SECTION I
PERFORMANCE WORK STATEMENT
FOR
LEAD ABATEMENT and FILTER CHANGE SERVICES
1. DESCRIPTION OF SERVICES: The contractor shall provide all management, tools, supplies, equipment and labor necessary to ensure that lead abatement and filter replacement are performed at Bldg 4309 Kenny drive, Joint Base Elmendorf-Richardson (JBER), AFB, Alaska in a satisfactory manner.
1.1. CLEANING SERVICE
1.1.1. SITE PREPARATION
1.1.1.1. WORK AREA CONTAINMENT AND WORK METHOD: Construct containment enclosure for each work area. The entrance to the enclosure(s) shall be outside the restricted area, the area surrounding the work area demarcated by danger warning tape and signs.
1.1.1.2. SIGNS: During cleaning/lead removal the contractor shall post signs immediately outside all entrances and exits to the work area. The signs will be at least 20 inch X 14 inch and indicate the date and place of the lead cleaning project and read "CAUTION LEAD HAZARD, KEEP OUT" in bold lettering at least two (2) inches high. The sign shall not be removed until the contract manager gives final clearance to the area. Signs stating that no eating, drinking, or smoking in the work area shall also be posted.
1.1.1.3. SHUT DOWN ELECTRICICAL POWER: Shut down electric power and lockout all circuit breaker boxes. Provide temporary power and lighting and ensure safe installation of temporary power sources and equipment per applicable electrical code requirements.
1.1.1.4. SEALING: Shut down and seal with two (2) layers of 6 mil plastic sheeting all openings, including doorways connecting work and non-work areas, heating, cooling, and ventilating air systems, to prevent dust dispersal to other areas. Plywood (3/8 inch minimum thickness) critical barriers are required to separate the abatement area from adjacent rooms.
1.1.2. CLEANING: The contractor shall clean all walls up to eight feet, floors, tables, overhead baffles and back stop areas, including the areas behind the backstop, and other horizontal surfaces within the firing range of surface lead contamination. Contractor shall assure all potentially contaminated surfaces will be High Efficiency Particulate Air ( HEPA) vacuumed, washed down with an approved cleaning product/solution working from the ceiling down. After the cleaning solution wash down, the entire area shall be HEPA vacuumed again. The cleaning areas and frequency as determined as follow:
1.1.2.1. MONTHLY: The contractor shall perform lead abatement procedures for the entire firing range to include: all floor areas, backstop/bullet catch system, barricades, and walls in firing range. Contractor will clean the room located behind the backstop and firing range.
Contractor shall change all pre-filters twice monthly. HEPA filters will be changed once monthly. The date changed shall be written on the HEPA filters in ink. The Contractor shall also empty containment buckets located behind the bullet trap monthly, and replace buckets, and bucket seals as needed.
1.1.2.3. SEMI-ANNUAL: In addition to monthly service, the contactor shall clean lead/debris from the installed ventilation duct diffusers, overhead baffles, and lighting fixtures within the firing range. Also, Contractor shall replace Action Target Dust Collection Unit (DCU) air filters in accordance with DCU maintenance manual. Attachment 1, PWS PO No. FA5205-09-M-S059 -5-
1.1.2.4. SPECIAL MAINTENANCE PROJECTS (SMPs): Provide all management, administrative support, supervision, personnel, equipment, tools, material, and other items or services necessary to perform all requirements for SMPs. SMPs are defined as work requirements within the general scope of this contract which may include separately defined or priced line items incidental to the overall work. Upon request of the Contracting Officer, the Contractor shall prepare and submit a cost proposal within three (3) days for the work requested.
The format provided in Appendix 1 shall be used for submitting SMPs.
1.1.2.4.1. The Contracting Officer will negotiate and award all SMPs over $3,500.00, and the QAP is authorized to approve SMPs below the $3,500.00 limit. The Government reserves the right to award this work to a third (3rd) party.
1.1.2.4.2. All work accomplished under SMPs shall be in accordance with negotiated agreements and the standards contained herein as well as trade standards, and shall be completed within the negotiated performance period. Upon completion of SMPs, the Contractor shall notify QAP for 100% inspection and acceptance.
1.1.2.4.3. The Contractor shall invoice monthly for SMPs once they are completed and accepted by the Government. Each SMP invoice shall be submitted with the original approved SMP.
1.1.2.5. CONTAMINATION: Should areas outside the work area become visibly contaminated with lead-containing dust or debris as a consequence of the abatement employees' work practices, the abatement contractor shall be responsible for cleaning these areas in accordance with the procedures outlined in this specification at no additional cost to the Government.
1.1.3. DISPOSAL OF HAZARDOUS WASTE: Contractor shall remove lead dust/debris in an environmentally safe manner. All hazardous waste generated from the cleanings will be placed in containers and turned into the Hazardous Waste Center (bldg 4314). Hazardous waste is not allowed to be left on-site. After the completion of work, the site will be returned to the original condition.
1.1.4. PREABATEMENT BASELINE SAMPLING: Prior to construction of abatement enclosure system, the contractor shall collect and analyze baseline wipes in accordance with methods defined by federal, State, and local standards inside and outside of the physical boundary to assess the degree of dust contamination in the facility prior to lead disturbance or removal
1.1.4.1. POSTABATEMENT SAMPLING: The contractor shall collect and analyze wipes in accordance with methods defined by federal, State, and local standards inside and outside of the physical boundary to assess the degree of dust contamination in the facility after lead disturbance or removal. All air sampling and monitoring shall be conducted by a contractor-supplied industrial hygienist or properly trained individual. Test results must indicate that the lead dust level in the tested areas is below 800 micrograms per square foot. If the test results indicate higher levels, the contractor will conduct additional cleanup as needed and will retest the areas with the analysis of the sampling to be at the contractor's expense. This procedure will be repeated until the allowable level of dust is obtained.
1.1.4.2. SAMPLING METHODS: Each work shift, a minimum of one (1) area air sample shall be collected for each 1,500 sq ft of work area or one sample for each restricted work area.
Trained personnel for the project will be required to place their area sampling pumps in the containment. Sampling pumps will not be placed by abatement workers. Area sample pumps will not be placed together or intentionally placed in locations away from the removal area.
1.1.4.3. AIR SAMPLING DATA: Data must include sample volume, sampling time, sampling locations (with appropriate dimensions and sketches), evidence of periodic inspection of sampling equipment, documentation of pre and post calibration of equipment, detailed description of work conditions, and description of worker protective devices.
1.1.4.4. EXPOSURE LIMITS ACTIONS: If at any time the results of the air samples taken inside or outside the containment by contractor's independent lab rise above the OSHA Action Level (AL) 30 micrograms per cubic meter (ug/m3), the abatement will stop immediately and clean down procedures will be required. Cleaning will continue until air sample results are below the action levels in accordance with OSHA 29 CFR 1910.1025 or 1926.62.
1.1.4.5. PERSONAL SAMPLING: The Contractor shall conduct personal sampling at all times.
1.1.4.5.1. SAMPLING METHODS: The contractor shall reference NIOSH Analytical Method handbook sampling methodology, most current version, for sampling protocols.
1.1.4.5.2. SAMPLING QUANTITIES AND PERCENTAGES: The contractor shall reference the requirements of OSHA 29 CFR 1910.1025 and 1926.62 and NIOSH Analytical Method, most current version.
1.1.4.5.3. SAMPLING DATA REPORT: All sampling data shall be provided to 673 CES/CEAN, Combat Arms NCOIC, and the CO. The contractor shall submit all documentation within 5 business days after cleaning. Reports shall include results from swipe tests, and air sampling as listed above, hazardous waste container logs, inert certifications, and preventive or corrective maintenance performed.
1.1.5. CLEANUP WORKSITE: Upon the completion of the performance, the contractor shall cleanup the work site and dispose of all non-contaminated trash and debris outside JBER according to local community standards.
1.1.6. REQUIRED PAPERWORK
1.1.6.1. MATERIAL APPROVAL SUBMITTAL: The contractor shall submit the Manufacturer’s Material Safety Data Sheet (MSDS) for chemicals and hazardous materials, if any, to the Contracting Officer for approval prior to use in accordance with instructions indicated in AF Form 3000, Material Approval Submittal. Submission of material samples, such as repair parts shall be made in the same manner upon request by the Contracting Officer.
1.1.6.2. WORK SCHEDULE: The Contractor shall provide annual work schedule within 10 calendar days after award to the contracting officer. Work schedule must be approved by the firing range NCOIC so any scheduling conflicts may be resolved prior to the commencement of work. Changes to the schedule must be immediately notified to and approved by the firing range NCOIC at least 30 calendar days prior to work.
1.1.6.3. ANALYTICAL SAMPLING DATA REPORTS: The Contractor shall submit a comprehensive sampling data report IAW paragraph 1.1.4.5.3.
GENERAL INFORMATION
1.2. CONTRACTOR PERSONNEL
1.2.1. APPEARANCE: Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the company name or by wearing appropriate badges that contain the contractor’s company name and the employee’s name.
1.3. QUALIFICATIONS
1.3.1. LICENSES/QUALIFICATION: The contractor shall possess all required license(s) to perform duties stated in this PWS.
1.3.2. TRAINED WORKERS: The contractor shall submit proper documentation that the Competent Person (CP) is trained and certified in accordance with federal, State, and local laws.
The contractor shall also submit a certificate for each worker and supervisor, signed and dated by the accredited training provider, stating that the employee has received the required lead training specified in 29 CFR 1926.62(l) and is certified to perform or supervise lead removal in the state of Alaska. The contractor shall provide employee certificates to the QAP or contracting officer upon request.
1.4. QUALITY CONTROL: The contractor shall develop and maintain a quality control program to ensure services are performed in accordance with the contract and commonly accepted commercial practices. The contractor shall develop and implement procedures to identify and prevent defective service from recurrence. As minimum, the contractor shall develop quality control procedures addressing the areas identified in Section 2, Services Summary. The government evaluator must have a specific quality control inspector to notify in case of customer complaints. The policy of the Government for Contractor Quality Control and applicable definitions are provided in the Federal Acquisition Regulations in Part 46. In all Government contracts, the Contractor is required to control the quality of service delivery and offer to the Government for acceptance only services which conform to contract requirements.
The overall control of quality must meet the specified performance thresholds for each requirement in the Services Summary
1.5. QUALITY ASSURANCE: The government will periodically evaluate the contractor’s performance by appointing a Quality Assurance Representative (QAR) to monitor performance to ensure services are received. The QAR will evaluate the contractor’s performance in accordance with Services Summary in Section 2 of this PWS, using a variety of means to include customer complaints, periodic site-visits, and 100% inspection.
1.6. GOVERNMENT REMEDIES: The contracting officer shall follow the requirements of FAR 52.212-4, Contract Terms and Conditions – Commercial Items (Mar 09), for contractor’s failure to correct non-confirming service.
1.7. AVAILABILITY OF WORK SITE AND WORKING HOURS
1.7.1. WORK REQUEST: Work schedule must be processed/approved IAW paragraph. 1.7.2.
of this PWS.
1.7.2. AVAILABLE DAYS/HOURS: The contractor shall perform work during the hours that will cause the least amount of conflict with the user’s operations. Normally Friday 1600 hours through Monday 0700 hours. The above working days and hours may not be extended.
1.7.3. RECOGNIZED HOLIDAYS: If a U.S. holiday falls on Saturday or Sunday, the preceding Friday and following Monday will be observed as part of the U.S. holiday. The following is a list of U.S. holidays:

1.8. SECURITY REQUIREMENTS
1.8.1. KEY CONTROL: The contractor shall develop, establish and implement procedures covering key control along with methods of ensuring that all keys issued to the contractor by the government are not lost or misplaced and are not used by unauthorized persons. No keys issued to the contractor by the government shall be duplicated. The contractor shall report the lost or misplaced keys no later than one hour after discovery. During hours when the CO or QAR are not available, a telephonic report, email or fax shall be given to the CO and QAR’s, outlining the circumstances of the incident. When not in use the contractor shall keep keys in a lockable container. In the event keys are lost, the contractor shall be required to reimburse the government for replacement and any and all costs required to secure the facility.
1.8.2. BASE ACCESS: The contractor shall be responsible for obtaining all necessary cards, passes, badges, buttons, and decals to perform work requirements. The contractor shall apply for vehicle passes and individual identification media through the contracting office and the 673 Security Forces Squadron, Pass and ID Section. Identification and passes shall be surrendered to 673 CONS/LGCB upon completion or termination of the contract, or upon termination of an individual’s employment.
1.9. SAFETY REQUIREMENTS
1.9.1. PROTECTIVE CLOTHING: The contractor shall reference OSHA 29 CFR 1910.1025 and 1926.62 for proper protective clothing and equipment.
1.9.2. RESPIRATORY PROGRAM: The Contractor shall implement a respiratory program IAW with 29 CFR 1910.134 available at http://edocket.access.gpo.gov/cfr_2008/julqtr/29cfr1910.134.htm and 1926.62 available at http://edocket.access.gpo.gov/cfr_2008/julqtr/29cfr1926.62.htm .
1.9.3. SPECIAL SAFETY PRECAUTION: All personnel working at a height of nine (9) feet or above will be protected from potential falls by the use of safety belts and guardrails. No materials/tools will be thrown from high places to the ground. The public shall be adequately protected from the contractor’s work by temporary barricades or fences.
1.9.4. SCAFFOLDING: When scaffolding is required, it shall be set up in such a manner as to prevent damage to any floor surface or any adjacent surfaces and equipment. Any materials damaged by the contractor shall be identified and repaired prior to contract completion and acceptance at no expense to the Government.
1.10. PERFORMANCE DURING CRISIS: This service is not determined to be essential for performance during crisis as declared by the National Command Authority or Overseas Combatant Commander according to DoDI 3020.37. In the event of crisis, the contractor will be notified by the CO of the need to discontinue services due to base closure or other causes. If notification to discontinue services is not received, the contractor will be expected to continue performance in accordance with this PWS.
1.11. SPECIAL REQUIREMENTS
1.11.1. All authorized respirators; clothing and equipment for safe handling of lead contaminated materials must be provided by the contractors and worn in accordance with OSHA and AFOSH standards. These items must be transported to and from the job site as storage is not available.
1.11.1.1. The Contractor shall be reimbursed for the actual cost of all parts or supplies furnished when performing preventive maintenance and repair of the equipment specified under this contract under the reimbursable line item in the schedule. Incidental parts / material utilized in preventive maintenance work that cost less than $10.00 per item shall be included in the monthly cost for the preventive maintenance work. The Contractor’s cost used herein is defined as the price paid to the supplier as evidence by copies of the supplier’s invoice, prepaid freight receipts, sales slips, warranties, and any other documents that identified the items purchased by the Contractor and furnished under this contract. All documents shall be available for the CO or CORs review and audit. The Contractor shall ensure that parts are not procured from an affiliate.
The Federal Acquisition Regulation defines business concerns as affiliates of each other when, either directly or indirectly, one concern controls or has the power to control the other. The prohibition on purchase of spare parts from an affiliate does not apply to affiliates of the equipment manufacture obtaining parts through the manufacture’s established commercial parts distribution system. In such cases, the cost may be evidenced by records of standard internal transfer established by the manufacture and its affiliates.
1.11.1.2. Each invoice for parts and/or supplies shall include the date(s) of service, work completed, parts used and the name of the person who authorized the service (emergency service only). In addition, invoices for parts reimbursement must be itemized (description of part, quantity, and price) and be forwarded to the QAP to support the contractor’s monthly invoice submitted via Wide Area Work Flow (WAWF). Parts and materials shall be billed at the Contractor’s cost, and the amount billed shall not exceed the cost of the same or similar parts and materials inventoried for the Contractor’s commercial work or the lowest cost reasonably available to the Contractor, whichever is lower. Shipping costs may be added to the bill for reimbursable parts, but not overhead and profit.
The Contractor is obligated to pass on any discounts earned for parts/materials other than those earned for prompt payment discounts.
1.11.2. COMPLIANCE TO REGULATION: The contractor shall comply with all applicable provisions of the following directives:

SECTION II
SERVICES SUMMARY
2.1. Overview: This Services Summary (SS) implements AFI 63-128, Performance-Based Service Contracts and identifies critical success factors for the contract. It identifies both the performance objectives for those factors and the performance threshold required for each performance objective. The Government reserves the right to perform surveillance of all services called for in the contract to determine whether or not the performance objectives and goals were met. This service summary (SS) lists the performance objectives for the required service that the Government shall surveil.
2.1.1. The absence of any contract requirement from the SS shall not detract from its enforceability nor limit the rights or remedies of the Government under any other provision of the contract including the clauses entitled “Inspection of Services” and “Default”.
2.1.2. The SS will be used as the baseline to measure contractor performance. The SS will identify the surveillance methods the Government will use to evaluate performance.
2.1.3. Surveillance methods may include: customer complaints, facility manager phone calls or e-mails and periodic inspections by the QAP.
2.1.4. Methods of surveillance may change after contract award, based on, but not limited to:
a. Acceptance of a contractor QC plan.
b. Contractor performance.
2.2. PERFORMANCE EVALUATION: Performance of a service will be evaluated to determine whether or not it meets the performance threshold. Re-performance is the preferred method of correcting any unacceptable performance.

SECTION III
GOVERNMENT-FURNISHED PROPERTY AND SERVICES
3.1. GOVERNMENT FURNISHED PROPERTY: There is no Government furnished property.
3.2. GOVERNMENT FURNISHED SERVICES: The government will furnish, where available, water, natural gas, sewage service, electricity, heating and cooling at no cost to the contractor for the sole purpose of accomplishing the requirements of this contract. Any temporary connection of electrical lines that may be required shall be installed, maintained, and removed by the contractor at his own expense.
3.3. ENTRY AND OR ESCORT SERVICE: The building facility manager shall arrange for entry and escort service, when required in secure locations on base.
3.4. POLICE AND FIRE PROTECTION: The government shall provide police and fire protection. The telephone number for Security Forces is, 552-8550; Fire Protection, 911.
Elmendorf spill response team can be reach at 552-SPIL (552-7745).
3.5. MEDICAL: In the event of a severe emergency, Elmendorf Hospital, 580-5555 or 580- 5556, shall respond and transport, if necessary, a contractor employee to the local hospital. The contractor shall reimburse the government for these services.

DEFINITIONS and ACRONYMS
DEFINITIONS
Authorized Personnel: Individuals authorized to place "calls" to the contractor for response to a trouble call, installation, removal or any other maintenance action or service covered in the Performance Work Statement
Contract Discrepancy Report (CDR): A report issued to the contractor, citing unsatisfactory services or performance for which the contractor is responsible under the PWS.
Damage to Government Property: Damage or abnormal deterioration caused by physical abuse or negligence.
Defective Service: A service output that does not meet the standard of performance associated with it in the Services Summary (SS).
Escort: One or more persons accompanying the contractor in high security areas on Elmendorf Air Force Base.
Inspection: Detailed visual examination of all operators and related structures.
Proposal: To submit in writing an offer listing discrepancies identified during inspection of hangar doors and all other types of doors.
Quality Assurance Personnel (QAP): Individuals performing a planned and systematic pattern of actions necessary to provide confidence the products or services conform to established technical requirements and acceptable performance is achieved.
Quality Control (QC): A program of action to effectively and efficiently manage the quality of performance objectives relating to standards of performance and inspections necessary to assure that the service satisfy the requirements from concept through validation.
Quality Control Plan (QCP): A quality control program providing self inspection, to ensure maintenance and repair services are performed satisfactorily.
Service Call: A call initiated periodically when a door failure or damage occurs between inspections.
Services Summary (SS): Identifies the key service outputs of the contract being evaluated by the government to assure contract performance.
Unacceptable Performance Response: Contractor performance not meeting the standards or scope of the contract.
Vehicles: All trucks, forklifts, scissor lifts, bucket trucks and trailers used by the contractor in the performance of this contract.
