MEMORANDUM FOR 374 CONS/LGCBB
FROM: 374 FSS/FSCVO
SUBJECT: Brand Name Justification for Yazaki EYE-3T Digital Tachograph
1. In accordance with the requirements established by paragraph 6.8 of AFMAN 64-302, Nonappropriated Fund (NAF) Contracting Procedures, the following information is provided as justification for the use of authority set forth in FAR 6.302-1(c), “Application for brand name description.” The following specifics are provided, in accordance with FAR 6.303 and 6.304.
a. Nature of Acquisition: The nature of acquisition is a Purchase Order from the 374th Force Support Squadron Vehicle Operations for a Grand Cabin Van with a Yazaki EYE-3T Digital Tachograph Unit factory installed.
b. Description of the Services Required: The Yazaki digital tachograph units (DTG-3 & DTG-4, and EYE-3T) are the only units that are compatible with the home station, media reader, and software that are already in use at Vehicle Operations.
c. Statutory Authority. 10 USC 2304 (c) (1): Only one responsible source and no other supplies or services will satisfy requirements for this solicitation.
d. Efforts to Obtain Competition: Yazaki digital tachographs are available direct from the manufacturer as well as being sold through other vendors/distributors and are commercially available for order and install by most domestic vehicle manufacturers and distributors as accessory equipment.
e. Listing of Sources: EYE-3T digital tachographs and accessories are available directly from
Yazaki and are also sold through companies such as Toyota Motor Company, Nissan Jidousha, Tokyo Hino Jidousha, OBS, and Kaiken.
f. Barriers to Competition: Purchase of digital tachograph units from another manufacturer would require a significant additional government investment to procure, establish, and maintain an additional workstation, media reader, as well as purchasing and maintaining licensing on additional management software and mapping software to extract/read information collected from the vehicles. This requirement should not create any increase in difficulty to the competition of the PR as a whole as the unit is commercially available for install as accessory equipment to all known domestic vehicle manufacturers.
2. User Certification. The undersigned hereby certifies that the information contained herein is accurate to the best of his knowledge and belief. Based on the forgoing information, I hereby determine the purchase of the supplies required using the exception in FAR 6.302-1, to be in order.
