Air Force policy, the following products that are pure (i.e., they meet the relevant product specification identified in AFI 32-7086) are Class I ODSs:
(1) Halons: 1011, 1202, 1211, 1301, and 2402;
(2) Chlorofluorocarbons (CFCs): CFC-11, CFC-12, CFC-13, CFC-111, CFC-112, CFC-113, CFC-114, CFC-115, CFC-211, CFC-212, CFC-213, CFC-214, CFC-215, CFC-216, and CFC-217, and the blends R-500, R-501, R-502, and R-503; and
(3) Carbon Tetrachloride, Methyl Chloroform, and Methyl Bromide.

5352.242-9000 Contractor access to Air Force installations.
As prescribed in 5342.490-1, insert a clause substantially the same as the following clause in solicitations and contracts:
CONTRACTOR ACCESS TO AIR FORCE INSTALLATIONS (AUGUST 2007)
(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.
(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or security police for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver’s license, current vehicle registration, valid vehicle insurance certificate, and [insert any additional requirements to comply with local security procedures] to obtain a vehicle pass.
(c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.
(d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with [insert any additional requirements to comply with AFI 31-101, Volume 1, The Air Force Installation Security Program, and AFI 31-501, Personnel Security Program Management,] citing the appropriate paragraphs as applicable.
(e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.
(f) Failure to comply with these requirements may result in withholding of final payment.

EXEMPTION FROM JAPANESE CUSTOMS DUTIES AND TAXES PURSUANT TO STATUS OF FORCES AGREEMENT
(a) Paragraph 2, Article XI of the Status of Forces Agreement between Japan and the United States, authorizes the United States entry into Japan free from Japanese customs duties and all other charges on materials, supplies, and equipment imported for the official use of the United States Armed Forces or for the exclusive use of such forces or ultimately to be incorporated into articles or facilities used by such forces.
(b) Paragraph 3, Article XII of said Status of Forces Agreement, authorizes the United States exemption from certain Japanese taxes for materials, supplies, equipment and services procured for official purpose in Japan by the United States Armed Forces or by authorized agencies of the United States Armed Forces. Currently, these taxes are: (1) Gasoline tax and local road tax on gasoline; (2) Diesel oil tax; (3) Liquefied petroleum tax, and (4) Consumption tax.
(c) If you are the successful offeror, the contracting officer or his authorized representative will issue customs or tax exemption certificate in accordance with procedures agreed upon between the Government of Japan and the United States of America. Tax exemption certificates for either a the end of each month or upon termination of the contract. These can be applied against future purchases of motor fuel. They will be issued only to you as the prime contractor, so, if you employ a subcontractor or supplier who uses motor fuel, you must purchase the motor fuel to secure the exemption.
