PERFORMANCE BASED WORK STATEMENT

FOR

AERIAL LADDER TESTING SERVICES

At Yokota Fire Department, Yokota AB, Japan

PERFORMANCE WORK STATEMENT (PWS)

FOR

YOKOTA AIR BASE JAPAN

AERIAL DEVICE EXAMINATION AND TEST

1.0 OBJECTIVE

To meet our mission in the required examination and testing of the Aerial Device Examination and Test, the contractor shall provide the user the service of examining and testing of aerial device in accordance with National Fire Protection Association (NFPA) 1911, Standard for

Inspection, Maintenance, Testing, and Retirement of In-Service Emergency Vehicles 2017 edition, and upon satisfying those standards, issue a certificate of compliance.

2.0 TASKS

2.1 Performance Testing & Inspection Program:

Annual performance testing and inspection, 5-year testing and inspection, and as-needed testing and inspection in accordance with NFPA 1911 is required to confirm the ladder aerial device continued for operational safety. The contractor shall provide testing and inspection of one 105’

Aerial Platform vehicle (AF08L60001) assigned to Yokota Air Base (AB) Fire Emergency

Services (FES) located in Tokyo, Japan in accordance with NFPA 1911 Chapter 11 & Chapter

22. 5-year testing shall be conducted in the first year along with annual testing and inspection.

The Aerial Device apparatus information is listed below:

Pierce Ladder Truck, assigned to Yokota AB FES, VIN: 4P1CA01G08A008845, Serial Number: 20390TR, Model: PAL

2.2 The Annual performance testing and inspection consists of the requirements addressed in

NFPA 1911 Chapter 11 & Chapter 22, but are not limited to:

2.2.1 Review service records and previous inspections.

2.2.2 Review manufacturer’s specification and performance requirements

2.2.3 Visual inspection. (All structural weldment, bolts, rivets, and other mechanical fasteners).

2.2.4 Visual inspection. (Chassis, stabilizers, turntable, torque box, aerial ladder, platform, water way).

2.2.5 Operating test. (Elevation, extension and rotation time requirements, operation controls and overrides.

2.2.6 Manufacturer’s mechanical tolerances. (Bearing clearance & backlash, cylinder drift, vertical twist).

2.2.7 Safety devices. (Warning lights and horns, interlocks, overrides, relief valves, etc.).

2.2.8 Load test.

2.2.9 Water system test.

2.2.10 Warning signs and operational limitation placards.

2.3 The 5-Year testing and inspection consists of the requirements addressed in NFPA 1911

Chapter 11 & Chapter 22:

2.3.1 All Non-Destructive Tests (NDT).

2.4 As-Needed testing and inspection consists of the requirements addressed in NFPA 1911

Chapter 11 & Chapter 22:

2.4.1 After major repairs or overhaul. Consists of all inspections and tests specified in NFPA

1911 Chapter 22 except those specifically designated as NDTs.

2.4.2 Following the use of the aerial device when the aerial device could have been subjected to unusual operating conditions of stress or load. Consists of all inspections and tests specified in

NFPA 1911 Chapter 22 except those specifically designated as NDTs.

2.4.3 When there is reason to believe that usage has exceeded the manufacturer’s recommended aerial device operating procedures. Consists of all inspections and tests specified in NFPA 1911

Chapter 22 except those specifically designated as NDTs.

2.4.4 Whenever visual inspection or load testing indicates a potential structural or safety problem. Consists of all inspections and tests specified in NFPA 1911 Chapter 22 as NDTs.

2.4.5 When there is a desire to further confirm continued operational safety. Consists of all inspections and tests specified in NFPA 1911 Chapter 22 as NDTs.

2.5 Test Results Contractor will provide a written report with an explanation of the findings to the GR and the Contracting Officer within 30 days after inspection. This report should detail all of the tests that were conducted. In addition, the results of each of the specific inspection and test items and any required repairs shall be identified.

If the equipment is found to comply with the applicable requirements, a Certificate shall be issued.

3.0 CONTRACTOR TASK REQUIREMENTS

3.1 Certification and qualification requirements for third party testing: The inspections and tests outlined in this standard shall be performed by qualified persons, a third party testing company or the manufacturer, determined acceptable to the authority having jurisdiction. If a third party testing company is employed to do NDT that company shall comply with ISO/IEC

17020 General criteria for the operation of various types of bodies performing inspection.

(NFPA 1911, section 19.3)

After completion of the inspection and testing of aerial device, a copy of an inspection and test

Report will be provided. If the equipment is found to comply with the applicable requirements, a

Certificate will be issued by the contractor. If non-compliant items are found during an inspection, a re-inspection may be required in order to obtain a Certificate. The contractor also has the option to issue a certificate when proof of all items identified as “non-compliant” have been corrected.

3.2 Place of Performance: Contractor shall coordinate with the Government Representative

(GR) and Yokota AB FES for scheduling the inspection and testing.

A level area with electricity and water will be made available for the inspection. A trained and qualified operator will be provided for by Yokota AB FES during the aerial testing.

3.3 Hours of Operation: Monday-Friday 7:20 a.m. – 4:00 p.m. daily. No services are required on weekends or U.S. Holidays, unless prior arrangements have been made.

3.4 Period of Performance: The contractor shall complete the testing within sixty (60) days after receipt of award for the first year. The contractor shall coordinate the schedule with the GR and CO for the following years at least 30 days in advance.

3.5 Clean up: The Contractor shall at all times keep the work area, including storage areas, free from accumulations of waste materials. Before completing the work, the Contractor shall remove from the work and premises any rubbish, tools, scaffolding, equipment, and materials that are not the property of the Government. Upon completing the work, the Contractor shall leave the work area in a clean, neat, and orderly condition satisfactory to the Contracting Officer.

4.0 RESPONSIBILITIES OF THE GOVERNMENT

4.1 General: Government personnel shall perform or interfere with the maintenance of the equipment while such equipment is under purview of the contract.

4.2 Government POC: Government will designate a Government POC upon contract award;

he/she will be responsible for the inspection and acceptance of contractor-performed services.

The Contractor shall coordinate all work requirements and schedules to the designated POC.

4.3 Surveillance: The Government POC will conduct quality assurance and evaluate performance through on-site inspections of the Contractor’s quality control procedures. Method of surveillance will be 100% sampling. Contractor shall guarantee all work performed in accordance with NFPA 1911 and related commercial industry standard.

4.4 Acceptance Quality Level: Due to the nature of the firefighting equipment, it is critical that

100% is the only acceptable level in performing this task order.

4.5 Government Furnished Information (GFI): The Government shall provide a letter of invitation, which the contractor has to fill out and submit to the Contracting Officer or the GR.

The letter of invitation is required in order for the Contractor Personnel to have access to the

U.S. Installation and to use facilities here on Yokota Air Base, Japan.

5.0 CONTRACTOR NOTICE REGARDING DELINQUENT PERFORMANCE

In the event the Contractor anticipates or encounters difficulty in complying with the contract performance schedule, time limitations and requirements, or in meeting any other requirements set forth in this contract, the Contractor shall immediately notify the Contracting Officer in writing giving full detailed rationale for delinquent performance. Receipt of the Contractor’s notification shall in no way be construed as either acceptance by the Government or as a waiver of the Government’s right under this contract or a law.

6.0 GENERAL INFORMATION

6.1. Holidays: The following is a list of U.S. Government holidays. No work will be performed on U.S. Government holidays. If the holiday falls on a Saturday, the preceding Friday is observed as the holiday, if the holiday falls on a Sunday, the following Monday is observed as the holiday.

6.2. YOKOTA AIR BASE FIRE PREVENTION:

The Contractor shall be responsible for fire prevention in all contracted area and be free from any potential fire hazards. The contractor shall comply with the following fire prevention guidance.

6.2.1. FIRE REPORTING

(1) The primary emergency reporting number on Yokota AB is 911 or 042-507-6560 from off base.

(2) All contractor employed personnel shall be familiar with fire reporting numbers and procedures and shall put the number “042-507-6560” into his/her mobile phone.

6.2.2. VEHICLES

(1) Access for fire fighting vehicles must be maintained at all working sites.

(2) Contractor’s vehicles shall not be parked within 15 feet of any fire hydrant of Fire

Department connection.

(3) Contractor’s vehicles shall give the right-of-way to responding fire/emergency vehicles.

6.2.3. ELECTRICAL HAZARDS

(1) All the contractor’s electrical tools and equipment shall be in good (original) working condition, and its maintenance shall be done properly in compliance with manufacturer’s maintenance instructions.

(2) All extension cords used shall be equipped with circuit breakers and plugged directly into the outlets (no other extension cords).

(3) Building utility panels shall not be blocked by contractor tools/supplies.

6.2.4. STORAGE

(1) Flammable liquids shall not to be stored inside the warehouses, next to the buildings or near exit ways.

(2) Fire protection system shall not be obstructed at any time. Carpet storage shall be neat in a manner which does not present fire/safety hazards and not to block the access to where fire extinguishers are mounted.

6.3. REQUIRED INSURANCE (This paragraph applies only when contractor’s owned vehicles are being operated on Yokota AB)

(1) The contractor shall procure and maintain during the entire period of his/her performance under this contract, the following minimum vehicle insurance:

Property Damage – ¥2,000,000

(2) Prior to the commencement of work hereunder, the contractor shall furnish to the

Contracting Officer a certificate or written statement of the above required insurance. The contractor is required to notify the Contracting Officer immediately upon cancellation or of any material change in the policies adversely affecting the interests of the Government.

(3) The contractor agrees to insert the substance of this clause including this paragraph c, in all subcontracts hereunder.

6.4. PERFORMANCE OF SERVICES DURING CRISIS DECLARED BY THE

NATIONAL COMMAND AUTHORITY OR OVERSEAS COMBATANT

COMMANDER: This service is not determined to be essential for performance during crisis as declared by the National Command Authority or Overseas Combatant Commander. In the event of crisis, the contractor will be notified by the Contracting Officer of the need to discontinue services due to base closure or other causes. If notification to discontinue services is not received, the contractor will be expected to continue performance in accordance with this PWS.

6.5. CONTRACTOR EMPLOYEES: The contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the contracting officer as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.

6.5.1. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges which contain the contractor's company name and the employee's name. The contractor shall be responsible for acquiring an appropriate number of badges to meet contractor's needs at no additional cost to the government. Military clothing may not be worn by contractor personnel while on the military installation.

6.5.2. The contractor shall not employ any person who is an employee of the US Government if employing that person would create a conflict of interest. Additionally, the contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to DODD 5500.7-R, Joint

Ethics Regulation. The contractor shall not employ any person who is an employee of the

Department of the Air Force if such employment would be contrary to the policies in AFI 64-

106.

6.5.3. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment. Military

Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor's ability to perform and their absence at any time shall not constitute an excuse for nonperformance under this contract.

6.6. CONTRACTOR’S EMPLOYEES PASSES AND VEHICLE PASSES

a. Prior to the start of on-site work, the contractor may submit applications for base passes

(listed below) to the Contracting Squadron, 374 CONS/LGCB, for all employees, including subcontractor employees, and vehicles requiring access to Yokota AB in order to perform under this contract.

(1) 5 AF Form 99, Application for Base Pass, for employees.

(2) 35 FW Form 54, Application for Vehicle.

b. Upon completion of this contract, the contractor shall return all employee and vehicle passes to the Visitor Control Section, 374 SFS/SFOP, and obtain a

Certification of Receipt. Final payment will be withheld until the contractor has accomplished required clearances.

6.7. Random Antiterrorism Measures (RAMs). RAMS are conducted on Yokota AB at varying times during a 24-hour period and may consist of measures such as spot checks of identification credentials, random vehicle searches, and site security sweeps. The contractor is subject to participating and cooperating with RAMS as directed by competent authority.

Anticipate increased RAMS during implementation of elevated Force Protection Conditions

(FPCONs).

6.8. Reporting Suspicious Activity. It is the responsibility of all personnel working and residing on Yokota AB to be alert for detecting and reporting suspicious criminal or terrorist activity. The contractor shall immediately report any on-base observed suspicious activity to the 374

SFS/BDOC. All contractor-employed personnel shall be familiar with suspicious activity reporting numbers and procedures. The primary number for reporting suspicious activity on

Yokota AB is 911 from a base phone or 042-507-6560 from a mobile phone or off-base.

6.9. Safety Standards & Guidance.

The Contractor shall comply with the Japanese Industrial Safety and Health Act located http://www.japaneselawtranslation.go.jp/law/detail/?id=1926&vm=&re. Additionally comply with appropriate safety requirements defined in AFI 91-203, AF Consolidated Occupational

Safety; TJC; AFI 91-202, Mishap Prevention Program. All work shall be conducted in a safe manner and shall comply with the current Safety and Health Requirements Manual (EM385-1-1) issued by the U.S. Army Corp of Engineers located http://www.usace.army.mil/inet/usace-docs/eng-manual/em385-1-1/toc.htm. The Contractor shall provide all necessary safety and protective equipment and follow all necessary procedures.

6.9.1. Comply with safety standards for activities related to accomplishment of this contract.

6.9.2. Have procedures to record and report promptly to the GR all available facts relating to each instance of damage to Government property or injury to either Government or Contractor personnel.

6.9.3. Immediately secure and protect any accident scenes or wreckage until released by the accident investigative authority through the GR.

6.7.4. Cooperate and assist Government personnel in conducting an accident investigation.

6.10. PERSONNEL RESTRICTIONS.

The Contractor shall not employ any person who is an employee of the United States

Government if the employment of that person would create a conflict of interest. Nor shall the

Contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval in accordance with DoD

Directive 5500.7 (for military).

6.10.1. Military Personnel.

The Contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station (PCS), change in duty hours, or deployment. Military

Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the Contractor's ability to perform. Employee absence at any time shall not constitute an excuse for nonperformance under this contract.

6.10.1.1. The Contractor shall not hire military or American civilian personnel who are assigned to the MTF.

6.10.2. Application Precautions.

The Contractor shall ensure employment applications for individuals who are seeking work under the contract shall contain a question asking whether the individuals have ever been arrested for or charged with a crime and if so, a description of the disposition of the arrest or charge is required.

6.10.2.1. The contractor shall conduct background check with local authorities on all employees.

The contractor shall not employ any convicted felons.
