Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items

I. Contracting Activity.

36th Contracting Squadron, Andersen AFB, Guam. Contracting Officer, SSgt James McFarland III, phone 671-366-1718.

II. Nature and/or description of the action being processed.

This is a new requirement for a sole source, firm fixed price contract to upgrade and replace thirty (30) existing Scare Wars Bird Cannons model RJSW1E, one (1) Master workstation model RJSW1, one (1) Hand Held Transmitter model RJSW1B, and one Base Antenna.

III. Description of supplies/services required to meet agency needs.

The 36th Wing Safety Office is requesting approval to procure a sole source, firm fixed price contract to upgrade and replace thirty (30) existing Scare Wars Bird Cannons model RJSW1E, one (1) Master workstation model RJSW1, one (1) Hand Held Transmitter model RJSW1B, and one Base Antenna. The cannons will replace the existing system components that have become obsolete and deteriorated over time. The acquisition includes installation of the new equipment, removal and disposal of the obsolete equipment, with 5 years of quarterly maintenance service (12-month base period and four 12-month option periods, 3 year equipment warranty with an extended 2-year warranty.

IV. Statutory authority permitting other than full and open competition.

AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Reed-Joseph is the original manufacturer of the Scare Wars System currently being utilized by the 36th Wing Safety Office for bird avoidance on the airfield. IAW FAR 6.302-1(a)(ii), the specialized equipment needed is only available by Reed-Joseph due to proprietary and patent restrictions on the software program used for the existing equipment.

Additionally, replacement of the Bird Avoidance Strike Hazard System (BASH) with an entirely new system will require approximately 120 days for full installation which will significantly impact the capability of the Wings mission on airfield safety. The newly upgraded Scare Wars components are self contained systems which protect the gear components and motorized parts from the highly corrosive environmental elements on Guam, thus prolonging the useful life of the system.

Market research performed determined that other BASH systems are available in industry. However, in comparing Reed-Joseph to other manufacturers, the government found that Reed-Joseph BASH systems have a longer range of coverage which means fewer BASH systems are needed to cover the entire airfield. The market research shows that other BASH systems require electricity or batteries to operate, unlike the existing Reed-Joseph which are solar powered making them easily mobile if relocation is necessary. Current conditions do not have adequate power sources to accommodate a new BASH system and installing the power sources will necessitate Munitions and Explosives of Concern clearance that will significantly drive the cost up and lengthen the time the airfield will be unprotected.

Market research also shows that other companies did not provide routine preventive maintenance which is critical for the government due to limited manpower and resources.

The government will save a considerable amount of money by replacing the existing corroded systems and upgrading the computer software. Installing a new system that requires electrical connection will be costly due to necessary MEC clearance that has been proven to drive up costs. Additionally, extensive time delays should be anticipated for MEC execution, thus resulting in excessive disruption daily operations.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market research was conducted using previously awarded contracts by the Air Force , internet searches on BASH

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined the anticipated cost to the Government is fair and reasonable based on market research, the Independent Government Estimate (IGE), and comparing proposed prices with prices found on previous purchases.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Conduct market research to identify other viable sources, if applicable. Reed-Joseph is the original equipment manufacturer and because of the nature of the software programming, no other sources of equipment have been fostered.
